Verdict reached in Muslim charity’s second trial (convicted on all of the 108 charges)

Jurors have reached a verdict in the second trial of a Muslim charity accused of helping to finance terrorism in the nation's largest such case since the Sept. 11 attacks.

The verdict was to be announced Monday afternoon, on the eighth day of deliberations in the retrial of the Holy Land Foundation for Relief and Development. It was once the nation's largest Muslim charity.

Holy Land is accused of giving more than $12 million to support the Palestinian militant group Hamas, which the U.S. designated as a terrorist organization in 1995.

Jurors were to read a long list of verdicts on more than 100 charges against Holy Land and five of its former leaders.

One of the sons of one of the convicts is named Jihad Elaydi. Yea, no fanatics in that bunch. Riiight. The son is not a kid either, but more than old enough to shave, although it appears he doesn't.

Zolfa Elaydi (center) is comforted by her son, Jihad Elaydi, as she and her daughter, Fidaa Elaydi, weep outside the Earl Cabell Federal Building on Monday in reaction to the guilty verdicts in the Holy Land Foundation terrorism financing case.

Islamic charity's assets frozen

By Laurie Cohen, Stephen Franklin and Robert Manor | (Chicago) Tribune staff reporters
December 5, 2001

Excerpt:

In a major expansion of the financial war against terrorism, the Bush administration on Tuesday froze the assets of one of the nation's largest Islamic charities, alleging it serves as a front for the militant Palestinian group Hamas.

The freeze order affects the Holy Land Foundation for Relief and Development, which is headquartered in Richardson, Texas, and has an office in southwest suburban Bridgeview.

The president also blocked assets of two financial services companies based in the West Bank that have long been accused of supplying funds to Hamas.

White House officials took the step--the first since Sept. 11 to choke off funds to a terrorist group other than Osama bin Laden's Al Qaeda network--after a pair of suicide bombings in Israel last weekend. Hamas claimed responsibility for the attacks, which killed 25 people.

"The message is this: Those who do business with terror will do no business with the United States--or anywhere else the United States can reach," Bush said in announcing the freeze at a Rose Garden news conference.

Chicago’s Hamas Youth
By Joe Kaufman

FrontPageMagazine.com | Thursday, August 21, 2008

Excerpt:

During the 1990s, the Hamas infrastructure within the United States was complete.

It consisted of a propagation outlet, the Islamic Association for Palestine (IAP); a financing wing, the Holy Land Foundation for Relief and Development (HLF); a command center, the United Association for Studies and Research (UASR); and a defense mechanism, the Council on American-Islamic Relations (CAIR).

Today, only the latter exists, along with a remnant of the IAP, the Mosque Foundation. Both have a presence in the Chicago area, where group and mosque are working hard to indoctrinate young Muslims into radical Islam.

In 1981, two Muslim Brotherhood entities, which later would be widely regarded as being aligned with the terrorist Hamas, were established within the Chicago area of Illinois.

One, the IAP, was created as a collaboratory effort between future Hamas leader Mousa Abu Marzook and future Palestinian Islamic Jihad leader Sami Al-Arian.

Soon after the onset of the violent Palestinian Intifada against Israel, which began in 1987 and which gave birth to Hamas, the IAP became a publishing house for the Hamas charter and Hamas terror training videos.

*snip*

One of the coarse individuals the Tribune discusses in its piece is Jamal Said, the imam of MF.

Said, named a co-conspirator in the 2007 federal Hamas financing trial, is pictured shoulder to shoulder with the keynote speaker of MYLS’ Spring 2008 symposium, U.S. Congressman Keith Ellison.

Said also spoke at the event, as well as MF’s Associate Director (and former IAP board member) Kifah Mustapha and MF’s President Sahloul Mohammed.

MYLS’ Summer 2008 symposium featured as speakers teacher and board member of the Zaytuna Institute, Zaid Shakir, and Chicago Sun-Times reporter Rummana Hussain. As well, CAIR-Chicago Executive Director and CAIR’s National Strategic Communications Director, Ahmed Rehab, spoke.

Rehab, who likes to pawn himself off as a “moderate Muslim” by wearing trendy clothes and flamboyant glasses – he even posed half-nude for photos on his personal website – donned a keffiyeh for the kids. Keffiyes, made popular during the Intifada, are head coverings or scarves which are commonly worn as symbols of Palestinian violence.

###

According to terrorism expert, Steven Emerson, the defendants, “Shukri Abu-Baker, Ghassan Elashi, Mohamed El-Mezain, Mufid Abdulqader and Abdelrahman Odeh, could face up to 20 years in prison for their convictions on conspiracy counts, including conspiring to provide material support to terrorists.

The verdicts, read Monday afternoon, ended a two-year saga in what is considered the largest terror financing case since the 9/11 attacks.”

All five defendants are “Palestinians” and/or American citizens as well.

