Obama's Justice Department:Filling in the Blanks

The transition to a new administration is underway and people are naturally curious about what to expect at the Department of Justice. Asked to check into this, I called on friends inside and outside the Justice Department, on the Hill, and in think tanks. No one seems to have a very clear or full picture yet, although there are some hints in specific areas which I’ll deal with below.

Watch for the judiciary to be granted the powers of law-making on the bench, based on any criteria, written or unwritten “law”, foreign or domestic, that suits their fancy.

Granted by whom? They already do it if they’re so inclined and stop only when a higher court intervenes.

True. They do. But at least it is not law. My opinion is that Obama will give them the LEGAL POWER to legislate from the bench. Let us not forget he is a Marxist and will work to give government all power over the individual.

He sure as heck better not fire “all” the AG’s...that would be “political”...we need to keep an eye on that.

All Presidential appointees - including the 93 United States Attorneys - tender their resignations after each Presidential election. The new [or re-elected] President can choose which to accept. Appointments at DOJ have absolutely nothing to do with the actions of Judges. While government lawyers may decide how to litigate cases, the judges' actions are not based upon appointments at DOJ.
