TEACHERS should NOT be prosecuted for having sex with pupils over 16, claim union bosses.
The NASUWT says it is UNFAIR to treat teachers who have affairs with students who are over 16 as sex offenders, insisting all they are guilty of is an error of professional judgement.
In 2001 it became illegal for teachers to have any intimate or sexual affair with any pupil in their school under 18.
If found guilty of doing so, the teacher would face instant dismissal, be made to sign the sex offenders register and possibly face jail. But NASUWT general secretary Chris Keates told the Tonight show its wrong to criminalise these teachers.

This is an issue of a person of authority abusing their power and manipulating someone they can control into doing what they want out of fear. Just like why a guard can’t be in a relationship with an inmate, or a psychiatrist can’t date a patient.
Well of course not. They've been working so hard for years now, what with early sex education, gay sex education, gay is ok try it education, to make it the oasis for child predators. All they need is a teaching certificate to be a member of this club.

Change the teacher's contract. At the onset they should say if they will or will not have sex with students, then put the issue in front of the parents for their approval of said contract. Specify damages and termination of the contract is violated. Then we have a valid contract with no lawsuits.
All that Benjamin Spock crap was going on back then among our parents. Everything was cool.

In California there is a prohibition on Communists working as teachers. The Democrats in California are trying to change this decades old law. And the Left wonders why we say the Democrats are PRO Communist.

In response to some ignorant comments on the articles site, I ask, if sexual molestation and exploitation ofgirls is harmful, why isn’t it for boys?
Society is dead wrong that it benefits boys and only those who were never subjected to such molestation and exploitation by older adults would make such a ridiculous claim.
However, perhaps this could usher in an age of return to relatives with large sticks 'meeting' with the teacher to 'discuss' morality.
It worked in the American South of my youth, and I am sure the paradigm is still valid, as would be the deterrent.
The Age of Consent is 16 in the United Kingdom. Personally, I have sympathy with their position. It should not be a criminal offence to have sex with somebody over the age of consent. If it violates their professional standards however, they should be sacked and blacklisted from their profession, as a doctor would be struck off the medical register if he was caught having sex with a patient.....

After a spate of tabloid stories, the govt(some say knee-jerkedly) brought this law in. The loophole of course is that said pupils and teachers can legally meet in a non-school capacity and bed each other, as both are over 16, it is only an offence if the teacher can be proven to have initiated said relationship/intercourse within the context of the school.
Therefore, if they met on the street shopping one Saturday afternoon, they could legally go back to his/her place and have sex. Or meet at a party. Or at the local gym (you get the idea).
But it wouldnt be legal if teacher seduced pupil on a school trip/holiday or at a school function.
I think most people in Britain understand the need to protect pupils from teachers, but also realise that in theory, you can and should be able to have sex with anyone you want once you have passed the age of consent, as long as they also are over 16.
Its a grey area I suppose.

40 years ago I taught in a small community college. I dated a former student of mine, but only after nearly a year later and she was no longer a student in the school. And, by the way, she got an “F”.
OK, then they should instead be shot to death by the father of the violated 16 year old. That would save the government thousands of dollars on a senseless trial and would achieve appropriate justice at the same time.
May be on to something here, I have always felt a very public lynching would be much more effective.

Teachers are in position of authority.
The ability of the teacher to grade and discipline a student with whom s/he has a sexual relationship would be severely compromised. The judgement and integrity of a teacher entering into such a relationship is already questionable, so how could we trust the rest of his judgement system.
Such a teacher should be fired, at the very least.
Here in the States, the age of consent is 18, not 16, so criminal statutes would be in play.
For college professors taking advantage of students 18 and over, firing and blackballing would be appropriate.
I agree, the teacher who nails a 16-18 year old student in his care should be fired and blacklisted from his profession, but in Britain, the age of consent is 16. It is ridiculous to bring criminal charges into the equation for what is a matter of professional misconduct....

Rape is rape, and sex with underage teenagers is ‘unlawful sexual intercourse with a minor’.
Which imo makes more sense, as the latter charge in its definition understands the sex, though illegal, to have been consented. Unless the boy or girl is under 12, the law then deems they are too young/immature before age 12 to have consented (even if they have)
And again, sex with a 16 yr old here is not any sort of offence(except the issue we are discussing) as 16 is the legal age of consent.

October 4, 2008 - SOUTH BEND, Ind.---- A teacher and coach was charged with child seduction after authorities said she made sexual advances toward a 16-year-old girl.
Brooke M. Biggs was formally charged Friday in St. Joseph Superior Court with two counts of felony child seduction following her arrest Thursday. She was released from St. Joseph County Jail on $2,000 cash bond Friday.
Oookayyyy. These people need a crash course on ethics and sexual harassment. The point is not the age of the student. That the students are minors is not the only thing wrong with the picture. Yes, it’s why it carries a jail term, but it is WRONG to have sexual relations with any student. Period. It’s never okay, and should carry some form of punitive charges. IF not jail time, then perhaps loss of contract or loss of certification.
Bottom line, they should be treated as offenders because they are offenders. Mutual consent is not an option in a teacher-student relationship. It doesn’t matter how old the student is.