Elyashi was born in Gaza; Abu-Baker moved to the “Palestinian territories” as a child; both Abdhulqader and Odeh were born in the West Bank; El-Mezain was born in Gaza. One wonders why five Palestinians chose to set up shop in Dallas, Texas?

Has Holy Land Foundation monies been going to widows and orphans?

Well, maybe–but I would suggest, mainly to those whose sons and daughters have blown Israelis (as well as themselves) up.

Maybe The Holy Land Foundation paid for the kidnapping of Gilad Shalit who still remains in captivity or for the murder of countless Israel civilians; maybe their monies paid for the Qasam rockets that Hamas has rained down upon civilians in Sderot and Ashkelon. Maybe it paid for most of the weapons shipped to Hamas by boat and by underground tunnel.

And certain Jewish sects as well. And other groups...Amish for example. Kind of a natural "badge" when you think about it.

Somehow, I can’t generate any sympathy for the wife of a Jihadist.

I may have been mistaken in ID's Jihad as the son of one of the convicts, but I too have problems with a mother who would name her son "Holy War", or allow him to be so named. One wonders what his baby nickname was?

I shudder to think of a nickname for a kid named “Jihad.”
Perhaps it’s the culture I live in, but there is no way that I would sacrifice one of my children for the “religion of peace” which is neither.

Both of my children served their country; one in the army and one in the navy. All of us would give our lives for this country. But I would NEVER martyr either of them (or my grandsons who are now serving) for a lost cause.

FEDERAL JURY IN DALLAS CONVICTS HOLY LAND FOUNDATION AND ITS LEADERS
FOR PROVIDING MATERIAL SUPPORT TO HAMAS TERRORIST ORGANIZATION

DALLAS — Following approximately six weeks of testimony and seven days of deliberation, a federal jury in Dallas returned guilty verdicts this afternoon convicting the Holy Land Foundation of Relief and Development (HLF) and five of its leaders on charges of providing material support to Hamas, a designated foreign terrorist organization, announced U.S. Attorney Richard B. Roper of the Northern District of Texas, and Patrick Rowan, Assistant Attorney General for National Security.

“Money is the lifeblood of terrorism. The jury’s decision demonstrates that U.S. citizens will not tolerate those who provide financial support to terrorist organizations,” said U.S. Attorney Roper.

“Today’s verdicts are important milestones in America’s efforts against financiers of terrorism. For many years, the Holy Land Foundation used the guise of charity to raise and funnel millions of dollars to the infrastructure of the Hamas terror organization. This prosecution demonstrates our resolve to ensure that humanitarian relief efforts are not used as a mechanism to disguise and enable support for terrorist groups,” said Patrick Rowan, Assistant Attorney General for National Security.

HLF was incorporated by Shukri Abu Baker, Mohammad El-Mezain, and Ghassan Elashi. Mufid Abdulqader and Abdulrahman Odeh worked as fund raisers. Together, with others, they provided material support to the Hamas movement. From its inception, HLF was linked to radical groups promoting jihad. Before it was designed as a Specially Designated Terrorist by the Treasury Department and shut down in December 2001, it was the largest U.S. Muslim charity. It was based in Richardson, Texas, a Dallas suburb. The “material support statute,” as it is commonly referred to, was enacted in 1996 as part of the Antiterrorism and Effective Death Penalty Act. That statute recognizes that money is fungible, and that money in the hands of a terrorist organization — even if for so called charitable purposes — supports that organization’s overall terrorist objectives.

The jury convicted all defendants on the conspiracy charges — conspiracy to provide material support and resources to a foreign terrorist organization; conspiracy to provide funds, goods and services to a specially designated terrorist; and conspiracy to commit money laundering. In addition, Abu Baker and Elashi were convicted of conspiring to impede and impair the IRS.

HLF, Abu Baker and Elashi were also convicted on all of the substantive charges of providing material support and resources to a foreign terrorist organization, providing funds, goods and services to a specially designated terrorist and money laundering. Abu Baker was convicted on one count of filing a false tax return and Elashi was convicted on two counts of filing a false tax return.

The government presented evidence at trial that, as the U.S. began to scrutinize individuals and entities in the U.S. who were raising funds for terrorist groups in the mid-1990s, the HLF intentionally hid its financial support for Hamas behind the guise of charitable donations. HLF and these five defendants provided approximately $12.4 million in support to Hamas and its goal of creating an Islamic Palestinian state by eliminating the State of Israel through violent jihad.

The government’s case included testimony that in the early 1990’s, Hamas’ parent organization, the Muslim Brotherhood, planned to establish a network of organizations in the U.S. to spread a militant Islamist message and raise money for Hamas. The government’s case also included testimony about Hamas material found in zakat committees. The defendants sent HLF-raised funds to Hamas- controlled zakat committees and charitable societies in the West Bank and Gaza. Zakat is an Arabic word meaning the religious obligation to give alms.

