Mark Levin pens another cogent analysis in dissenting against George Will's column and the latest Supreme Court assertion of governmental branch supremacy. Within, Mark says:
And that "black hole" exists for two primary reasons: 1. to detain unlawful and lawful combatants until the end of hostilities, thereby keeping them off the battlefield where they can kill American soldiers and, in the case of terrorists, kill civilians (as they have extended the battlefield to our cities); and 2. to interrogate the detainees to secure information that might save the lives of American soldiers and civilians. Now, it seems to me that these are very important objectives. At least they were considered as such in past wars.
If I may offer a military perspective here at NRO's MilBlog as a supplement to the linked analysis, and specifically that cited above, it would be simply this:
We have a very real problem in that a not insignificant number of those released from Guantanamo Bay thus far have been found coming back at us from the same direction where we rounded them up in the first place, killing our troops or, most recently, killing Iraqis in a suicide bombing in Mosul.
Does it not strike supporters of the Supreme Court decision that some within our society, including 5 Supreme Court justices, are working very hard to confer Constitutional rights on these same unlawful enemy combatants, which consequently puts our own troops at increased risk? Is it not also depressingly ironic that we are now allowing access to civilian courts that our own military members do not have access to?
Might we have some in detention who are not the worst of the worst? Yes. But why is risking injustice to a small number of them a less acceptable risk than the lives of the very troops who keep finding them coming back the other way? This is a perverse inversion of risk acceptance.
The lives of our troops are clearly in this interpretation worth less than the potential improper detention of a few. Spin it any way you like, that's the math. And those deployed in the field can do the basic math.
And I personally find the irony maddening that those on the Left who champion the decision (some in their silence) who thus put our forces at increased risk are the same who constantly remind us that they care about the troops infinitely more deeply and sincerely than the warmongers who send them into battle. Really?
Well, if supporting this decision to confer Constitutional rights on those foreign anti-American terrorists who seek their own death in relentless pursuit of visiting carnage on us is how you 'support the troops,' just ^%$@! stop already.
It's that simple.
Levin is fast becoming my favorite talk guy - just the right combination of passion and brains.
If they are being held because they are killing troops then
release them and immediatley round them back up but kill
them in “battle”. Problem solved.
I like Mark too, just wish he didn’t hold back so much as to how he really feels.
Anyone who doesn’t believe more (on BOTH sides) will die as a result of this LUNATIC ruling they are naive in the extreme.
Will is an idiot. At CPAC this year, he told us why we needed to support McCain and he had the gall to say that conservatives must resign ourselves to the fact that the illegals can’t be deported and will be staying here whether we like it or not. He was roundly booed by all of us at the dinner—much to his surprise. Will doesn’t seem to understand the basic concept of the rule of law.

Let’s just say that our troops’ methods will evolve and take into consideration the lunatic ruling by these five insane black-robed Marxists and handle situations on the battlefield in an appropriate way.

Fighting for McCain? More like fighting for the Republic. This is it. If the first generation, highly suspect quantity becomes the leader of the free world during these perilous times, it could easily spell the end.
