Kentucky Student May Sue After Mall Claimed Her Dress Was Too Short for Shopping

A Kentucky college student has hired a lawyer after she was escorted out of a mall by security on Sunday because her dress was deemed too short, MyFOXBoston reports.

Kymberly Clem, a 20-year-old student at Eastern Kentucky University, wore the dress Sunday after purchasing it from the mall in Richmond the previous day, the Richmond Register reported Tuesday. After just a few minutes inside of the mall, a security guard approached her and expressed concerns over the length of the garment.

According to MyFOXBoston, the guard informed her that several female patrons had complained that she was disrupting their shopping experience because their husbands were “checking her out.”

“He made me turn all the way around while he stared me up and down,” she told the Register “The only thing he said was that other people didn’t like the way I looked, so he wanted me to leave.”

Clem’s sister Kendra told the Register that while the dress was short, it was not exposing any of her “private body parts.”

While Clem has not yet filed suit against any entity, she has hired local defense attorney Wes Browne to represent her in a possible case, the Register said.

While I don’t know if she has a case, a couple of things strike me as stupid. First, she thinks she should be able to wear the skirt because she bought it at the mall. She could also buy lingerie at Victoria’s Secret (at many malls) that would be inappropriate to wear out in public. Second, she seems concerned that the security guard looked her up and down. Sheesh, didn’t she wear an (apparently) ultra short skirt to make men look? Goodness, what an airhead. Having said that, she will probably win the suit.

Agreed. While I don't think the dress would violate any indecency laws, we are not talking about agents of the state (police, etc) trying to prevent her from appearing this way in public. It was representatives of the mall, a private entity, that were responding to the concerns of their patrons.

She’s an airhead. She probably purchased it to get men to look at her. She got her way. Not being able to wear it for a longer time in the mall disrupted her plans, so she is getting a lawyer. Which results in her geting her picture in the newspaper and on the internet. Maybe she is auditioning for a playboy spread. She’s kinda cute, but she’s still an airhead.

Well, let's try another scenario. Let's say she borrows a shirt from you, then shows up at a party at your house wearing nothing but the shirt. You other guests complain, and you ask her to leave. She then sues you. Since you lent her the shirt in the first place, according to you, she has a case?

The dress is certainly revealing, but I've actually seen a lot worse. It's really more for a night club setting, but I guess -- flaunt it if you can.

Personally, I wouldn't be caught dead in such a dress -- but that's only because I don't like people pointing and laughing.

The mall, being private property, can certainly set their dress code. And she, being a private citizen, can simply take her business elsewhere. God bless the free market. If she sues, she has to prove she was damaged in some way. If she didn't like how the security guard looked her over, it does seem a bit disingenuous since she was wearing a dress that showed off her considerable physique.

She could have bought a tool belt from Sears and worn just that. Lots of things you get at malls that would not be appropriate to wear, or carry, in the mall.

You can’t set up an REI tent in REI and spend the night.

Someone else mentioned Vickie’s Undies, then there is Hollister and Abercrombies.

The dress is intended as outerwear. The mall shouldn't sell it if it doesn't want it worn there.

Why don't they just not rent to the shop selling the "objectionable" dress? Why not pick on the shop instead of the girl?

Someone said the following to a group of young women, and it is so amazing a sentence, even in its brevity and simplicity:

"If you aren't for sale, don't advertise."

By the way, and I try to ask this of different women, what is the point of wearing a top that is clearly designed to show off the breasts (let's be frank here), and then spend all day pulling up the top so folks don't see them? I'm a guy, and I don't get it...

I don’t get a lot of what women/girls wear. When I taught HS many girls would wear the *short* little tops (and many shouldn’t have just based on the bellies they had!) and spent their entire day pulling them down. I also see women spend their entire day pulling their pants up. Who knows? Maybe I’m old, but I’m way more into comfort these days....

More info:

Mall officials claimed the dress 20-year old Kymberly Clem was wearing wasn’t a dress at all.

In fact, they say, it was a shirt made to be worn with pants.

Kymberly disagreed saying, “ ... to me it’s a dress. It was on a dress rack. As far as it being a top, that’s clearly to me not true.”

Clem has received a lot of media attention since wearing the dress.

She now says she’s uncomfortable wearing the garment, so she’s going to auction it off giving the money to charity.

I've never seen a dress code at a mall, have you?
Others here can (and have) made deliberately ridiculous and outlandish comments about not being able to wear something they bought at a mall(underwear, gun, etc.), but this is a dress, made to be worn in public. I'm sure underwear is sold at a store in the mall, too, but you don't see someone putting it on and wearing it out the door, do you?

Ummm. actually... that turns out to be not correct. But the tent setters have to have some cluefullness and be slick about it.

Sounds like that’s THEIR problem, not the girl’s.

One has to wonder if these women let their husbands go to the beach?