HLF became the chief fundraising arm for the Palestine Committee in the U.S. created by the Muslim Brotherhood to support Hamas. According to a wiretap of a 1993 Palestine Committee meeting in Philadelphia, former HLF President and CEO Shukri Abu Baker, spoke about playing down Hamas ties in order to keep raising money in the U.S. Another wiretapped phone call included Abdulrahman Odeh, HLF’s New Jersey representative, referring to a suicide bombing as “a beautiful operation.”

The government also presented evidence that several HLF defendants have family members who are Hamas leaders, including Hamas’s political chief, Mousa Abu Marzook, who is married to a cousin of Ghassan Elashi, HLF’s former Chairman of the Board. Ghassan Elashi, who also served as the vice-president of marketing for Infocom Corporation, is currently serving an 80-month sentence following his conviction on several charges related to export violations. Mohammed El-Mezain was HLF’s Director of Endowments and Mufid Abdulqater was HLF’s projects and grants director. Two named defendants, Akram Mishal and Haitham Maghawri are fugitives.

The defendants provided financial support to the families of Hamas martyrs, detainees, and activists knowing and intending that such assistance would support the Hamas terrorist organization. Since 1995, when it first became illegal to provide financial support to Hamas, HLF provided approximately $12.4 million in funding to Hamas through various Hamas-affiliated committees and organizations located in Palestinian-controlled areas and elsewhere.

During trial, the government also presented evidence that HLF was so concerned about investigators uncovering the group’s intentions that they kept a manual entitled “The Foundations Policies and Procedures.” HLF followed various security procedures outlined in the manual to include, hiring a security company to search the HLF for listening devices, ordering defendant Haitham Maghawri, (a fugitive) to take training on advanced methods in detecting wiretaps, shredding documents after board meetings, and maintaining incriminating documents in off-site locations.

All defendants were detained pending sentencing; a sentencing date is forthcoming. All defendants face substantial prison sentences.

Robert E. Casey, Jr., Special Agent in Charge, Dallas FBI, expressed appreciation for the U.S. Department of Justice, the U.S. Attorney’s Office for the Northern District of Texas, the team of FBI Agents and staff, along with the Agents and staff of the Internal Revenue Service, Army Criminal Investigations Division, Dallas Police Department and Richardson Police Department for their efforts in this investigation.

Mr. Casey said, “These men and women followed the evidence in this case even as it led them across the globe. Their personal sacrifices and dedication to preserve the security of the U.S. and ensure justice should be admired by citizens everywhere. The FBI will continue to keep the country safe by actively investigating all forms of terrorist threats, whether that threat manifests itself in the planning or execution of a violent terrorist act or other crimes that provide support to terrorist organizations.”

“Terrorist networks need money to be effective,” said Special Agent in Charge, Michael P. Lahey, Dallas Field Office. “IRS Criminal Investigation will not allow exempt organizations to be misused for raising money that is ultimately used for terrorism financing.”

The case was investigated by the Joint Terrorism Task Force, involving agents from federal, state, and local agencies including: FBI, Internal Revenue Service, U.S. Immigration and Customs Enforcement (ICE), Department of State, U.S. Secret Service, U.S. Army Criminal Investigation Division, the Texas Department of Public Safety, and the Dallas, Plano, Garland and Richardson, Texas, Police Departments.

The case was prosecuted by First Assistant U.S. Attorney James T. Jacks of the Northern District of Texas; Barry Jonas, Trial Attorney for the Department of Justice Counter-terrorism Section; and Elizabeth J. Shapiro, Deputy Director, Federal Programs Branch, Department of Justice, serving as a Special Assistant U.S. Attorney.

President Bush will never pardon any terrorist. It is President Bush who has caused incredible damage to the terrorists world wide.

Well, at least he put us into the longest war we've ever been in...George pardons a terrorist every time he lets one walk across the southern border...

The nature of the war on terror is long and hard. We are not fighting a standing army and there is no government to surrender to us. We have to go the Middle East bring out the terrorists and kill them. We have killed and captured tens of thousands of them so far. We have crushed them in Iraq. We have achieved VICTORY in Iraq. We have killed most of Al Qaeda leadership. We have no been attacked in the US since 9/11 2001. For me, those are great achievements.

Illegal aliens have been crossing the boarders for generations.

Muslims are a fifth of the world's population. How long should it take?

Perhaps you may have heard the rumor that Osama declared war on the USA in the 90’s....but then, I too have this mental image of the nation’s public school system with a “Mission Accomplished!” banner flying overhead...

Hey, haven't you heard? “Jihad” refers to a spiritual struggle the devout Muslim goes through. It's entirely peaceful, and involves much prayer and fasting.
In a very tiny number of cases, the young Muslim jihadist gets involved in planning mass murder and mayhem, and these cases almost always involve manipulation by evil FBI agents and informants who set him up.

This is a “Religion of Peace”, don't you know? These people love the United States of America, and are deeply saddened when one of their misguided young men blows himself up along with lots of other people.
