The National Review ^ | August 8, 2008 6:00 AM | Andrew C. McCarthy

In an astounding finale to the first military-commission trial, Salim Hamdan, Osama bin Laden’s personal aide, has been sentenced by a military commission to five-and-a-half years in prison — five-and-a-half years — upon conviction for the war crime of providing material support to al-Qaeda.

They'll let him loose (and if you and I are real lucky they'll tell us the time and place eh), and then return him to his homeland.

There they will cut his head off ~ figure a 1 or 2 minute prayer (with no trial), and that's the end of that.

If the Leftwingtards hadn't agitated for giving these guys trials, he'd be sitting down to dinner with duck a la orange, a dry white grape juice, and some fresh veggies.

Ain't life strange.

When they say military tribunal, do they mean theirs, or ours?

You got precisely what Bush could rig up, and no more. Whoever believed that this entire Gitmo game was going to dish out appropriate or even inappropriate justice....was kidding themselves. This was a Rummy and Cheney episode that just didn’t have much thinking tied to it....and now is the end result. As the months roll by, and you figure the cost of this, and the limited amount of intelligence they really gained (especially from the 4th grade drop-out that we just sentenced)...then we’ll sit back and have a good laugh.

To be truthful here...I don’t blame any of the officers now involved. They have to manage with a prosecution that used torture, and then try to remedy this into their entire case, and sentence. If any guy gets more than a ten-year sentence...it’ll surprise me. I think this will be the max you see handed out.

Come on now. Who has Hamdan killed and how? There is nothing there. This is the lower boundary that the commissions will award.

How do you know he hasn’t killed anyone?
How is it possible to investigate someone like that when the “crime scene” is the whole world of terrorist actions?

Is McCarthy straight up on this, or is he mealy mouth pleading like people who oppose the death penalty by saying, “that’s the easy way out , I want them to rot in jail.”

Besides, it's now time to try him in VIRGINIA.

Here the situation is that if you are just along for the ride and someone gets killed in the commission of a crime, even if it's only the criminal doing the dieing, you are eligible for the death penalty.

Certainly Hamdan was, as it were, "along for the ride" ~

Yes, that's a fine standard of proof - kind of like that applied by the maniacal left against us.

Well, this didn’t make me quite speechless (or I wouldn’t be posting this, just lying on the floor), but this comes close.

Looks like Al Queda should line up every warm body they have and tell them to surrender. They can promise them a nice place to live, great eats, and no hard work. It costs a bundle for the infidels to transport and keep these prisoners. What a great way to harm America.

Boy, think how great it would be if the Gitmo head count could be built up to 100,000 or more! What a great way to fight a war — just give up gracefully and in masses.

Do I really have to add a sarc? Oh, OK — SARC

They should all be held for the duration of the war.
IF they want a long war then they get imprisoned for a long time.
No trials until after and only for the top players.
