Newly-announced Obama endorser and superdelegate, Rep. Pete Stark, talking about the California gay marriage decision on XM's POTUS08 earlier today:

Rebecca Roberts, XM: Congressman Pete Stark of California, a new super-delegate for Barack Obama. I wanted to get your reaction, by the way, since you're a Californian, on the Supreme Court decision to overturn the ban on gay marriage.

Stark: I think that was, you know... California usually leads on these issues of human rights and civil rights. I was quite proud of our state supreme court. We're going to have a big fight, because you know, the born-again Christians and their right wing loonies are going to put this thing on the ballot, which you can do easily in California through petitions. So it's going to be a tough fight. It'll be nasty. I find the homophobes become very unpleasant people and we're going to have to work hard to protect human rights in California. I hope we can do it. It would be a sad day for California to start to trash people's constitutional rights.

Somebody said earlier this morning that I — my colleagues, I don't — put their hands on the Bible to support the Constitution, but I've never seen them putting their hands on the Constitution to support the Bible... [Roberts says that's a pretty good line, and Stark returns to the topic.]

And I just think (muffled) we're dealing with people who want to have a responsible realtionship between two-

I wonder what they're going to do with the Mormons. I'd like to put polygamy up if they want to fight this battle. Let's go into Utah and have it out. I mean, I don't have any quarrel with polygamy, as long as they leave little kids alone, which is child abuse.

But if you want to have three husbands, be my guest. I think that to me, that's your decision.

I think it's kind of humorous you're going to find the Mormons leading the fight against gay marriage, which is an interesting commentary on what you believe.

(I would note that Rebecca Roberts of XM is way too classy to bring up Mormons or polygamy in this context; Stark brings up the false stereotype about Mormons on his own.)

So... I wonder how Senator Obama feels about Stark's characterization of the Mormon faith.

Using Stark's logic, we're trampling on the constitutional rights of killers by putting them in prison.  And before someone notes that the constitution allows the government to create laws, and laws against murder are among them... You need to solve the paradox that Californians 'voted' to outlaw gay marriage and yet the supreme court of CA claimed that law to be unconstitutional.

All he did was prove the argument that redefining marriage to fit gay marriage is a slippery slope to redefining it for polygamy, beastiality, pedophilia, etc. Stark’s kind used to scream, “slippery slope argument, slippery slope argument,” but he just proved by his words that it was a valid argument. Next up, beastiality, then we’ll start hearing the whining of “who are we to say what the age of consent is, it’s arbitrary anyway.”

“Mainstreamed” Mormons have more social capital to lose with the legalizatino of polygamy than any other organized group in the country. Over a hundred years of effort to mainstream the cult will have been wiped away by a minority splinter group of polygamists if the polygamists put forward a legal challenge to the definition of marriage as only between two people, in the state of California, in today’s political and judicial climate.

Ask yourself why should polygamists NOT put forth a legal challenge? Ask yourself why a religion that is based on eternal celestial polygamy would NOT want to lose the more valuable social acceptance in the American society rather than follow the word and teachings of their prophets. Profits over prophets argument.

If you are a Mormon that believes the church teachings that one day polygamy is to be legal in this world again, would this not be considered The Sign that the time has come?

The Salt Lake based Church is going to be fighting off attempts by splinter groups to challenge this in California for the next several decades.

Stark is not only a hateful jack@ss but he doesn’t know any Mormons. The people who are HURT by polygamy ARE the Mormons because of the misguided idea that it has something to do with them (thanks HBO and NBC!!).

Stark is an atheist just like the large part of the CA Congressional delegation and a clear majority of the CA Dem Party elected crowd. They hate Christians for their belief in values because it is in contrast to the atheist belief in NO VALUES. But they somehow interpret opposition to their views as being evil instead of just wrong. Which tells you a whole lot about the rationality of their arguments.

