Marriage Referendum Leads 52% to 43% Among Likely California Voters

A new poll of California voters shows Proposition 8, a proposed constitutional amendment that would reserve marriage for opposite-sex couples, has a 9 percentage point lead among likely voters, 52% to 43%. The poll was conducted for the Knights of Columbus by the Marist College Institute of Public Opinion between September 28 and October 5, 2008.

The survey shows that Proposition 8 has majority support among men (53%), women (51%), whites (51%), Latinos (57%), those who are married (59%) and those age 45 and older (59%). Those opposed include likely voters under age 45 (54% opposed) and those who are not married (54% opposed).

The poll also shows that Proposition 8 leads in every region of California except the Bay Area, where 58% are opposed.

52% of likely California voters believe the state Supreme Court was wrong to have overturned the 2000 referendum in which voters approved reserving marriage for opposite-sex couples, and 72% believe the decision should be left to the voters.

Poll respondents were presented with several arguments and asked whether each one would make them more or less likely to vote for Proposition 8. A majority (58%) were more likely to favor Proposition 8 when reminded that if it passes, same-sex couples will still be able to form civil unions in California. More than half of those describing themselves as opponents of Proposition 8 said they were more likely to shift from opposing to favoring the referendum because of this argument. Approximately one third of those voting “no” on 8 – and a significant number of undecided voters – would be more likely to vote yes if the proposition’s failure could compromise the tax status of religious schools or if children in public schools would be taught that marriage was a relationship “between any two adults.”

Nearly half (49%) of likely voters believe that same-sex marriage should not be law if legalizing it would place clergy at risk for lawsuits or threatens the tax-exempt status of religious institutions. And 79% of all likely voters believe that if Proposition 8 fails, clergy should not be required to perform same-sex marriages if it violates their religious convictions.

The margin will be MUCH bigger on Election Day. The polls ALWAYS understate the depth of support for traditional marriage.

That was for a state law that the CA SC said was unconstitutional. This is a vote to amend the CA Constitution which a court cannot ignore.

They voted on a “law”, which the California Supreme Court overturned as unconsitutional.

This is a constitutional amendment, which the California Supreme Court cannot overturn as unconstitutional, because it will be part of the California State Constitution.

This shouldn't even be this close.... unbelievable. When Prop 8 was being discussed, it was said that a majority (though slight) were in favor of same-sex marriages. Thanks to everyone who donated in order to get the message out.

I saw a commercial in favor of same sex marriage and it was presented as more of a basic right thing. The actors spoke about "what else 'they' would want to take away from Californians." Ridiculous--especially in California.

If people truly understood that the family unit, consisting of a man, a woman, and any children, is the basis of society, it would be about 80% for... or even just considered a non-issue.

I consider there are about 15% of the population (in CA) that seeks to destroy our society as we know it.

Too bad the McCain campaign couldn’t/wouldn’t point out that the likely impact of an Obama win would be that he would be in a position to name justices to the SC who would overturn such an amendment, once it’s challenged in federal court.

Who knows, maybe people who will vote for the amendment will put two and two together.

We voted to create a statute outlawing same-sex marriage. The California Supreme Court ruled the statute was trumped by the state constitution. This is a constitutional amendment.

Its not really close. When you consider the NO side has deep pockets, has the backing of the state Democratic Party and every leftist interest group and the Attorney General wrote the ballot language to help ensure its defeat, that Prop. 8 is ahead at all in liberal California is a true miracle!

Yes the NO side has all that power, but it cannot overcome the overwhelming rejection of gay marriage among minorities who usually vote liberal on nearly all other issues. Prop 8 will win because minority dems will vote for it in droves.

No, 50% + 1 is enough to make it a constitutional amendment. A constitutional amendment, however, is much more difficult to get on the ballot (more signatures required).

We’ve seen a lot of YES on 8 ads on TV here in L.A. (meaning we do NOT want to recognize gay marriage). And there are some NO on 8 ads as well.

Here in my leftist bastion in the San Fernado Valley the NO signs far, far outnumber the YES signs, as you would expect. Often they are accompanied by Obama signs — again no surprise.

But oddly, some NO signs stand alone — no presidential sign at the same residence at all. Hmmmmmm What’s that all about?

In my one mile radius alone many of us know each other due to a neighborhood watch group. At least 90% of residents have been libs, for many decades. Knowing what I know, I can say with certainty that the Obama and/or NO on 8 people are either bleeding heart libs, or gay, or both.

I think I should move to the Central Valley!

Hubby just arrested a middle-aged woman here in San Diego County for having a bunch of stolen Yes on 8 signs in her truck. He was just going to warn her, until she barked, “What are you going to do, arrest me?!”

The NO side has far less money. Something like $20 million less, perhaps more. Obsession with Obama is probably sucking Hollywood funding away from NO on Prop 8.

Obama, Biden, Feinstein, Arnold don't really want to put their necks out for the gays. Sure DiFi and Arnold are officially against 8 but where are they in advertising?

Considering it was Harvey Milk's murder that *made* DiFi's political career, you'd think she'd be more visible in the NO campaign.

The recent Survey USA poll has the Prop 8 ahead 48-45 but within the margin of error.

Logically, one would think all those people voting Yes on Prop 8 would also vote for McCain-Palin, but I’ve learned not to apply logic to anything that happens in California.

I was born in California and lived over half my life here, and I still can’t figure the place out.

(I live in Glendale now, I’ve lived in Hawaii for a big chunk of my life, too, was there when I signed on to FR back in 2000.)

I think the rational voters know all this - you can often tell you're on the right side by the nature of your opponents. (Doesn't/shouldn't everyone know that Obama is endorsed by Hamas?) It's painfully obvious to most people why Brown rewrote the title of the proposition.

I have friends who work at UC Berkeley - they used to be pro-gay but after all the daily bombardments by gays, they have changed their minds. Volunteered it.

Heard that the “Yes on 8” folks are warning people to bring in their signs at night in northern California because there is a concerted effort to steel them every night.

A lot of the people I've talked to at work are confused about the language. They think a "yes" vote is for gay marriage. Hopefully they'll get it together by election day.

Anyway, it's going to win.

The Yes on 8 Campaign has been well done, and Newsom’s “whether you like or not” and the field trip were golden opportunities.

Isn’t there one of these initiatives on the ballot in Colorado? If so, McCain should use that there.
