After backing the sovereignty of the state of Texas and rejecting international meddling, the US Supreme Courts consideration of a last-ditch appeal has put illegal alien rapist/double murderer Jose Medellins scheduled execution tonight on hold.
Stay tuned for late-breaking developments.

NO!!!
Isn’t there always a last minute SC appeal ?
They have decided 5-4 to go with the execution.
It’s going forward? !!!
They have already voted tonight?
Bump-ping!
Michelle Malkin is on top of this and she says it’s on hold.
???
Cruel and unusual indeed—to the families of the victims! How outrageous.
The witnesses should have their popcorn by now and are ready for the show to begin.
The application to recall and stay the mandate and for stay of execution of sentence of death, presented to JUSTICE SCALIA, and by him referred to the Court, is denied. The application for stay of execution of sentence of death, presented to JUSTICE SCALIA, and by him referred to the Court, is denied. The petition for a writ of habeas corpus is denied.
Texas has over 3 hours to send this scumbag back to his Maker.
Long Live Justice Scalia!!

Good.
Looks like this is in an ever-changing state of flux.
No, SCOTUS issued no stay. They denied a stay by a vote of 5-4. Opinions here: http://www.scotusblog.com/wp/wp-content/uploads/2008/08/medellin-opinion-8-5-08.pdf
The “delay” (which was not a formal stay at all) was due to those dissents being written.
Why the news black out on this?. No Google or Yahoo news.
“Let’s do it!” - Gary Gilmore
Check the links on Malkin’s site. Seems to be confusion.
Go Scalia! Time to take out the trash.
Nope, no confusion. This is the latest news.
Kill him anyway. SCOTUS decisions aren’t enforced anyway. Just ask the residents of DC after SCOTUS told them they had a right to keep and bear arms...... DC said screw it and just passed a new law as bad as the last.
L
Yes the Scotus has already ruled (Scalia tonight)
AP says it’s going forward.
Wiki said there were five guys convicted and sentenced to death for the murder of those 2 poor girls. Have the other 4 guys been executed yet?
I love that we’re no Europeans!
Again, just so everyone is clear, THIS is the official and final word of the Court:
http://www.scotusblog.com/wp/wp-content/uploads/2008/08/medellin-opinion-8-5-08.pdf
Any media report saying that it’s still being “delayed” is incorrect. The delay was only due to the dissents being authored. No formal stay was ever issued by the SCOTUS.
Medellin can now be executed before midnight.
Fast breaking changes? Bears watching in any case.

Another 5-4. We cannot let Obama pick the next couple of justices.
Thank you!
“Under a 1963 treaty signed by the United States and 165 other countries, citizens from any of the participating nations are entitled to contact a consular official without delay if they are arrested overseas.”
THANK A KENNEDY!!
The Bush Administration would be compelled by law and our constitution to answer to any and all TREATIES signed by this country.
It was Kennedy who signed the stupid thing in 1963!
It’s odd that Michelle is posting the delay. I usually trust her.
I wouldn’t be surprised if there are a lot of twists and turns on this.
Skin him alive and mount the hide at the border as a warning.
Times a wastin'...
Although a cruel person would give him another month to think about his upcoming trip to Hell....

Of course, there is no such thing as international "law", since law is an attribute of sovereignty and there is no sovereignty superior to that of the People of the United States.
In exercising that sovereignty, we have delegated our judicial power as follows: "The judicial Power of the United States shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish."
Thus, Mr. Justice Breyer's view, if it ever commanded a majority, would impugn our sovereignty by limiting its exercise as commanded by a body other than an Article III court.
You need to look at the USSC decision. 5-4 to execute him tonight.
Adidos, MF!
You need to email Michelle Malkin.
This is what happened:
The sicko was supposed to be executed at 6 PM Texas time. The guy had a stay request pending at the Supreme Court 6 o’clock came and the Supreme Court had not announced its decision regarding the stay. Thus, Texas held off on executing the guy (the delay) until it heard from the Court. The Court a few minutes ago handed down its decision/opinions in the case. Michelle’s news is now old. (And slightly misleading, but that is the fault of the MSM, not Michelle.)
I didn’t read the courts reasons but if they are not for soverign reasons then Texas was just full of hot air if they don’t execute.
It’ll never happen, but comments to that angle ought result in immediate removal from the Court. There should be nothing uttered from the Court that cannot be directly tied to words in United States law.
Hey Breyer. Who enforces your "international law?" Those U.N. sissies in their powder blue helmets? ROTFL!!! Gimme a break!
Why not you? I could care less if she got it wrong.
Well that makes me feel better!
You’re the one who began telling me what I need to do. That’s why not.
Well, if by some fluke Obama does win, looks like we got a lot of cleaning house that needs to be done in Texas before this year is over!!
Kill him, then argue the merits..
There were only three, sentenced to die that is. One has already been executed and one more awaiting an execution date to be set.
If Congress can amend the Constitution, withdraw that, if two thirds of the Senate and the president of the United States can amend the Constitution by entering into a treaty which cedes article 3 functions to a body other than our own courts, eventually they can do away with the whole Constitution.
There should be only two ways to do away with the whole Constitution, by authorized constitutional amendment process or by revolution.
