A roulette worker at Foxwoods came up the big loser when he bet that nine women gathered around his table - including an NYPD sergeant, FBI special agent and Long Island cop - couldn't understand the gross comments he was making about them in Spanish.
It turned out the party also included Michelle Marigliano, a businesswoman who used to teach bilingual education and was able comprende every disgusting word. After complaining, the women were invited into the high-rollers' lounge, given free drinks, a free breakfast and two free rooms for one night at the Connecticut facility. They were told at least one worker was fired.
But the women are going for another spin of the wheel, hoping for a giant payoff in a lawsuit seeking $500,000 each.
The bizarre bilingual battle started in September, when the women, who also included an assistant to the director of oncology at Long Island Jewish Hospital, coordinated their schedules to celebrate 40th birthdays for three of them.
The FBI agent flew up from Florida where she works white collar crime. The NYPD sergeant is assigned to the Communications Division.
The women's first night went pleasantly, but on the second, Marigliano was stunned to hear two Hispanic employees spinning the roulette ball and handling chips making highly off-color remarks in Spanish
"Great - we have a bunch of dumb broads that don't know how to play," one allegedly said. "That blonde in the corner believes her t-ts are going to get her places."
They said one was a "dyke."
And that was the tame stuff.
"These c- - -s need a big d- - - to loosen them up and then maybe these hard-asses would tip better."
Marigliano and her friends cashed in their chips.
"We were tipping and I was winning $300," she said.

Sheesh, seems like they could have just shot back with a couple of barbs of their own in Spanish and it would have taken care of it.
Does everyone have to be such a victim these days? Can’t anyone just stand up for themselves?

So businesses have to hire Hispanic workers or face discrimination lawsuits. And then when they do hire Hispanic workers who run their mouth in spanish, they face harassment lawsuits. Seems fair.

Because Foxwoods is run by the Mashantucket Pequot Indians and is built on tribal land, the tribe is claiming that it cannot be sued in conventional courts because it has “sovereign immunity.”
Tribal leaders say the women’s complaints can be best resolved in their tribal court.

You go to the Argument Clinic and enter the wrong room.
The reporter obviously meant 50th birthday for three of them. The rest are well into their 6th decade on earth.
Those women deserve nothing from the casino beyond that.
The casino workers deserved to be fired by the casino.
If their being fired does not satisfy the women the offended, they can take legal action against the workers themselves.
However, holding the casino responsible for the actions of the workers which they could not reasonably predict, and which they did their best to remedy once they were informed of them is insane.
Maybe it’s time for English to be the Official Language and the and the jerks who talk en Espanol learn their lesson.

Also there is well established employment case law that employers cannot stop their employees from speaking languages other than english on the job.

Absolutely agree. Unless there is clear evidence that the casino deliberately harbored and encouraged this type of behaviour or negligently doing nothing in the face of repeated outrageous acts, then these women got as much as they should.
Furthermore, I fail to see how these women have been damaged, not to the tune of $500,000. We all have to put up with boorish behavior, and so one cannot claim long term mental distress because of crude comments.
As the US Supreme Court has recognized, we don't have a right to not be offended by anyone else.
If they were being offended, they had the options of leaving or of asking the casino to remove the offending people. They asked the the casino to remove the offending people and the casino accommodated them.
If the casino had no accommodated them, they could reasonably demand a refund of money they were paying to stay there if they were staying at the casino, and maybe even travel costs to come to the casino. At most they could demand to be paid for their time in coming to the casino and the time they spent there.
I don't see any reason why they should be paid large sums for "suffering" a little verbal abuse from a couple of crude and rude people who were sharing what they thought to be a private joke, especially when those people were acting on their own in making those remarks, not in their capacity as casino employees.
Employers are forced through equal opportunity laws to provide reasons if they choose to not to hire people and to provide reasons for firing people. If they can't fire people before they have reason to do so without getting accused of wrongful termination, how can you hold them financially liable for an employee's actions before those actions have been brought to their attention and they have had an opportunity to resolve the situation?
I think the casino was generous in how it handled the situation.
