Court Finds Army Commander Was Denied Job For Revealing He Would Start Work as A Woman

A former Army Special Forces commander passed over for a job as a terrorism analyst at the Library of Congress because he was in the process of becoming a she won a discrimination lawsuit on Friday.

U.S. District Judge James Robinson ruled that the Library of Congress discriminated against Diane Schroer of Alexandria, Va., by not giving her the job after the former David Schroer disclosed he would start becoming Diane before beginning the new job.

"The evidence establishes that the Library was enthusiastic about hiring David Schroer -- until she disclosed her transsexuality," Robinson wrote in his decision. "The Library revoked the offer when it learned that a man named David intended to become, legally, culturally, and physically, a woman named Diane. This was discrimination 'because of . . . sex."'

Advocates called the ruling groundbreaking because a federal judge has now ruled that discriminating against someone for changing genders is sex discrimination under federal law.

"The court got it exactly right, sending a loud and clear message to employers everywhere: if you fire or refused to hire someone for transitioning, you are guilty of sex discrimination and may well find yourself liable," said Sharon McGowan, a lawyer with the American Civil Liberties Union who helped with the case.

The Justice Department is reviewing the judge's ruling, spokesman Charles Miller said.

Schroer said during a lunch with Charlotte Preece, a Library of Congress official, he explained the upcoming medical transition to become a woman. Schroer testified Preece called the next day and said the position would not be a "good fit."

The stuff just writes itself.

As a woman, will he be offended if he is called a pig? A disabled person? Will he be upset is Sandra Berhard decides he will be raped by black men in NYC?

Of course, he would sue for any and all of the above and would probably win.

I've seen worse.

What's with the military and transgenders? I actually know two retired military men - independently - who transitioned.

What the heck. I'm not ready to pronounce "Not guilty!" by any means. But, on the other hand, the B&W photo shown here is of someone born a woman who allegedly remains one. I'll let you red blooded American boys judge who's more attractive.

Just sayin'.

That's definitely a part of it - many transgenders overcompensate in their youth - but it's usually sports or growing a beard or womanizing.

One I talked to about it said it was a defensive overcompensation: knowing the world was against them so what better way to protect yourself than with a tank? (That transgender had been a tank driver and had to retire early because of losing a couple fingers in an accident)

OH GOSH. Like we need that in the military. He probably did it knowing he would win some free courthouse lottery money. I can’t even imagine how disruptive it would have been to put he/she in the field of battle.

It sounds like a desk job, so who cares if he wears a skirt and has been ahem altered? Can we really afford to turn down people who are willing to fight against terrorism?
