3:30 p.m. - Supreme Court to Consider Obama Citizenship Case

The decision on granting a hearing challenging President-elect Barack Obama's U.S. citizenship is still pending.

The "Washington Times" reports that the U.S. Supreme Court held a private conference Friday morning to discuss whether to take up a lawsuit but it was not on the list of court orders for the day.

According to the "Times" a Supreme Court spokesman said the decision to hear the case will most likely be announced next week.

The decision to “hear” may just mean that the “justices” will say there are no grounds for the appeal. Few are more socialistic than the five judges who dominate the court. I cannot see for a second that they would permit an honest hearing.

Well..., the other case that was accepted for a hearing was announced on Friday. It was said in another article that this is usually the procedure, in that it gives the parties ample time to be able to respond to the granted hearing.

The ones which are not heard are usually not announced right away. So, the fact that it was not announced, while the other case was, indicates that this Obama Birth Certificate case is *not* going to be heard.

But. a lot of people already knew that this was going to happen...

Even though I know this case SHOULD go forward, SCOTUS will probably not allow it to do so. I hope and pray I’m wrong.

As former military - sworn to defend the Constitution against all enemies - both foreign and domestic — I would like to KNOW that the CIC who has the power to order me into certain death, at least held that office under conditions SPECIFIED by the Constitution!

If Obama can’t PROVE he is a legitimate NATURAL BORN AMERICAN CITIZEN —I will never accept him as President, and in fact view him as an enemy of the Constitution and Republic.

For Obama to refuse to submit documents to verify his eligibility — is certainly justification to deny him the office.

Please verify your source for your information. Per the SCOTUS web site:

The vast majority of cases filed in the Supreme Court are disposed of summarily by unsigned orders. Such an order will, for example, deny a petition for certiorari without comment. Regularly scheduled lists of orders are issued on each Monday that the Court sits, but "miscellaneous" orders may be issued in individual cases at any time.

Generally, if a case is considered at a Conference, viewers can expect that the disposition of a case will be announced on an Orders List that will be released at 10:00 a.m. the following Monday.

At the end of the day, the Court has never had a case even remotely like this due to the fact that the checks and balances in the Federal Govt have historically worked as intended. In this election, there has been a systemic breakdown that has found its way to the Court as an arbiter of last resort. Anyone who acts like this is run-of-the-mill and that they have any idea of how this will be handled is kidding themselves. This very well could lead to a standard denial of cert on Monday. But it very well may not.

This case goes fundamentally to 1) the primacy of the Constitution over the Executive Branch using the clearest terms and facts possible; AND 2) the ultimate ability of the USSC to assert authority over the Executive Branch through the Court's role as Guardian of the US Constitution. Of course, there have been cases touching on these issues before, however, the bright line precedent that would arise out of this fact pattern provides an opportunity to reinforce the Court's authority over the other Branches in an unmistakable way.

Basically, this is a straight-up mano y mano conflict between the Exec. and the Legis. that the USSC will use to strengthen its power, which is the most important thing, after all.

Hopefully, the SCOTUS judges are smart enough to understand that this issue cannot be swept under the rug and forgotten.

0bama and his minions have given the issue legitimacy by sealing his birth documents in Hawaii which amounts to a cover-up. (Nixon did nothing except attempt a cover-up of watergate).

I doubt they could coordinate with the white house without word getting out.....coordinate so the white house could prepare a plan for internal security?

While it is never good to get ones hopes up, I do have confidence in at least four of the Justices and every now and then a potential fifth. The SCOTUS has had its share of criticism and rightly so when they have in the past legislated from the bench.

As painful as reality can be, purveyors of the US Constitution do have a sacred duty to uphold the very fabric of our Republic.

Unlike some POTUS who have sworn to do so and failed without much consequence, it seems unlikely the last line of defense of the Constitution would ignore a potential violation of the document....

That’s just it - he doesn’t have to produce anything. Nobody does. And the chicken sh*t SC sure won’t. So we’ll have a precedent of letting anyone be elected as president -natural-born citizen or not. I am disgusted by this but nothing any of us can do about it. The Constitution is just a piece of paper.

It only takes four of the nine Justices to vote in favor of fully hearing the Donofrio case. I am counting on Justices Roberts, Thomas, Scalia, and Alito to do exactly that. In fact there may be more than four who vote to hear the case.

I believe the Justices will consider this issue of great importance since it is a Constitutional qualifications concern for our Commander in Chief.

That is not what Leo said. He said the cases that were mentioned yesterday afternoon had already been heard. The procedure on cases discussed on Friday is that the decision is not posted until after 10:00AM on Monday.

Some news articles have stated that Leo Donofrio’s case has already been denied, and that is not the case. If it is denied we will know on Monday.
