Ignoring the court (The U.S. Supreme Court's Heller decision!)

It's been barely three weeks since the U.S. Supreme Court upheld the Second Amendment, tossing the District of Columbia's strict ban on handgun ownership as an unconstitutional infringement on the individual right to bear arms.

As you'd expect, D.C. officials have been busy little bureaucrats since then, trying to figure out a way to get around the high court's decision.

On Monday, the D.C. council announced emergency legislation designed to update the gun ban. As expected, it's a joke.

Instead of simply acknowledging that individuals have a right to own handguns in the district, the legislation would still require that all firearms be kept in the home unloaded and disassembled or equipped with trigger locks.

Some handguns would be allowed, but only those that carry fewer than 12 rounds of ammunition.

Those who wish to register a handgun in the district must pass a battery of tests and will be limited at first to only one weapon.

In other words: Purchase a handgun, but if you're lucky enough to jump through the registration and regulatory hoops, don't count in a practical sense on ever being able to use it to defend your home.

"Clearly, D.C. is doing everything they can to ignore the Supreme Court ruling," said Chris W. Cox, an NRA lobbyist.

The district is setting itself up to lose another costly legal challenge. Last time we checked, D.C. wasn't so flush with cash money that it could afford to keep its lawyers focused on finding ways around the Bill of Rights rather than attempting to comply with them.

Last time we checked, D.C. wasn't so flush with cash money that it could afford to keep its lawyers focused on finding ways around the Bill of Rights rather than attempting to comply with them.

But the lawyers get paid whatever happens, while the citizens of D.C. continue getting shot without the means of self-defense.

Why is it that we the citizens of the U.S.are required to follow the laws of this country under threat of a loss of our personal liberties when our governments can violate our laws and violate our liberties without Penalty.

This has to stop.

I hope the N.R.A. and other conservative organization sue the crap out of D.C. not to mention boycotting the place.

I for one wouldn't want to live in D.C. under these tyrants.

Whats amazing, is these idiots continue to get re-elected.

I'd like to think this would upset a few DC voters, but I'd probably be wrong.

Once again, left to the rest of the country to fix the DC government.

Then we won’t get anywhere. They’re happy to keep this tied up in court ad infinitum.

Citing ‘em for contempt of court, and hitting ‘em (not just threatening) with 30 days in jail, will get their attention.

If the District isn’t going to obey the law, then I say that residents of the District are fully justified in openly defying the District government on this matter.

With a Democrat Federal Gov’t looming on the horizon, DC officials may figure that they need only wait a few months and they can do whatever they please. As far as the costs of lawsuits, why should DC care? DC is basically the irresponsible teenager of the federal govt and if they overspend, somebody will take care of them. Besides, the money doesn’t come out of the offcial’s pockets.

As regards the recent refusal to follow the US Supreme Court ruling, I find that somewhat surprising. Even I did not think they would simply balk at following the USSC ruling and continue to infringe on a basic human right. Apparently, we are further down the road from our earned Constitutional heritage than I realized. Is this not one of the first times in the history of the United States that a local govt has thumbed its nose at the Constitution, the USSC, and the rights of the people?

If I were a DC resident, I would carefully consider whether the DC govt could be trusted with registration of arms. They do not appear to be a legitimate governmental body as evidenced by their actions. There should also be consequences for the violation of human rights in America. In other news, Robert Mugabe ignored his nation’s constitution and laws and simply did what he wanted to. Of course, that is what happens in a third world dictatorship.

No big deal just buy a trigger lock and keep it next to you gun. If you ever had to use it how could they tell it was unattached when you pick it up. They can’t enter or search your house without probable cause to secure a warrant and I would never provide them with that.

This is outrageous. It is a slap in the face of ALL AMERICANS. It is OUR CAPITOL, not a little Bantustan run by pygmy local politicians.

Under the Constitution the Congress has final authority over DC. They should dispense with home rule if this is continued, or at least simply write their gun laws for them and put outside of “local control”.

That would make for lots of fun and fireworks.

I wish you could explain this to me, I’ve been hearing people saying the same thing since the ruling.

In my case it NEVER entered my mind that the law would NOT be summarily flouted. Haven’t you been watching these people? Can’t you predict what they will do by now.

I live in Suffolk County Long Island NY and: No you CANNOT obtain a gun here any easier than before the ruling, Just as I understood would be the case.

Amen! D.C. has shown itself to be ungovernable. Just have the President appoint a commandant to run that asylum. In the meantime, arrest D.C.'s mayor, acting AG, and council members for conspiracy to violate the Constitutional rights of the residents of D.C.

They might be that stupid. But, of course, the administration changing will have no beneficial effect on DC's attempt to ignore Heller.

Everything is resting on the courts, which have already stated what the law is, using their power to enforce their own orders. I would be very surprised if either of the DC Court of Appeals or the Supreme Court hesitates to accept an emergency appeal from Heller. I think that there is a good chance that DC has only one week left of crafting gun laws. After that, it may be the courts who will say what the gun laws in DC are.

This could work greatly to our advantage. The DC Court of Appeals could, after having found DC in flagrant contempt, rule that NO registration shall be permitted since the effect has been to deny the right to keep and bear arms. Is the Supreme Court going to then reward DC for its contempt? Or let the lower court make the call? I think the latter.

In a perfect world, the first federal judge to hear the lawsuit against this would toss this new law and appoint Wayne LaPierre as special master over D.C. for gun laws.

As I read the pages of Free Republic and watch the evening news the answer struck me as to why many feel America is slipping.

We read and watch many reports about how teenager’s, especially in urban dwellings grope, rape, assault, rob and kill one and other with little if any remorse or regard for the law.

“Take all you can get and give nothing back”, supposedly the ole pirate saying goes.

We read and watch many reports on how Wall Street has mislead investors on more than one occasion, leaving its mess to a taxpayer funded mop up more often than not. The Savings & Loan debacle Michel Milken and his penny stock scheme, insider trading convictions, Enron and Adelphia and now the mop up of the “Credit Crisis” which is political correct speak for banks lending money to people who never earned that privilege. The FBI is now looking into the possibility of fraud in many of those failed institutions. Once again it would appear that the law was not respected by those who know better…once again with little if any remorse or regard for the law.

We read and watch many reports on how illegal immigrants are smuggled into this country and work in what basically is a cast system of people with little or no rights to stand up and demand a fair wage.

When they get sick, once again the taxpayer picks up the tab, but we are told by our government and business leader’s that they are good for our economy…once again with little if any remorse or regard for the law.

What we all know is the businesses use and abuse these people that are using fake social security numbers…only helping to mask the pending Social Security disaster that is soon to follow while the effect of an illegal immigrant wage depress the wages for the average law abiding citizen. The law be damned, profits usurp the law…and once again with little if any remorse or regard for the law.

We all watched in amazement when a sitting President wagged his finger at us and stated he did not have sex with that woman, then wanted to know the definition of “is”…all the time skirting the law…and once again with little if any remorse or regard for the law.

Now we watch the District of Columbia flagrantly disregard the Supreme Court’s ruling in Parker vs. Heller with the passage of its new firearms registration process.

Individuals, city, state and most of all our Federal Government routinely are engaged in a power grab, whether it be by the treat of force as in a street crime or the threat of force by a government entity such as the District of Columbia depriving the honest, tax paying citizen of their Constitutional rights through the abuse of courts and regulations.

I see is one set of laws for me and the lack thereof for others. The law, for all practical purposes only works to ensnare the under-represented and the weak.
