A Pennsylvania man has filed a petition to the Pennsylvania Supreme Court, seeking the court to make the Pennsylvania Secretary of the commonwealth demand proof from President-elect Barack Obama that he is qualified as a natural born citizen of the United States.
The petition, filed by James D. Schneller, seeks Mr. Obama's sworn statement, filed with his application for placement on the ballot, and an injunction preventing the certification of the vote and of the Pennsylvania electors ballot, by the secretary, including any certification to Pennsylvania's governor, and postponing of the scheduled meeting of the electors, which by law usually occurs on the third Monday of December.
Mr. Schneller says that if the candidate has not shown his eligibility under the Constitution, the electors should not have their votes certified, their votes should not be tallied in the traditional meeting before the governor, nor should the certified ballots be lodged with the president of the Senate, nor the joint session of Congress early in January.
"It is astounding that no official has demanded proof of this gentleman's eligibility under what is a most simple and basic requirement for the presidency," said Mr. Schneller. "A bare statement by the Hawaii Health Director that they have a valid birth certificate is completely insufficient, and the fact that Sen. Obama apparently has placed a doctored 'certificate of live birth' on the internet, and may have falsely sworn in his candidate affidavits in thirty or more states, should put every American on notice that the Presidency may be being sought invalidly."

What the Left portrays as an assault on Obama is, in reality, an effort to uphold the United States Constitution. The question has been raised, and Obama can quell all the hubbub by simply providing the documents which are needed to prove that he qualifies.

Without a doubt, the vetting of a presidential candidate /> must be transparent and information must be readily available to the general public..this seems to be missing with mr OBUMA. Natural born citizen question: I’m natural born, married to a foreigner who still maintains foreigner status with a green card. Our children are all born in the U.S. and have dual nationalities.
By definition, are they, therefore, NOT natural born citizens because of the dual-nationality problem from birth?
This is the Donofrio argument, I believe. Frankly, I think this is in tune with the founding Fathers. What if my son, as POTUS, had to go to war with the country of his mother?

IMO, I still think the best opportunity will be to win one at the lower court level, either at the state level or a lower federal court. This new case, or the Keyes case, or the WA state case..
That way SCOTUS will be under pressure to hear the appeal by the state Attorney General/SOS or they can just let the lower ruling stand.

It's common thinking that if born in the US, you are qualified. But I think that logic derives from an old assumption that to be born in the US you must have had two US citizens as parents.
Two US citizens having a child provide the child natural born citizenship. There is no argument. But anything outside of that has some qualifications and strings attached.
The reality is, no court is going to act and the commie Senate will confirm Obama as the next president no matter if Obama was found to be the son of Osama born in Iran.

It’s apparent that Bush and the Bush Administration has done nothing to ensure that you see the documents, McCain and his campaign has done nothing to ensure you see the documents, even Palin has done nothing to ensure you see the documents, and the majority of the voting electorate is doing nothing to make sure you see the documents — and for sure, the Obama Campaign and incoming administration is going to *make sure* you do not see the documents — and lastly the Supreme Court is also making sure you don’t see the documents. And if we are going to leave behind the rather specious if not utterly baseless claims of fraud and switch to a purely legal tack -- and let's even assume we can get beyond the issue of standing here, which none of these crackpots individuals ever will, see Lujan v. Defenders of Wildlife, 504 U.S. 555 (1992) -- what you are left with is a case that directly implicates the doctrine of nonjusticeability, AKA the political question doctrine. See Baker v. Carr, 369 U.S. 186, 217 (1962).
But by all means, strap on the tinfoil hats, forget about opposing Obama (and offering viable, conservative alternatives) on anything so silly as actual policy, and enjoy the journey down the Road to Marginalization. And thanks for putting the FR in FRinge.
