Franken May Appeal To Senate, Courts

Minnesota Senate candidate Al Franken's campaign says it may appeal to the U.S. Senate or the courts because it believes that up to 1,000 absentee ballots were improperly disqualified in the state's recount of votes, The Hill reports.

"Wherever the numbers stand today…that number simply cannot be relevant if it does not include all the votes that were legally cast," Franken attorney Marc Elias said, according to the newspaper. "No recount can be considered accurate or complete until all the ballots cast by lawful voters are counted."

Franken trails Republican rival Norm Coleman by 282 votes with most of the vote counted, though his campaign claims the deficit has shrunk to 73 votes.

Minnesota's Board of Canvassers ruled last Wednesday that it would not revisit the improperly disqualified ballots.

Elias said that of the 12,000 disqualified absentee ballots in the race, "as many as 1,000″ ballots were improperly excluded, and should be counted. Elias said it would appeal to the Board of Canvassers, courts, or even the U.S. Senate to ensure those ballots be counted.

The U.S. Constitution allows each congressional chamber to be the "Judge of the Elections, Returns and Qualifications of its own Members." Senate Majority Leader Harry Reid (D-Nev.) called the Board of Canvassers' decision to not count the absentee ballots "a cause for great concern," fueling speculation that the Senate would explore the legality of the Minnesota recount's results.

"If ultimately there is no remedy before the canvassing board or before the courts, then that is certainly an option," Elias said of appealing to the Senate.

I don’t see what recourse the Senate might have. As for the courts, I suppose it all depends on whether or not the judge hearing the case feels up to creating law from the bench on the day he/she hears arguments...don’t you just love life under a judicial oligarchy?

This man is vile and evil and an enemy of America. He went on SNL to tell the same propaganda lie that has been used in wars from WWII to Vietnam that the troops serving were missing out on seeing their wives cheat on them back home.

Air America stole taxpayer money from Boys and Girls Club of America to fund their operations. Randi Rhodes made several on air death threats against the President.

Dennis Miller has said that Al Franken is a friend of his but that in no way should this man be serving in the Senate.

The Socialist Democrat Party is determined to tear this country apart.

In 2004 Al wrestled a 64 year old man to the ground for heckling John Kerry. Later, he bragged about being on his school’s wrestling team. He uses his wife’s alcohol problems in his ads,and it does not surprise me that she acts as his keeper when he loses control.
Much worse than this is the stuff Keith Ellison,Minnesota’s muslim 5th district Rep to DC., has been saying lately, (search on you tube for his latest.) Ellison mentions the Reischstag fire–hmmm.

No,Comrade...that's not *exactly* how it works.Not only must the voters *themselves* be lawful (and I'm surprised to hear you,a RAT lawyer,acknowledge this) but those lawful voters must have cast lawful *ballots*.You see,*that's* the problem that your client has here.
