U.S. company: crash lawsuit governed by Islamic law

RALEIGH - To defend itself against a lawsuit by the widows of three American soldiers who died on one of its planes in Afghanistan, a sister company of the private military firm Blackwater has asked a federal court to decide the case using the Islamic law known as Shari’a.

The lawsuit “is governed by the law of Afghanistan,” Presidential Airways argued in a Florida federal court. “Afghan law is largely religion-based and evidences a strong concern for ensuring moral responsibility, and deterring violations of obligations within its borders.”

If the judge agrees, it would essentially end the lawsuit over a botched flight supporting the U.S. military. Shari’a law does not hold a company responsible for the actions of employees performed within the course of their work.

Erik Prince, who owns Blackwater and Presidential Airways, briefly discussed the lawsuit in a meeting today with editors and reporters at The News & Observer. Prince was asked to justify having a case involving an American company working for the U.S. government decided by Afghan law.

“Where did the crash occur?” Prince said. “Afghanistan.” ...

If it helps defend our honorable and heroic protectors of the American Way against a lawsuit by those greedy soldier types, then I’m all for it.

If this is true, then it sounds like Blackwater's management knows good and well that its emplpoyees fouled up and will be held responsible in a US court of law.

To try and get out of compensating the widows of three American soldiers killed in such circumstances by invoking this is absolutely, totally' and utterly shameful.

I hope the judge does not give in to this sham and blatant attempt to avoid responsibility, if that is what it is. With the MSM, you never know.

I guess the FLDS can then claim that it is OK to molest underage girls since it OK according to FLDS laws. Where does it end ...

Blackwater is being very shortsighted here: Do they want to be defendants in a bunch of lawsuits by jihadists that are ruled upon by US courts based on sharia law? Short answer to each of those lawsuits: the jihadists win because they are muslim and Blackwater isn’t.

Sleazy, slimy, underhanded, a travesty, a shame, crawfishing to avoid any legitimate inquiry, dodging responsibility ( obviously must be guilty of incompetence or worse) otherwise why Afghani law to adjudicate a claim about American citizens in American courts.

BLACKWATER SUPPORTS SHARIA.

Now, even the sexual harassment and rape suits by Blackwater employees in Iraq can be submitted to the Iraqi Sharia courts.

And we wonder why the war on a tactic is the object of scorn, ridicule and contempt.

Under the federal rules of civil procedure, they have no grounds for such motion. The best they can do is try to convince the court that the case should be tried in afghanistan (and therefore be dismissed in the U.S.) because it is impossible to get witnesses to the U.S., for example, or transport key evidence. Doesn’t sound as though this option would work either.
