Last time I read Article II of the Constitution it said the Executive was commander-in-chief. Therefore, since we have separation of powers, and since these are prisoners of war, it seems to me the President has the right and responsibility to NULLIFY the ruling and ignore its directive. He would be upholding our laws, and providing Americans with a valuable civics lesson if he did.

Oh yes. Release ‘em. Let some of them go in San Francisco. Let some of them go in Berkeley. Some in Boston, too.

Maybe one or two in Johnstown, PA - home of Judas Murtha. And put a few in Kucinich’s district.

Oh yes.

Here’s a proposition:
1. Incarcerate Mohammed in Kennedy’s hometown.
2. Try him in that town.
3. If convicted, serve time in the closest federal penitentary.
4. If freed, release him in that town.
5. Repeat process in MA, IL, CT, NY and the home of every terrorist-loving Senator.
6. Wait for the first NIMBY reaction.

That's precisely the problem: we are not at "war" within the Constitutional meaning of the word., and the prisoners in Gitmo are not enemy combatants fighting under a foreign flag; they are terrorist non-state actors. The President is not free to overrule or ignore the Supreme Court in the exercise of his wartime powers as Commander-in-Chief no matter how wrong-headed their ruling might be.

As a consequence, we are likely going to have to free a group of highly dangerous individuals, and if we do so, I would suggest they be split into two groups and dropped off at the doorsteps of Harry Reid and Nancy Pelosi.
