(Lafayette Hill, Pennsylvania – 08/21/08) - Philip J. Berg, Esquire, [Berg is a former Deputy Attorney General of Pennsylvania; former candidate for Governor and U.S. Senate in Democratic Primaries; former Chair of the Democratic Party in Montgomery County; former member of Democratic State Committee; an attorney with offices in Montgomery County, PA and an active practice in Philadelphia, PA, filed a lawsuit in Federal Court today, Berg vs. Obama, Civil Action No. 08-cv-4083, seeking a Declaratory Judgment and an Injunction that Obama does not meet the qualifications to be President of the United States. Berg filed this suit for the best interests of the Democratic Party and the citizens of the United States.

Philip J. Berg, Esquire stated in his lawsuit that Senator Obama:

1. Is not a naturalized citizen; and/or

2. Lost his citizenship when he was adopted in Indonesia; and/or

3. Has dual loyalties because of his citizenship with Kenya and Indonesia.

Berg stated: “I filed this action at this time to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.

There have been numerous questions raised about Obama’s background with no satisfactory answers. The questions that I have addressed include, but are not limited to:

1. Where was Obama born? Hawaii; an island off of Hawaii; Kenya; Canada; or ?

2. Was he a citizen of Kenya, Indonesia and/or Canada?

3. What was the early childhood of Obama in Hawaii; in Kenya; in Indonesia when he was adopted; and later, back to Hawaii?

4. An explanation as to the various names utilized by Obama that include: Barack Hussein Obama; Barry Soetoro; Barry Obama; Barack Dunham; and Barry Dunham.

5. Illinois Bar Application – Obama fails to acknowledge use of names other than Barack Hussein Obama, a blatant lie.

If Obama can prove U.S. citizenship, we still have the issue of muti-citizenship with responsibilities owed to and allegance to other countries.

I was frankly surprised to see that Berg is a lawyer. He cannot possibly have been a litigator. The Complaint is such an abomination on so many levels, it is hard to believe a lawyer actually drafted it. In its present form, this case is going nowhere.

I sent an email to my brother in Washington, DC yesterday, as soon as I heard about Berg's lawsuit, and received this reply from him last night:

I consider my brother a reliable source on this. So, on the word of his friend, we have it that -- although the media have been ignoring the Lawsuit story in public, in private it was "all anyone is talking about" at the National Press Club in Washington, DC, last night.

AND that the media folks are worried that circumstances might force them to report on Philip Berg's Lawsuit.

published an article on June 9, 2008 stating that a research team went to Mombassa, Kenya,
and located a Certificate Registering the birth of Barack Obama, Jr. at a Maternity Hospital,
to his father, a Kenyan citizen and his mother, a U.S. citizen.
At the time of Obama’s birth in 1961, Kenya was a British Colony. There is a
purported Canadian Birth Certificate, posted on the Internet, in the name of Barack Hussein
Obama, Jr.; however, the date of birth is shown as August 23, 1961.

You misunderstand the entire case. The question is not whether Obama is a citizen, but whether he fulfills the requirement of a “natural born citizen” ie born-on-American-soil. A citizen and a natural born citizen are two different things. I hope that cleared it up some, I know it’s a bit confusing.

According to the folks at Texas Darlin', if Lalo Soetoro legally adopted Barry and gave him Indonesian citizenship when he married Stanley, then Barry lost forever-after his status as "a natural-born citizen of the USA."

After returning from Jakarta to Hawaii, BHO could regain citizenship under INS laws, but it would be as a [re-]"naturalized citizen."

Q.E.D., Barry would be ineligible to run for president.

The folks at Texas Darlin’ don't know the law. No one, including a father, adoptive or not, of a minor child, can renounce a person's American citizenship for him.

A word of warning: if the pleadings refer to the same “Andrew Martin” in Illinois that many of us recognize, this man is a perennial candidate. He was denied a law license by the State Supreme Court.

Obama travelled to Pakistan in 1981, at the age of 20. It is suspected that he used an Indonesian passport to do so. If this can be established, it would show an acceptance of Indonesian citizenship by Obama as an adult.

Irrelevant as to his citizenship. There is only one way to renounce your citizenship. Go to an American embassy or consulate and fill out the specified forms. Obtaining and using a foreign passport does nothing.

Of course, if it turned out that he had used a foreign passport, that may (or may not) disqualify him from serving as President. The decision of disqualification will be made by each American voter as individuals. In the voting booth.
