After reading Justice Anthony Kennedy's recent majority opinion in Boumediene v. Bush, I feel like I need to install a "1984"-style Big Brother camera in my home so Justice Kennedy can keep an eye on everything I do.

Until last week, the law had been that there were some places in the world where American courts had no jurisdiction. For example, U.S. courts had no jurisdiction over non-citizens who have never set foot in the United States.

But now, even aliens get special constitutional privileges merely for being caught on a battlefield trying to kill Americans. I think I prefer Canada's system of giving preference to non-citizens who have skills and assets.

If Justice Kennedy can review the procedures for detaining enemy combatants trying to kill Americans in the middle of a war, no place is safe. It's only a matter of time before the Supreme Court steps in to overrule Randy, Paula and Simon.

In the court's earlier attempts to stick its nose into such military operations as the detainment of enemy combatants at Guantanamo, the court dangled the possibility that it would eventually let go.

He says the law violates "separation of powers," which is true only if "separation of powers" means Justice Kennedy always gets final say.

I had heard today that Obama had said if Osama Bin Laden is caught, he would also have the benefit of habeas corpus.

Exactly. Obama wants to invade Pakistan to find and kill Obama, unless of course we only capture him, then we must read him his Miranda rights and give him a cell in the U.S. with cable TV, and free lawyer for a trial in a U.S. court. And of course he'd get the right to discovery, which would include exposing sensitive U.S. secrets and technology.

The detainees are not held because they are guilty; they're held to prevent them from returning to the battlefield against the U.S.

A point that needs to be made again and again.

Its not about guilt or innocence in war-time. He was no doubt doing right by his own lights, and quite probably acting within the laws of whatever organization deployed him. Its a judgment of perceived threat, and its a military opinion.

If you're holding someone who you believe to be no threat, such as an innocent farmer in the wrong place at the wrong time, you cut him loose.

If you believe him to be a threat to you, a combatant, legal or otherwise makes no difference, you keep him in custody.

And if you believe him to be a threat even in custody, if he is someone who must never walk free again under any circumstance, you sweat him for whatever information he has and you hang him. Sooner is better than later.

I am really steamed about this.

In effect what these 4 justices did was to naturalize these detainees. They now have the same constitutional rights as I do.

We really must hold our noses and get McCain elected (hoping beyond hope that he does not stab us in the back on judge appointments) it’s just too important.

This is just the start, from nationalizing the oil industry, gay marriage and what not, this is just a taste of the horrors we can look forward to.

It’s interesting to read the columns of supporters of the recent decision. They twist themselves into logical knots trying to justify treating pows terrorists as deserving of some kind of trial. I assume the same kind of fair trials terrorists give our soldiers. I can’t be sickened enough by this latest stupid decision. Kelo was awful, but this one will end up killing more Americans.

Bush could do as Andrew Jackson did and ignore them. Jackson said, “They have made their decision. Now let them enforce it.” In reality, the justice branch has no authority over the executive or judicial branches.

Foreign prisons are not the answer. Too many terrorists have bribed their way out of these places. Entrusting hard won prisoners to foreign prisons, especially Arab & muslim prisons, is just DUMB! Witness the recent “escape” of 800+ prisoners in Afghanistan. Indonesia released the Bali bombing mastermind.

I say quiz these prisoners for a very short time, then apply the FULL force of the Geneva Convention - shoot them as Illegal Combatants out of uniform.

I know we are supposed to have a system of laws but this is ridiculous!

I say ignore the bastards and let them try to do something about it. The Supreme Court and other judges in this country, are ruling by fiat and someone should at least attempt to do something about it. (Just don't ask an attorney to help you.)

I say again, The Government in Washington is broken, maybe for good.

Justice Kennedy and four of his cohorts already had their minds made up, no point in confusing them with facts and reality.

Despite a great deal of rhetoric devoted to the contrary, no decision is irreversible. Several sessions of the US Supreme Court themselves have cheerfully gone ahead and reversed judicial thinking a number of times in the past.

One would hope this Dredd Scott decision may at some time in the future be reversed.

We all know how the Dredd Scott percolated through the entire society of America. Even more than the Fort Sumpter attack, it helped launch the War between the States, and attempted secession of the Confederate States.

The next logical step is prosecution of members of our military in the courts for attempted murder.

If the court rules of criminal rights and trial are paramount, aren't also the criminal rules of evidence and arrest? Instead of doing everything to prevent harm to the defendants before detaining them, our military was constantly hunting these men down to kill them without regard to judicial evidence and due process of law.

The same goes for the Administration. They have been holding "open season" on these terrorists, er, unconvicted defendants around the world without regard to their Constitutional rights.

These sound like obvious war crimes to the Left, don't they? After (if?) they gain power in 2009, shouldn't the criminals of the illegally selected Bush Administration be prosecuted for them in the International Court in the Hague when they are no longer in office?

That is the obvious next step.
