When California legalized same-sex marriage a little more than a month ago, the state left things vague for one segment of the population: prison inmates.
What happens when same-sex inmates want to marry each other? It's a problem California prison officials are now trying to figure out.
In the past month, more than 1,500 same-sex marriages have been certified by the county of San Francisco alone. Just north of the city is San Quentin State Prison.

Me either, and I worked in New York's prison system for 23 years. Some of New York's prisons were allowing conjugal visits between male inmates and their wives. Since sex acts between inmates is against the rules, I wonder how California will deal with this situation. I'm assuming of course, that California also has conjugal visits. If two male inmates aren't allowed to have sex behind bars, how can the State allow two males, one an inmate, one a citizen, to have sex behind bars? The decision on this will be interesting.
When they're both dead of AIDs, what's the problem?
I classify this debate in the same category as “How many angels can dance on the head of a pin”. It is simply does not rise to the level of deserving consideration.
Um, California didn’t exactly legalize it...the courts forced it upon them, no? I’m sure the opinion didn’t specify. This is the problem when judges legislate from the bench....
Here’s another aspect of it: if prisoners can marry other same-sex prisoners, than it could lead to same-sex polygamy, since some of the married prisoners will pimp out their “wives” to other inmates.
How’s that for diversity?
What about two inmates who were "married" prior to incarceration?
I disagree though.
Another problem they'd have to deal with. They don't realize the can of worms they open up when they make these stupid decisions.
Simple solution: Ban conjugal visits. Nobody in prison should be getting laid.
No cable TV, weight rooms or other niceties either. In fact all prison sentences should be immediately cut in half and all prisoners should immediately be required to do hard labor for the duration of thier sentences. Let's make prison a place where no one wants to be.
I totally agree, but unfortunately, the courts don't, and they play a big role in the running of facilities. When they started letting inmates sue for rights behind bars, they created a monster.
As it always does when the government meddles in human affairs.
