H.R. 45 "Blair Holt's Firearm Licensing and Record of Sale Act")

Legislation (H.R. 45 "Blair Holt's Firearm Licensing and Record of Sale Act") sponsored by U.S. Representative Bobby Rush (D-Ill.), would mandate numerous gun control measures if passed.

The bill specifically calls for all handgun owners to submit to the federal government a formal application including: photo identification, fingerprints, medical and mental health records and a completed written firearm safety examine. Applicants would also be forced to pay a fee to the federal government.

The legislation also mandates that a database be established and kept by the attorney general of the United State so as to record every sale and transfer of a firearm.

Additionally, the bill would make it illegal for a licensed gun owner to fail to record a firearm loss or theft within 72 hours, or fail to report a change of address within 60 days. Further, if a minor obtains a firearm (even from stealing it) and injures someone with it, the owner of the firearm may face a multiple-year jail sentence.

And so it begins.

Hardly a breathing spell since the "O" was inaugurated, and already a House bill has been filed to register and license all handguns and their owners, plus several other onerous requirements. I predict it will sail through Pelosi's Democrat dominated House with no problems, and of course the "O" is salivating on his pajama shirt just dreaming about signing it into law.

Unless the Senate Pubs can muster up enough cohones to filibuster this kind of bill several times in each session of Congress for the next four years, by the time the "O" has finished his 1st term US gun owners will be in the same sorry shape as Europeans are now, or even worse if the antigun Nazis get everything on their wish list. They have been biding their time for the last eight years waiting for some radical left winger like the "O" to take over the Oval Office, and now they intend to strike while the iron is hot.

Further, if a minor obtains a firearm (even from stealing it) and injures someone with it, the owner of the firearm may face a multiple-year jail sentence.

How many gun owners will know about that provision of the law until it's too late and they find themselves in federal court charged with a felony? Spending several years in a federal penitentiary for simply being the victim of a common thief would be the most outrageous miscarriage of justice I can think of offhand.

Any co-sponsors yet? Former Black Panther Bobby Rush is a nut — he may have a tough time getting backing. The last incarnation of this bill was H.R. 2666 in ‘07, and it died quickly in House committee. But with an anti-2A SOB in the WH and the Rats having an even larger congressional majority this time around, the enemy might just be uppity enough right now to think they can pass this unconstitutional abomination. So be vigilant and let your reps know about it.

And where is the President's birth certificate and college transcripts? You would think as a minimum, our highest office in the land would expect that much. He wants to spend a trillion dollars, command (or dismantle) the greatest military on earth, and he's pestering me for paperwork over a sidearm, when he hasn't produced so much as a birth certificate? Did he at least provide a valid driver's license? State of Illinois ID? Bus pass? Library card?

No I didn't see that, I haven't kept up with that kind of thing up well enough I suppose. Was Franken given that MN seat, or am I completely out of touch and it's another state that allowed Democrat vote fraud to win out again?

If Reid has 60 votes in his pocket we are so screwed that we may as well start digging holes to bury our guns in.

A Republican senator accepted Obomba’s offer to become Commerce Secretary and the Dem state governor will appoint a RINO who will almost certainly vote along Dem lines despite being a Republican.

Of course it is, but so are the other 20,000 gun laws in the US. The USSC Heller decision was a step in the right direction, but there is a very long way to go yet before the 2nd Amendment is interpreted as it's authors intended. Heller only invalidated a couple of the worst D.C. gun laws, thousands more almost as bad are still on the books all over the US.

Fine.. we know that the House is Democratic to the extreme.. You get ENOUGH people to contact their Representatives with a NO comment.. you will get change.

Its NOT up to the "football" game of Republican Representatives against the Democratic Representatives.. you have to take the NEXT step.. the PEOPLE need to let their views KNOWN LOUDLY.

Yeah they never give up. Liberals are so full of bright ideas that only apply to good, law abiding citizens. since we are all such upstanding citizens, we should just succumb and do our duty since we have nothing to fear. Government will take care of us.

That's a disaster, and not just for 2nd Amendment rights. If the Dems can't be held in check by filibustering the worst items on their agenda it's all over but the shouting for all Americans who love liberty, not just gun owners.

The little Keltec .380 hideout pistol I have had on order since right after Christmas finally came in today, and I was in a pretty decent mood until tonight when I read the NSSF email alert. Now I can't even describe how bad my mood is, but my Democrat neighbor had better keep his liberal crap out of my face for the next few days.

