imagine if Robert Bork had been on the court instead of Anthony Kennedy. He was the 1st choice for the Supreme Court by Reagan in the fall of ‘87. After his confirmation became a circus, Reagan had to choose again. The next guy, Douglas Ginsburg, withdrew since he smoked marijuana. The 3rd nominee was Anthony Kennedy, who was part of the five votes today. This could have been 5-4 the other way.
Congress are the representatives of the people.
Our guns are next.
If Obama wins, there will be a lot more rulings like this, perhaps by larger margins.
