Supreme Court delays Texas execution

HUNTSVILLE, Texas, Aug. 5 (UPI) -- The U.S. Supreme Court considered a last-minute appeal by a Mexican national Tuesday night, temporarily delaying his scheduled execution in Texas.

Lawyers for Jose Ernesto Medellin, 33, say that he was denied access to a Mexican consul when he was arrested for participating in the rape and killing of two teenage girls.

Medellin's execution was scheduled for 6 p.m. but put on hold when the Supreme Court decided to consider his claim, McClatchy Newspapers reported. A spokeswoman for Gov. Rick Perry said the state was waiting to hear from the court before proceeding with the lethal injection.

The Texas Parole Board rejected a request Monday for a stay or commutation of sentence.

Prison officials moved Medellin to a cell next to the death chamber in Huntsville Monday night.

Why? What kind of nonsense is this?

Justice delayed is justice denied.

I think this thing is on hold awaiting a decision by the SCOTUS.... If they don’t rule before midnight then things will have to start over.

http://www.chron.com/disp/story.mpl/front/5924476.html

Jose Medellin is in a holding cell near execution chamber.

The warrant for his death expires at midnight tonight. If the high court rejects the request for the stay before then, he will be executed. If not, a judge will reset an execution date, but must wait at least 30 days.

Our justice system is one great big joke.

The victims get no justice. Every last drop of justice is preserved for the jackals who live among us. And when they’ve drained that last drop, a new pitcher is nearby.

I guess we’re now a ward of the World Court.

Altogether now folks, bow down and give honor where honor is due.

Sovereign nation? What a joke...

When I was a kid, America was a sovereign nation like the Indian reservations are now. NOBODY told us what to do! Especially a bunch of artsy-fartsy, European girlymen. I sure do miss those days.

“What kind of nonsense is this?”

Its called a cave to political presure.
The Supremes don’t want to look bad to their party circuit friends in Washington.

After what the guy did to those two girls he should have fried long ago.

Texas should ignore the Court and just do it. After all, what can the black-clad dudes do? Nothing. It’s time that
Americans with common-sense just start IGNORING the rulings of a despotic court.

This confuses me..... but hey, I’m just a nobody, and the Supreme Court is, well, Supreme.

It’s crazy how rapist murderers get support from the leaders of the world, but victims of violent crimes, and their families, are ignored and told to get over it.

Apparently he never asked for access to a Mexican consul until after he was convicted.

As an illegal immigrant (especially from Mexico) Medillin enjoys rights American citizens aren't even afforded. We have become an insipid joke, and an Obambi presidency will just make us moreso.

I told my wife a little while ago that I was born 100 - 200 years too late. The America we have become is an insult and an embarrassment to the America we once were, warts and all.

“Apparently he never asked for access to a Mexican consul until after he was convicted.”

I think this case is something like an international Miranda rights case. The complaint is apparently that the murderer was not informed of his right to contact the Mexican consul upon arrest. Not that that has ever been a right, but I think that is the basis for the appeal.

Was this a multiple-justice decision or a single judge like, say, Ruth Ginsberg?

One of the comments:

Pilar @ Aug. 5, 2008 at 9:13 pm This case only demonstrates how uncivilized are the poeple from the U.S. Pure segregation!!!!

The obligation of the State of Texas, was to inform Medellin about Mexican Consulate intervention, he was only 18 years old and this is not the first case of this kind of law violation agains mexicans.

Medellin did a terrible thing to those girls and we ask God´s mercy and forgiveness as he didn´t find it in Texas. Perry gave a prize to Medellin, he´s already in a better place than you all are, full of hate and ignorance.

I hope Medellin´s death gives peace to the soul of this 2 poor girls parents, unfortunatelly I don´t think so. They have to forgive, not to kill.

Do you feel better after Husseins death? Do you have your twins towers back again? and all the poeple who died there is alive right now?

I don´t think so, stop killing people!!!!