Mob Rule is not a paradox in need of resolution. Run from mob rule as fast as your feet can carry you. Is there anything in the California Constitution, or the US Constitution for that matter, that bans gay marriage? If not, there lies your paradox. The Court ruling was right. The voter imposed ban was/is un-Constitutional. You/we may not like that, but that doesn't change a thing. Make the move for a Constitutional Amendment, otherwise, you're wasting your breath. Thanks in advance. Point me to the clause in California's Constitution (or any other Constitution) that bans Gay Marriage. Unless it's there, this ruling was correct. BTW, "judicial dictators wish to redefine the meaning of the constitution", means what exactly? What is being "redefined" in California's Constitution? Mob rule does not replace Constitutional Governance. Blackbird.

 You missed the point of my post.  The CA supreme court ruled that one form of deviant behavior is covered by federal equal protection, while others are not.  The problem as I see it is that the court is saying a certain class of people have a right that others do not have.  The exact opposite of what people think the federal equal protection laws cover.

The court is saying that gays have the right to marry as do all others, yet hookers do not have the right to earn a living as do all others.  I wholly disagree with your assertion of mob rule.  You seem to be suggesting that in place of elections we should have a handful of elites make decisions for us.

If not, there lies your paradox."  No there is most definitely NOT anything in either document that bans gay marriage.  Anything not specifically provided for in the constitution is left to the states to decide.  This sentence actually works against your argument, not for it.

I thought you were refering to Pete Stark as being ex-Mormon.

As for the gay guys on Survivor, no they didn’t say they were ex-Mormon.
The one guy said it was a real survivor, in his life having to deal with being Mormon and being gay.

What I am suggesting is (nothing else to be assumed), we are a Representative Republic. We are NOT a Mobocracy. You want Gay Marriage banned, it's time to amend Constitutions. No there is most definitely NOT anything in either document that bans gay marriage. Anything not specifically provided for in the constitution is left to the states to decide.

Let's see.  I agree with the opinion of the 3 dissenting judges.  That "Without foundation, the majority claims that to hold the domestic partnership laws constitutional would be a statement that it is permissible, under the law, for society to treat gay individuals and same-sex couples differently from, and less favorably than, heterosexual individuals and opposite-sex couples.” (Maj. opn., ante, at p. 118.) This is simply not so. The majority’s narrow and inaccurate assertions are just the opposite of what the Legislature intended.

To make its case for a constitutional violation, the majority distorts and diminishes the historic achievements of the DPA, and the efforts of those who worked so diligently to pass it into law. Domestic partnerships and marriages have the same legal standing, granting to both heterosexual and homosexual couples a societal recognition of their lifelong commitment. This parity does not violate the Constitution, it is in keeping with it. Requiring the same substantive legal rights is, in my view, a matter of equal protection. But this does not mean the traditional definition of marriage is unconstitutional.

The majority refers to the race cases, from which our equal protection jurisprudence has evolved. The analogy does not hold. The civil rights cases banning racial discrimination were based on duly enacted amendments to the United States Constitution, proposed by Congress and ratified by the people through the states. ...  Here the situation is quite different. In less than a decade, through the democratic process, same-sex couples have been given the equal legal rights to which they are entitled.

But you on the other hand state matter of fact "The Court ruling was right."  That we were a "Mobocracy" attempting to rule and were slapped down.  Well, yippie-do-da.  Why the hell did the CA Supremes waste so much time deliberating this when all they had to do was ask you "Mr. Serious Discussion" what the true answer to this probing question might be.  Your flagrant use of mobocracy belies your underlying emotional not intellectual attachment to this ruling.

My statement that 4 judges mobbed the other 3 is extremely prescient particularly when coupled with your silly "mobocracy" comment.  These 3 judges may be correct, I think they are, but in our system the majority rules. And I'm quite fine with that.  You on the other hand believe majority votes are righteous when they are in your favor and "mob rule when not.  Now who is truly serious?

Equal protection is probably the most overused and misused amendment to the U.S. Constitution, and I'll make an assumption that the equivalent section of the California constitution is likewise misused.  Think about it.  The 14th amendment to the USC was ratified in 1868 and it is extremely obvious that it was intended for slavery.  Why do I think that?  Simple, women couldn't vote until 1920 when the 19th amendment was ratified.  Why did we need the 19th amendment?  After all we had the 14th that said "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

So one can easily extrapolate that the equal protection granted in the 14th doesn't cover women, yet covers homosexuals and their right to marry.
