Suspected copper thief shot by Garland store owner's son
The Dallas Morning News ^ | 10 July, 2008 | KIMBERLY DURNAN

Garland police say they planned no criminal charges against a 25-year-old man who fatally shot a suspected copper thief this morning.

The shooting happened shortly before 1:20 a.m. at the Bargain Town Variety & Furniture store in the 5700 block of Broadway Boulevard.

The business owner’s son, identified by police as Sunny Sheu, had been guarding the roof after the store had been recently hit by copper thieves.

The son said he confronted a man who had climbed on the roof, police said. The son fired his gun, striking the man in the torso, police said. The man fled, climbing back down the building and collapsing on the ground.

The person shot was identified as Edward Preston Hickey, 43. According to investigators, he had an extensive criminal record consisting of mostly nonviolent offenses such as theft and public intoxication.

It looks as if Texas is going the right way. Too bad this small time criminal chose to put himself in deadly peril. Stealing property, which takes takes part of your life to aquire, is stealing a part of your life.

They interviewed the father whose copper had been ripped out of his a/c unit twice I believe. He said in broken engrish “they tell me have two option...hire off duty cop...or secrety god!”

Looks like he got the latter, hehehehe. Good shooting.

Just to quote an earlier post: A man convicted of murdering his adoptive parents was put to death by lethal injection in Texas on Thursday, the second prisoner executed in the state since the U.S. Supreme Court lifted an unofficial death penalty moratorium in April. Carlton Turner's was the first of three executions scheduled for July in Texas

I love starting my day with a story affirming how smart I was to get out of Kali and move here -- even better with a heartwarming story that has a happy ending like this one...

Perhaps. But sometimes an innocent person is shot by mistake although people have a right to protect their life and property.

Bargain Town Variety & Furniture - if you live near Garland, Tx, make sure you buy something!!!

P.S. I think the title should have been “Copper Thief Settles for Lead.”

Not hard to pick out the “not so innocent” on your property at 1AM. Scumbag got what he deserved. And, no, he didn't kill him over $50 worth of copper, he killed him in defense of his property and livelihood.

If you don't climb someone's store roof in the dead of night with the intention of thieving from their store, you don't have to worry about getting shot. As I've heard said before, nothing good is usually happening between the hours of 2AM - 6AM.

Try about $300. dollars worth of copper. The going rate of copper at salvage yards is high. That is why it is being stolen. This man was more than likely a meth addict supporting a habit. In my area salvage yards make you show ID when bringing in copper and brass. So much is being stolen from power, telephone, and even graveyards!

More "murder" stats for the VPC morons to bloviate over.

When "law enforcement" no longer functions as it should, then those duties fall back on "We the People" who gave them those powers to begin with.

This cleansing of the criminal class from the gene pool is LONG over due.

Trespassing -- on the roof of a business -- at night?

Not an "innocent" person. That is known as "dead meat" in Texas...

Perhaps. But sometimes an innocent person is shot by mistake although people have a right to protect their life and property.

I was thinking of this sad incident.

Louisiana Indicts Man in the Killing Of a Japanese Boy

Published: November 5, 1992 NYTimes

A startled homeowner who fatally shot a 16-year-old Japanese exchange student after the youth had knocked on the wrong door while looking for a Halloween costume party was indicted in the case today.

The indictment, returned by a state grand jury after more than seven hours of deliberations, charges the defendant, Rodney Peairs of Center, La., near Baton Rouge, with one count of manslaughter. The maximum sentence on conviction is 45 years' imprisonment.

The authorities said Mr. Peairs, 30 years old, would turn himself in on Thursday.

The slaying of the exchange student, Yoshihiro Hattori of Nagoya, Japan, occurred on Oct. 17 and angered people throughout his country, where the episode underscored the image of America as a violent land where guns are far too plentiful.

The youth was shot after he and Webb Haymaker, a 16-year-old boy whose family was Yoshihiro's host, had knocked on Mr. Peairs's door while looking for a nearby party. The police say the two teen-agers startled Mr. Peairs's wife, who asked him to get a gun. When the two boys knocked on a side door, Mr. Peairs answered it armed with a revolver and ordered them to freeze, a command they did not understand.

When Yoshihiro moved, Mr. Peairs fired. According to his companion, Yoshihiro was holding a small camera that Mr. Peairs may have mistaken for a weapon.

so because one person doesn't follow the rule of "identify your target" everybody in the country of over 200 million should be disarmed.

I've got a better idea.

You choose to not own a firearm.

I'll choose to have one.

You'll be safe and I'll be safe.

So exactly how does the story you posted relate to this story? Do you actually think there is no difference between someone knocking on a front door at night (I’m assuming not that late since they were going to a party) and someone climbing up on a store owner’s roof at 2 in the morning. A store owner mind you who had people break into his store to steal stuff multiple times.

The metal theft of choice in these parts are catalytic converters. Couple of mexicans cut the converters off of 30 new cars recently, in Kingsport, TN.

I didn't say anything of the sort nor suggest that you give up the constitution right to a firearm. People have a right to defend their life and property by force if necessary. But trigger happy folks sometimes shoot innocent people and that is not a good outcome.

It’s always been legal to do this in Texas. :D

Reminds me of a Red Steagall song called "We'll Stand Up and Fight." A family crosses into Texas and is accosted by road agents, but the father drops them with his shotgun. He buries them, and then rides his family into town:

Then a rider approached as I reined in the horses
We shook hands and howdied and talked for a spell
My eye caught his badge and I read, "US Marshall"
I was churning inside, and I'm sure he could tell

He said, "There's some bad men who prey on new settlers."
I told him what happened at noon yesterday
I was sure he'd arrest me, but he just smiled politely
Said, "Thanks for the help," and then bid us good day

So exactly how does the story you posted relate to this story?

The poster of the Texas shooting suggested "It looks as if Texas is going the right way." My initial comment suggested that the innocent are sometimes shot by mistake when someone believes they are protecting their own as happened in Louisiana. The unfortunate incident in Louisiana actually occurred as I remembered and as cited on the link. Incidentally, the Louisiana shooter was found not guilty but it had to be a sad time knowing he had killed an innocent boy.

There was no corrolary between what happened in Louisiana and what happened in this story. There is no doubt what that guy was doing up on the store owner's roof at 2AM. He didn't get lost, he knew exactly what he was doing. Can't you see that?

Your retort to this story is like the liberals who compare what's going on down at club Gitmo to Nazi concentration camps. In other words, there is no comparison.

OldT-

Each man believed he was using deadly force in defence of life or property; one was correct and one was not and that is the relationship between the two events. While the Texas fellow correctly believed he was protecting his roof from a thief; the homeower believed he was protecting his home from evil men. The result in the second case was bad news for all involved. Obviously, an intruder on a store owner's roof is not lost and cannot be up to anything good. However, someone at the door may be religious missionaries, home invaders or a Japanese exchange student. Should the use of deadly force by legal gun owners become more common, we will see more criminals thwarted and crime decrease but we will also see more innocents shot by mistake, a statistical inevitability.

(C)ompar(ing) what's going on down at club Gitmo to Nazi concentration camps is is a false argument.

No, one was a case of bad judgement and one was a case of good judgement. The law failed in delivering justice to those kids killers in Louisiana. You know, the more pools that are built in people’s backyard, the more accidental drowning deaths we are going to have. It’s a statistical inevitability. Should we curb or outlaw pools?
