Two of the plaintiffs in court cases against Sen. Barack Obama, the president-elect, are working to move their cases forward before his presidential inauguration.
Philip J. Berg, the attorney who filed suit against Mr. Obama challenging him to produce his original birth certificate to prove he meets the constitutional requirements to serve as U.S. president. Mr. Berg filed a Writ of Certiorari in the U.S. Supreme Court late in October, in an effort to force Mr. Obama to produce the document.
Accordingly, the U.S. Supreme Court has said that Mr. Obama, the DNC and all co-defendants are to respond to the writ, on or before Dec. 1.
The judge in Mr. Berg's original case ruled that Mr. Berg does not have standing to enforce the constitutional requirements on a presidential candidate. Mr. Berg appealed the ruling to the Supreme Court.
"I look forward to receiving defendant Obama's response to the writ and am hopeful the U. S. Supreme Court will review Berg v. Obama. I believe Mr. Obama is not a constitutionally-qualified natural-born citizen and is ineligible to assume the office of President of the United States."
Mr. Obama put an electronic photo of a birth certification on his "Fight the Smears" Web site, a document that his critics have found unconvincing. The raised seal and authoritative signature needed to validate the document cannot be seen on the scan. The Obama campaign was unwilling to release the

Everytime I bring this up, I keep being told that Hawaii confirmed he was born in Hawaii. But I can’t really find anything except that they confirmed they HAVE his birth certificate and can’t release it.
So does anyone know the scoop and truth on this?
Well, he did, though there are some who say it is a forgery.
As an aside, the SCOTUS rules have a period where you can respond to a Write request. There’s no real order requiring Obama to produce anything.
Berg is the same guy that sued GWB pursuant to RICO essentially claiming that our govt was behind 9/11.
Berg has a tendency to stretch the truth.
I, for one, find the birth certificate claim to be utterly without merit and a waste of time. I don’t think it has been anywhere near proven to be a forgery. At best, and that is stretching it a lot, there are competing experts who make it all a draw. However, it IS his time to waste so *shrug*

Is there a list of all related action? I thought there were additional states and/or county election officials who were served on this very issue.

At the Supreme Court website, search for Dockets ...search Obama...I don’t know EXACTLY what Application Denied by Souter means...don’t know WHICH application...but where does it say that the Supremes asked the DNC to respond?

What would the ramifications be if he was somehow (miraculously) declared inelligble before January?

This could EASILY be resolved if Obama would request that Hawaii release the COLB. He has thusfar refused to do so. That is curious and worthy of at least cursory pursuit.

He has not shown any birth certificate much less a fake “certificate of live birth”. I had to show a birth certificate for my son to play little league for gosh sakes...isn’t the Presidency a little more important then a 11 year old playing short-stop?
What is the big deal ... if he was legally born here show the certificate... yet he obfuscates for some reason.
It is a big deal if he is not qualified to hold the office under the constitution he is going to swear to uphold!
Hawaii confirmed they had the BC and had locked it up. The fact they have it seems to me to prove he was born there. Why would Hawaii have a BC from Kenya?

There are three cases. The third is a retired NJ attorney who has his case at SCOTUS and is getting the run around from the clerk at SCOTUS. The NJ attorney’s name is Leo Donofrio.
The NJ attorney and Berg know the law - you do not file cases with SCOTUS unless you are licensed to practice ta SCOTUS and have a pretty good idea what you are doing.
The question is does O have to provide anything.

I have always suspected that he was born here but that there is something on the original BC that he wants very much to hide.
Why would Hawaii have his birth certificate if he wasn’t born there?
All a foreign person has to do is show up at a hospital with a baby and ask for a certificate of birth, but it's not a valid U.S. citizen document. All it says is that the baby was born. In most cases, it's lists where the baby was born - like, you know, Kenya for example.
Having his Kenyan grandmother and sister saying they witnessed his birth in Kenya makes the whole issue suspicious. He just needs to release his records.

Maybe his mother wanted his birth registered in HI. If I had a child overseas, I’d want an American birth record or registration. In fact, I may be required to have one.
Just because HI has a birth record (and the word “record” was the one used by the DHHS rep in HI), it doesn’t mean that record originated in HI. In fact, no one from the HI administration has divulged the origin of O’s birth cert.

You know I would think you’re right but Mark Levin made a comment at the close of his show that it no longer matters where he was born as he was elected. That blew me away as Mark in a Constitutional attorney but he was rather flippant about it. Are we that screwed already?

President Biden would be my guess....not great but likely a natural born American.
Between maybe 1% of black Americans who supported Obama and our National Guard? If it comes to President-elect Obama not being qualified to verify he is constitutionally qualified to take office, the American public who supported him will be VERY UPSET that he lied and tried to take power AGAINST our Constitution. I do not believe they would riot!

The Electors can elect anyone they want. I suspect Biden would become President. The Vice Presidency would remain vacant, to be filled under the provisions of the 25th Amendment. Or, the Electors could elect someone else Vice President, perhaps Hillary.
I was driving into work today, listening to Quinn & Rose talk about this and the thought occurred to me that it’s essentially too late to do anything about questioning his birth certificate. Now that Pres-elect Hussein has the office, he pretty much has at his disposal the ability to conjure up a completely valid looking COLB by fiat.
I mean, if you saw his birth certificate displayed as evidence it in court (if you could envision him actually answering a summons), wouldn’t you have serious doubt as to its authenticity? It could have all the perfectly proper seals and stamps and watermarks, and it’s entirely possible the document was generated from thin air by a Executive Branch department created solely to make a birth certificate.

He hasn't been sworn in yet. The delegates haven't given him their votes yet, either. Actually, he's still considered a candidate.
I've not seen anything that says an Hawaiin official said he was born in Hawaii. Do you have at least one instance you can cite? Thanks.
There may be only a 5% chance that there is something to this. However, this great nation now has a terminal disease. Even a 5% chance of a cure is something to bring me hope.
The Obama camp just wants to see just how gullible some people could be. They put out misinformation to see who bites. I agree, Obama should release the birth certificate, but I have more of a chance of finding two million dollars in unmarked bills in my pantry.

No direct quote from the official, just the Honolulu stating “State officials say there’s no doubt Barack Obama was born in Hawai’i.”
BUT, the article also says the official states “Health Department Director Dr. Chiyome Fukino said today she and the registrar of vital statistics, Alvin Onaka, have personally verified that the health department holds Obama’s original birth certificate.”
So where is the direct quote and who are the “state officials”.
Sounds like SLOPPY REPORTING to me.
