Let’s see. He’s a cop. His wife is a dispatcher. The ‘victim’ chased him and his wife with a vehicle. The ‘victim’ was drunk. The ‘victim’ tried to run him down, and that’s when the shots were fired.

Oh, wait, he’s a cop, and this is FR, home to a bizarre number of people with a Pig Complex.

She didn’t try to run him down, he was in his car.

Yeah I guess we’re funny in that we don’t want off duty cops shooting people at random.

Ummmm.....no.
This is a case where two stupid people encountered one another. Violence ensued. BOTH deserve jail time.
I feel sorry for the kid. He had no choice in any of this, and got shot because his mother’s a drunken moron.

He was off duty. If somebody ran into my car in a parking lot and I opened fire on them and hit them and their kid I’d be looking at a lot more time than he got.

There are a couple of minor details you left out. One, he brandished a weapon at the woman prior to the woman backing up. Two, he never left his vehicle. Three, he shot from his vehicle into another vehicle.

In other words, his life was not in jeopardy at the time of the shooting. The other driver may have been drunk, but there is enough evidence to show that, when he brandished his weapon, she tried to protect herself. At this point, the other driver did not know he was an off-duty cop.

The officer should never have fired his weapon.

Negative Sandreckoner,

She did not try to run him down. Stick with the facts. When he displayed his gun(brandished?) she being a female and not very good at backing up(and possible intoxication) "sideswiped" his car, and He shot his gun 5 times through his closed window and into her car.

I live close to this site and it all took place within one city block.

I'm one of those with the "pig complex" but I have to say that this one looks like it might have been a reasonable shoot.

If you are defending yourself from a dangerous assault and you have a firearm you can and probably should use it.

The kid getting shot is the only indication of any possible negligence. . .

He should be fined a weeks pay for poor gun control, the drunk driver lived.
It’s reasonable to believe he didn’t see the child in the car.
The prosecutor missed the call on this incident.

What if he weren't a cop? Do you think he'd still be out still be free?

I’m offended that you would refer to jack boot thugs as pigs.

i am very surprised i wasn't pinged to this article. i am FR's resident "boot-licking thug" because i am a cop and i can usually be found in heated (yet very civil) discussions with fellow freepers regarding all-things police.

what a case this one is. the female was obviously the aggressor since she followed the cop, she was in an impaired state, and she initiated the physical contact.

that being said, a cop is taught to fire when someone is using or he believes will imminently use deadly physical force against them or someone else. simply stated, did he think he was gonna die? i will not 2nd guess. i was not there.

If you have followed the story from the beginning the “she tried to run me down” is the focal point. Apparently other witnesses dispute that part. The cops have not released much info on the case and are playing it very close. There is much not publicly known about the incident. The DA took 5 months to decide - that says something.

1. In a traffic dispute he brandished a weapon. That's illegal

2. He fired on someone who damaged his car. That's illegal.

At least for civilians. But I understand there is a lower standard for cops

Oh, quit bitching. Freepers have no problems with cops as a whole, just the 'roided up scumbags who suffer from short d!ck syndrome that happen to make up the majority of younger cops these days.

What a moronic thing to say. Cops nowadays think they are cowboys right out Tombstone. They shoot dogs on their own front porches, attack a paramedic, shoot a family, and your here defending them? The police now think it is open season on normal people. When is it going be to much for you? When they storm your home on accident and shoot your wife or kids or dog. Then say “opps sorry wrong house, we were looking for your next door neighbor... Enoughs enough.
