Teen shoots burglar
Star Beacon ^ | 24 November, 2008 | SHELLEY TERRY

Posted on 11/27/2008 7:53:58 AM PST by marktwain

ASHTABULA — A 15-year-old shot a burglar late Friday night after the burglar and two cohorts broke into the teen’s West Side home, police said Monday.

The teenager and his 14-year-old brother were home alone when three men came to the house, police said. The teens recognized two out three of the men, according to their mother, who spoke with the Star Beacon Monday.

The identities of the teens is not being disclosed because they are juveniles. The identity of their mother is not being disclosed to protect the teens.

When the boys refused to let the men in the house, one of the men took the butt of a shotgun and smashed the window out of the front door, police said.

That’s when the older boy ran upstairs to retrieve his father’s handgun, his mother said.

In the meantime, the intruders told the younger teen they would kill both of them if he didn’t open the door, the mother said.

“They held a gun to his head,” she said.

Sgt. John Koski said the 15-year-old came down the stairs and shot one of the intruders in the leg. The men then took off.

“The bullet went in the leg and out through his buttocks,” the mother said.

The teens’ parents soon returned home from the store and a relative’s house, and police were called to the scene, the mother said.

In the meantime, police received a call from Ashtabula County Medical Center that a 21-year-old city man showed up with a gunshot wound to the leg, Koski said.

“He said a kid accidentally shot him,” he said. “The wound was in the exact place the 15-year-old said he shot the intruder.”

Police arrested and charged the 21-year-old man with aggravated burglary, a first-degree felony; attempted felonious assault and having a weapon under disability, Koski said, noting the suspect is a known felon.

The suspect’s name is being withheld until his arraignment.

As of Monday afternoon, police were securing warrants for the other two suspects, Koski said.

No charges will be brought against the teen, police said.

The mother said the men told the boys they wanted money.

I am told that this would have been illegal in California. The homeowner could have been sent to jail there for three years for illegal storage of a weapon.

I am told that this would have been illegal in California.

And in MA, NYC, DC, Chicago, Philly, etc. The state views self defense as a much more serious crime than burgulary or assault, because if you have the will and the means to defend yourself from unorganized thieves, then

  1. you might begin to think that the state's jackbooted legions are unnecessary
  2. you might consider that you could defend yourself from the biggest criminal organization of all, and
  3. you might question the self appointed authority know as the government
all of these much more threatening to the government than the robbery or murder of a serf

This story sounds effed up.
How did they get a gun to the kids head if they were locked outside?

police received a call from Ashtabula County Medical Center

This happened about 20 miles from me. Ashtabula is one of the poorest counties in Ohio.

The Star Beacon is a small county paper typically runs about 1 to 15 pages daily most of which are sports and classifieds

I am surprised that some one in Arizona is looking up Ashtabula news on the internet. Are you from the area?

Kudoes to the kid, but he needs time at the range. His aim's just a hair too low.

you can't blame the kid for not aiming at the center of mass as you or I would have done. But I forsee the criminals coming back for a bit of revenge. When they're dead, the only thing that happens is that you see their mommas telling everyone on the news that their wonderful chillun didn't deserve to die, and that the homeowner overreacted, etc. But the fact remains, the recidivism rate among dead robbers is very low.

I guess you’re talking about a minor possessing a handgun. Actually, it looks like he could do so legally, if he has written permission from a parent or guardian.

No, I got the story from Keep and Bear Arms.

http://www.keepandbeararms.com/

This is exactly the type of story that is regularly spiked by the MSM. That makes it all the more important to get the word out.

Who knows how many stories like this occur in the urban centers, and are routinely spiked by the MSM?

It sounds as if they got into bad company, at school or visiting the neighboring city. And that company must have figured they were worth robbing.

I'd also be a little worried about these perps or their friends coming back to take it out on this family. I hope they'll be careful.

No. I am told there is a specific California law that makes it illegal for a gun owner to leave it in a house where a person in the household under the age of 18 can access it.

A few years ago, a family had stored their guns this way, and the adults were gone when a crazy with a pitchfork broke in. The 14 year old girl who had been taught how to use the guns was able to escape with one of her siblings. By the time the police got there and shot the madman, her other two siblings had been killed. To this day, the grandmother believes that the California law caused the death of her grandchildren.

Yesterday I went to pick up an application for a CWP. This is a very conservative county in Michigan. I had to stand in line. There was a female lawyer behind me getting one too. I told the lady behind the bullet proof glass; “I thought everyone in this county ALREADY HAD ONE.” She laughed and said they have been busier than heck with permits to purchase and CWPs.

One question - isn't there an issue with a 15 year old having access to a load weapon?

I hope my son is a better shot when he's 15 but he won't have access to the gun safe.

I don't think so. You can't transfer a weapon to a minor on a 4473, but otherwise I believe it's fine...if parents approve.

IOW, parents that own (possess) a gun must anticipate that a threatening situation such as this might require their children to take defensive action, and place on file a written permission for their children to “borrow” their father’s gun to defend themselves, in the unlikely but possible event that such becomes necessary.
Would the boy’s emergency “borrowing” of his father’s gun, to defend himself and his brother, constitute illegal “possession” of a firearm?

I don’t know the answer to that. I don’t like the law, but just looked it up to see what the law is. It sounds to me like the parent or guardian has to write a permission slip of some kind...probably best to have it notarized.

I imagine the idea is to go after gangsta types who are unlikely to have said parental permission.

I think it depends on the kid.

I’ve got at least one daughter who I would have happily trusted with access to a firearm at that age because she was mature and sensible enough to handle that type of responsibility.

But I wouldn’t trust my youngest son in the same way. He’s a good boy for the most part, but at 15, he is still a child in the way he acts and the way he thinks. I’m fairly confident he wouldn’t misuse a firearm, but not quite confident enough that I’d want him to have access to one if I wasn’t around.

Now I live in Australia, so the law doesn’t give me any choice on this anyway - I can’t allow a minor to access one of my firearms unless I’m present and I have to keep the weapons secured. He does have a junior firearms licence (which allows him to use a gun in my presence or that of another licenced adult actively supervising him) and I have taught him how to handle a firearm carefully and safely and to use it appropriately, but at his age and level of maturity I regard those skills as backup tome actively supervising him - I intend to prevent him acting unsafely but if I, for some reason, am not there I want him to know what to do.

When he gets a little older, I’ll expect him to be primarily responsible with me as the backup, and further on, he won’t need me as backup (well, no more than I’d expect any man to look out for the safety of those around them), but at the moment, I’m Dad, he’s a child and I will give him the freedom and responsibility he’s ready for and reserve to myself that which he isn’t ready for.

All this is a long way of saying, you have to know the kid. If you’re not sure your son will be ready at 15 to have access to the gun safe, then as a parent you are definitely right to restrict that access regardless of any other factors.

Only in locales with
1. too many liberals
2. too many lawyers

In other words, states and large urban areas loaded with Democrats.

Yes, that's a simplistic answer. But sure feels like that's
the way it is at times.
