Five members of the US Supreme Court just sided with known terrorists currently detained at Gitmo in Cuba. In doing so, they not only provided aid and comfort to enemies of our state, but offered Constitutional Rights written solely to protect the rights of innocent legal US citizens to known terrorists, and placed every American life in mortal danger in that process.

If I remember correctly, I think it was Jefferson who first had to deal with the issue of irregular combatants, (with the Barbary Pirates) despite his deep humanistic idealism. This is one area where the responsibilities of the Executive to protect the people have always deviated from the Judicial.
Religious freedom in prison has allowed many of these prisoners to build themselves up spiritually and mentally. Their comittment and abilities have actually improved in the spartan, focused environment of jail. Releasing them in-mass, with their community intact, is virtually guaranteed to put anti-terror efforts back 10 years and result in lots of dead people.
The most dangerous ones will disappear into Europe for a few years, before revitalizing the financial, recruiting and counterintelligence capabilities of AQ. Then, we will see a different, more virulent form of AQ with an even deeper desire and ability to kill.
