Yeah and because they most likely wouldn’t have had a gun then were shot by the woman.

Yeah. Just because it's private property doesn't mean you can act crazy and go around threatening people with guns. That's the sort of stuff that gets you arrested or, worse, killed. Like here.

I would have ricocheted a bullet off of a nearby anvil and it would have struck a rope holding a bail of hay suspended over her head. The hay bail would have knocked the gun from her hand and allowed my faithful Indian sidekick to subdue her. I would then have ridden off into the sunset on the horse leaving only a silver bullet.

And I would have looked over to my son and said "Who was that masked man, anyway?"

And WBill Jr. would have replied, "Daddy? You don't know? That was the Lone Ranger."

WBill Jr. is ALL about the Lone Ranger right this instant. Shooting the guns out of people's hands is pretty heady stuff for a little kid. I've gotten tired of him running around the house shooting bad guys (Hearing BANG! screamed every 3 seconds is a little wearing...), so I've told him that he needs to leave the (imaginary) guns outside with the horses and the lassos.

He was invited onto the property by a resident of the property.

When the property owner protested about removing the horse, he unloaded it.

She continued to altercation, thumbcocked the weapon and pointed it.

He’s supposed to say, “Hold on a minute. I need to get my cell phone so I can call for police back up”?

Very bad mistake on her part. One I’m sure she’ll never make again.

No, it would be a homicide charge, 3rd degree.

The policeman didn't follow police procedures. There was an officer involved shooting.

The article also says that she told him to get off of her property and then he shot her. Enuff said right there. The status of the horse is irrelevant here.

Why didn't the dumb ass nephew just ride the horse (if it was his) off the property???

Not at all. IT WAS PRIVATE PROPERTY. At the first sign of any domestic dispute, which was obvious before any weapon was brandished, the officer should have removed himself and others away and immediately called for back-up.

First, he was not there as a police officer. He was there as an invited guest of someone living at the premises, the nephew.

Second, he did try to diffuse the situation and unloaded the horse from the trailer, but the woman would not relent and kept the rifle trained on him and his family.

You are being hysterical.

Very funny.I just think this whole thing is suspicious. For example, if I have a gun pointed right at you, I seriously don’t think you’re going to draw your weapon and shoot me five times without getting hit once. The article seems to suggest she never even got a shot off. That’s suspicious.

Are you kidding? If it wasn't a policeman, there is no way this is murder on the facts we have here.

Murder is the unlawful killing of another without justification. Here, our buyer shows up. Lady on the property comes out and points a gun at the buyer. Buyer shoots and kills the lady. The killing is justified because the buyer acted in reasonable fear for his safety or the safety of others.

Uh... you obviously know nothing about horses. You expect him to ride the horse to the end of her driveway..... and then what? Tie it to a tree? Let it go so it becomes one with nature? Take off the saddle and smack it in the ass? Ride it into the sunset?

Maybe he should take it with him to his new apartment hoping the landlord who has a NO PETS ALLOWED policy doesn't find out that a horse is sleeping on the hide-a-bed in his third floor bungalow?

I served in a jury in a 1st degree murder trial. If someone is invited onto your property by someone on the property, you cannot shoot them unless they are a threat.

The defendent killed a guy that he had invited into his house. He got life.

You're assuming that this woman is acting rationally. From the information here, she clearly wasn't. She's ranting, making irrational demands, and waving a gun about.

Moreover, particularly since the policeman was probably proficient with firearms, it wouldn't surprise me to guess that she was incapacitated after the first shot, but nevertheless still remained a threat. Getting off one shot before a crazy lady waving a gun to and fro can shoot you doesn't surprise me at all.
