Wednesday night McCain could have explained 0bamas promise to sign the Freedom of Choice Act (FOCA). It’s on tape. 0bama promised at a Planned Parenthood convention that the first thing he would do as president is overturn every pro-life law in all 50 states, including the Partial Birth Abortion ban, parental notification and consent. That’s what FOCA would do.

McCain could have closed with explaining that 0bama’s FOCA promise is proof that 0bama’s “common ground on abortion” is just more lies and BS.

0bama and his pathetic looser, Traitor Kmiec would have been hard pressed to spin on that.

As good as McCain did Wednesday night, he missed a tremendous opportunity to prove 0bama’s lies and rabid lust for abortion.

I have heard every commentator on FOCA say that it will overturn all those incremental state and local laws, regulations and restriction which aim to protect women and children from abortion ain any way. That would be parental notification and consent; informed consent; conscientious objector protection for health care providers, individuals or institutions, who refuse to participate in abortions, etc. All overthrown at a stroke.

But how can this be? How cn you overturn state laws in all 50 states without a Constitutional amendment, or --- lacking that --- a new Supreme Court Decision, "Roe vs Wade Stalinique" --- which in effect overrides every state and local jurisdiction?

The Philosopher Kings of the USSC could presume to do it. But how can Congress do it? Woudn't it be unconstitutional?

Can somebody explain how that works?
