D.C. Disses Supremes on Gun Law
Center for Individual Freedom ^ | July 16, '08

It shouldn't have come as a surprise that the District of Columbia can and will continue to all but completely disarm its law-abiding citizens after the Supreme Court ruled otherwise. After all, this is the same D.C. that was home to the most restrictive firearms laws in the country - until the Court struck them down. The same D.C. that banned the law-abiding citizens from possessing any handgun. The same D.C. that forced its law-abiding citizens to keep the few firearms they could possess both unloaded and disassembled or locked at all times. And the same D.C. that has disarmed its law-abiding citizens for decades despite achieving the title of "murder capital of the United States." The new D.C. restrictions don't contain a per se ban of handguns, but they may as well. The restrictions make it nearly impossible to get the few handguns that are not prohibited. Residents can apply for handgun permits but the process will take weeks or months. And what a process it is, involving a written exam, proof of residency and good vision, registration fees, fingerprinting, and criminal background check. As if that were not enough, any gun owners must allow D.C. to do ballistics testing on their weapons! Perhaps sometime soon the courts will tell D.C. lawmakers they need to be concerned with upholding the Constitution, rather than disobeying it.

Conservatives have been disappointed with some Supreme Court decisions but they've elected to redress those issues by peaceful and legal methods, not flagrant disobedience. The D.C. leadership illustrates how many liberals will obey only those laws they choose to obey, not admitting that the ultimate end to such a course of action is anarchy. And it continues the illegality of self-defence in the murder capital of the nation.

Maybe a $1 million dollar a day fine will bring the D.C. leaders into total compliance quickly...This is open defiance and should not be tolerated by the District Court or SCOTUS..

Restrictions such ar those described in the article are just as onerous as the Poll Tax was in the deep south...Besides, how many people were able to read and write during the early days of our country ?...But then liberals never have been in touch with reality so what do you expect ?

The topper is that the handguns must be transferred to a licensed, approved firearms dealer in DC for the “subject” to obtain possession. Only problem is that there are no dealers in DC.

Contempt for the law.

Contempt for law abiding citizens.

This is your Democratic Party, America.

These are the "common sense" restrictions that Marxist Obama must have had in mind.

A 1 million dollar a day fine against individuals in the DC gubermint. A fine against the city gets passed on to working taxpayers - the victims here. Jailed and fined for the DC politicians is good for me.

Not only are they subverting the Constitution but thy’re ignorant of all the research projects and studies that have proved that firearms possessed by law-abiding citizens actually reduces violent crime. A good example of this is one of the most exhaustive studies ever done, by Dr. John Lott. He published the results of his comprehensive research in his book, “More Guns, Less Crime.” But such facts and rule of law under our Constitution don’t deter the D.C. liberals and their ilk. The people in Baghdad are much safer than those in D.C.

Good point. D.C. is almost totally black and ultra-liberal. I wonder how they would have reacted if all the court decisions upholding civil rights had been disobeyed or ignored by the rest of the nation.

They aren’t ignorant, they just don’t care. They think that they’re smarter than “we the people”.

I can’t argue with that. It just means they’re not ignorant but dumb!

O.K., I'm still waiting for some entity (NRA/ILA/etc, etc) to actually DO something about this bizarre interpretation by DC that still restricts gun possession by its citizens against SCOTUS rulings. We all talk about it. When is someone going to DO something?

DC will never give in. They just need to change the location of a comma and then declare that their firearms policy is revamped, Defend that all the way up to the SC, which won’t cost them anything with Soros et al money and ACLU, lose again then move another comma or replace a couple of words with synonyms and do it again. Forever. Eventually they will get a Hussein appointed Court that will rule their way and it will all be legally over. DC will have won and the whole country will have lost. Or they could just decide to ignore the Court. How would the Court’s ruling be enforced?

The problem is that there are no legal consequences for public officials who ignore the courts, unless someone makes them, and there does not seem to be anyone who has the guts to make them.

Individual D.C. citizens should comply with the SCOTUS
ruling and ignore the new D.C. regulations.

Excellent question. It sort of reminds me of President Andrew Jackson’s question, “OK, the justices have made their decision; now, who’s going to enforce it?” I did hear Wayne La Pierre of the NRA (I think it was on Glen Beck’s radio program) and he said the NRA is doing all it can and that it means going back to court on each of the issues on which the D.C. legislation fails to comply with the Supreme Court’s ruling. If that’s the case, who knows how many years it will be tied up in legal limbo? It’s pretty sad when a very clear decision is held in contempt both in letter and spirit. But the saddest thing is that D.C. has chosen to trash the Second Amendment of our Bill of Rights with impunity. You’re right - doesn’t anybody CARE anymore?

It strikes me that that’s a really great idea! Disobey local laws which are clearly unconstitutional and follow the law as articulated by the highest Court in the land. That’s in the spirit of the original patriots when they disobeyed the Stamp Act, etc. in the name of a “higher” law as expressed in the Declaration of Independence.

That’s a very scary thought because it could easily take place. As many conservatives have pointed out, we should already be frightened for our freedoms when we recall that four of the nine justices voted FOR the D.C. gun ban! And we know that Obama will appoint justices that make Ginsburg look like a moderate!

According to the NRA, it is not possible to sue the DC
Officials.

Why is that? I don’t think D.C. officials personally can be sued but their legislation can be contested.
