He knew there was a domestic problem. He knew there was a threat against the horse. He should have reported this to the authorities, it is his duty as a policeman.
He unloaded the horse and returned it to the owner/nephew. When she pointed the gun at him, he asked her to put the gun away.
When she pulled the thumbcocked the gun and screamed, "LET'S END IT NOW!" he knew that the time for diffusing had passed. The cop saved his own life. But he might have also saved the life of his family and the nephew. I think that everyone here would be on this man's side, if he was not a LEO.
Good luck with that theory. Waive your gun and pull the trigger on some visitor on your property and see what happens to you.
No luck required. If you own the land, you can either force someone to leave it immediately if they don’t have a warrant or you can arrest them and hold them for the police.
Being an armed off duty police officer does not give automatic immunity to the legal rights of a property owner.
As I have said before, both parties here were just plain stupid, one of them is dead and one of them is accountable. Now there will be the lawsuits on behalf of this estate, depending on who the heirs are. More bloodsucking lawyers...
