The US Supreme Court is being asked to help the nation avoid a contitutional crisis by halting Tuesday's election until Democratic presidential nominee Barack Obama documents his eligibility to run for the top office in the nation.

There was a demonstration supporting Philip Berg and his case in front of the SCOTUS Building in DC on Thursday, Oct. 30, 2008.

Technically speaking, I wonder if the eligibility question can only be brought up when the electors vote, since technically speaking we aren’t voting for Obama or McCain on tuesday, only their electors.

Good point, in that, none of us vote directly for the president, just for electors. And it could be that, if the Supreme Court chose to get involved, it would be based on who the electors vote for, not who all of us ordinary citizens vote for.

Not so fast. He's still a US Senator, and I'll bet dollars to donuts there's a clause in the Constitution about that too.

Even if there isn't, and he's allowed to continue serving in the Senate, this thing will dog him until his dying day. No way will Americans sit still for him casting votes upon their future after everything comes out on him.

How do we not have the standing?

That statement alone is a constitutional crisis.

I’m not a constitutional expert by any stretch, but I distinctly recall the words “by the people, for the people”, which means government works for US, the voters.

I have a job interview Monday.

I’ll stammer a lot(I usually do in a job interview)offer no documentation of my identity or work history and just tell them I’ll bring change.

If they don’t hire me, I’ll sue!

Hmmmmm I know this is foolishly simple, but there would be no need for even considering a delay if Obama would just present it. Problem solved.....crisis avoided. Could the SCOTUS demand he produce it?

It seems they should surely anticipate the ensuing chaos that would follow the election of an ineligible person and make it easier on themselves as well as the country by taking care of it now.

The more publicity the issue of Obama's eligibility status and citizenship status get, the more people in the electorate will be educated about it, and, hopefully, the more people will say NO to Obama when they vote. Not a bad strategy by Berg, IMHO.

I believe that FOX News covered the demonstration today.

This whole thing makes no sense to me. You can’t get a passport without presenting a birth cerificate...I would think the requirements for the presidency would be just as important. And it’s so easy to do. THIS MAKES NO SENSE.

How do we not have the standing?

If I were the judge, I would rule that Berg has standing. But then again, the judge who ruled on it was appointed by Clinton and has his own agenda. There was a case earlier in the year brought by a citizen in NH (questioning McCain's constitutional eligibility) and it was dismissed on the same ground - lack of standing. That earlier case was a bad precedent for this one.

The courts have already ruled that Berg doesn’t ahve standing, but there is a move underway to bring some candidates for the Electoral College to belisted as plaintiffs. Being a listed cnadidate for Elector mightgive one standing. (Hey, it’s worth a try, right?)
