Liberal Rock Stars to McCain-Palin Campaign: Stop Using Our Songs

The McCain-Palin jukebox options are shrinking.

The latest rockers to tell the Republicans to cease spinning their albums are the women from Heart, who were chagrined to hear their song "Barracuda" play at the Republican convention as Alaska Gov. Sarah Palin hit the stage. Palin, a star high school basketball point guard, was nicknamed "Sarah Barracuda." The official Heart website states

that "Ann and Nancy Wilson of Heart have informed the McCain/Palin Campaign that Universal Music Publishing and Sony BMG have sent a cease-and-desist notice to not use one of Heart's classic songs 'Barracuda,' as the congratulatory theme for Sarah Palin. The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission. We have asked the Republican campaign not to use our music. We hope our wishes will be honored."

And on Entertainment Weekly's website

the Wilson sisters add that "Sarah Palin's views and values in NO WAY represent us as American women. We ask that our song 'Barracuda' no longer be used to promote her image. The song 'Barracuda' was written in the late '70s as a scathing rant against the soulless, corporate nature of the music business, particularly for women. (The 'barracuda' represented the business.) While Heart did not and would not authorize the use of their song at the RNC, there's irony in Republican strategists' choice to make use of it there."

This is not the first time a liberal rock star has asked McCain to stop spinning his or her tunes.

Can the bands and or record labels legally compel someone not to play their music? Does that not violate “Fair Use” provisions?

They should be glad we are using their songs. At least they are getting play. When is the last time you heard a Heart song not on Muzak?

At least Brooks & Dunn didnt throw a hissy-fit when Obama started using their song “Only In America”...I guess the difference between leftists and conservatives/moderates...

Oh, the GOP should stick to music written by capable people. “Flight of the Valkyire” or something classy and uncopyrighted by twits.

What I don’t understand is if the campaign is paying royalties to ASCAP or BMI to play licensed music, it really doesn’t matter what the artist says.

And, they are getting royalties.

Who gives a flip. They are old and has beens, seen them on that old rock show trying to sell CD’s like 90 of them for $19.95, but wait there’s more....

They can broad cast the songs by paying ascap or bmi for use. The stars can squawk all they want but can’t do anything about it.

Not at all since they played almost the entire song. Because of copyright laws they need a license to play the song. If they have the license and pay the fees than as I understand it Heart doesn’t have much to say. They could withdraw the song from all licensing arrangements and take it private, but then no one could play it. I suppose they could modify the license to exclude any political event, but again if they haven’t too bad, so sad.
