THis is why we all hate lawyers. They make everything so damn complicated.
Have you seen any part of the bailout bill? Or any federal statute? Convoluted beyond belief. This lawsuit is proceeding along the timeline of simple civil procedure. Weeks ago i said that nothing would be resolved before election day, and that hasnt changed.

I have been thinking about this entire matter and frankly, it’s hard for me to believe that BHO would have ever entertained thoughts of even running for POTUS much less getting the job if he’s not natural born. How could he have thought that he wouldn’t be questioned?
Yes, yes, of course I know how arrogant he is but this goes WAY beyond that condescension!
I have also wondered if he is not saying anything hoping that our side starts yelling about it, particularly McCain. Then, VOILA, out comes the real BC and McCain looks like a loony.
Maybe I am too much of a conspiracy theorist...

This makes far more sense for Berg. As Berg brought the case the defendant bears the responsibility to prove his/her innocence. It would be of no benefit at this point for Berg to play his hand.
The0bama campaign is doing one of two things.
1.) They are trying to run out the clock and try to gain empathy from the electorate by portraying themselves and being bullied.
2.) They may be trying to get a favorable ruling from the judge that would prevent them form having to potentially disclose what is strongly suspected, 0bama does not meet Constitutional qualifications for POTUS

As Berg brought the case the defendant bears the responsibility to prove his/her innocence.Not true. Berg must state facts in his complaint and/or ammended complaint that show that he can possibly prevail, i. e., that he might be able to show evidence that Obama is not a "natural born citizen." In other words, he must show enough to overcome the Defendants' assertions in their Motion to Dismiss. A bona fide Kenyan birth certificate would be Berg's trump card - if the court does not dismiss on the ground of Berg's lack of standing.
There is no such thing as "innocence" in a civil case.

... also because showing "the world" a Kenyan BC would give the media and others time and opportunity to "prove" it was not real.If Berg has in his possession contemporaneous affidavits of eyewitnesses to the birth and a what I referred to as a copy of a bona fide birth certificate, properly signed and sealed by a government official (which he is believed to have, according to other sources), there no way for the MSM and/or the Obama camp to "prove" that it is a fake.

Yes you would think we would have the legal right know everything about the candidates running for President and for the most part both parties were pretty good about it.
We have never had such a Sphinx as Obama, the Democrap party has many long serving senior members that you would think in a rational world would have gotten the nomination.
But look at what happened none of the senior Dempcrap leaders got any traction with the party rank * file the two leading contenders had the least experience. One who soaked up executive experience through matrimony (or osmosis!) and another who has zero, none & and it argubaly maybe not a citizen! The democrap voter thought this was OK ! HUH !

Good question.
My theory is the judge is sitting on this hoping barry looses in nov in which case the case is moot and it doesn’t matter how he rules. If Barry wins and the judge finds in favor of Berg and its upheld on appeal and a judge tells barry he wasn’t qualified barry can ignore the court and remain president as long as congress isn’t willing to impeach over it.
I sure hope something happens soon.

The judge may be holding off on his decison so that it won’t influence the election. Once the election is past, an order to produce the BC would have two months to wend its way through the legal system, arriving finally at the SCOTUS. Once there, any final decision would come from the Supremes, thus insulating Surrick (sp?) from it.