I think “F#ck ‘em” will be the attitude when they overstep. I will be purchasing at least one more firearm soon, while it is still easy to do so. If they make any or all of them illegal, there are several options:

1. Ignore them.
2. Report the firearm in question as stolen, then hide it somewhere for 4 yrs.
3. Lock and load.

I think the recent SCOTUS decision in the Heller case gives us some temporary cover. All bets are off if Obama gets a couple of Justice appointments and/or the Republicans don’t quickly regain seats in Congress.

I have seen this atrocity and others that have been proposed, including another more restrictive version of the AWB sponsored by none other than my own congress critter and sheepish RINO, (not so) HON Ileana Ros-Lehtinen! But despite having been crafted have they actually been filed and where are they in the conduit of committees? Have there been any votes?

The scenario I envision is some kind of crisis, involving a firearm. And O issues an executive order banning that kind of firearm, which will be broadly describedas a semi auto “assult weapon”
And if that gun is traced to a gun show purchase, that will be the opportunity to include closure of gun shows while “policy is under review”.
Even if suit is filed the process will continue until the court resolves the issue.
But wait. it won’t happen immediately. Things will be delayed until a USSC justice retires and the “only” judge “qualified” for the job will be entered.

But in the mean time this blair holt heaping pile and similar measures will be attempted on sleepy Americans.

By creating laws that generate widespread violation, they will go after whoever the want to. Just like they can stop blacks for going 60 in a 55, or having a burnt-out bulb, they’ll be hauling off in handcuffs the guy who writes critical letters to the editor, or thumbs his nose at lawn watering restrictions, or doesn’t recycle with mandated care. Bitter ex wives will use this as leverage, etc. etc.

Your advocating riots? That will accomplish NOTHING. You will be seen as lawbreakers.. and play into the hands of the democrats.

Your expecting to have the Republican Representatives fight the whole battle for you. Pickup the phone.. write a letter (yeah.. Snail Mail), or Email.. Often.. Get the like minded to do the very same thing.. Politely.. but pointedly express your opposition to issues.

You get enough people to do that.. and even your democratic representatives might think twice about voting for party lines. Maybe not on everything.. but some issues..you might be surprised.

This Woe is me mentality is CRAZY. Its time to get into the trenches and FIGHT, but in a legal way.

Keep track of each “Republican” who votes for H.R. 45.. and then work to inform others that he did trade away the rights.

Look I am not saying that the battle is automatically won.. but staying on the sidelines and just crying that the democrats is screwing us over.. leaves a very very bitter bile in my mouth.

I'm pretty sure, at this point, that convicted felons/criminals will be treated better by this administration than will law-abiding conservatives.

If they manage to federally register all of us and our guns, their next step will be easier. To disarm us. If/when they do that, we might as well prepare some nice, heavy-duty knee pads, cause we're gonna need em.

True. But consider that this particular bill is SO onerous, and will draw even more attention than it has already...

...on purpose...

because it is a Trojan Horse, inside of which is AWB II.

THAT, folks, is the killer - this one takes away nothing, but it is only handguns. They are after the rifles, and step one is to limit or choke off supply of the ones that have been most useful in anti-government operations around the world.

Fight on everything, hard - let your rep, no matter how pro- or anti-gun, know that you are unalterably opposed to this garbage. They all have to run in 2 years, and you should remind them ALL about 1994. Senators, too - remind them that Algore lost because he lost his home state, W. Virginia and Arkansas - all pro-gun but otherwise friendly states to him - due to his stance on gun registration.

We not only get to vote in 2010, but one last time, whenever we choose. I dearly don't want to see that happen, but neither did the Founders. We got 200+ years of good from that particular election, hard fought though it was.

Related legislation should be proposed. Because reckless use of writing instruments has led to incalcuable loss of innocent life (Mein Kampf, The Communist Manifesto, etc.), the following sould be enacted as soon as possible:

1) All assault writing instruments (printing presses, word processors, laser printers, photocopiers, etc.) shall be forbidden to minors and convicted liberals.

2) Assault writing instruments shall be restricted from import, except for military and police use.

3) Memory devices capable of holding more than 10 chapters shall be banned.

4) Sales of all writing instruments shall be registered and a background check conducted on buyers.

5) Any conviction of libel or slander involving the use of an electronic writing instrument shall result in enhanced penalties up to double the original sentence.

I'm sure there are more, but it is critical for the safety of our children that the rights guaranteed by the 1st Amendment be curtailed, controlled and restricted by our loving, nurturing government immediately!

I'm pretty sure, at this point, that convicted felons/criminals will be treated better by this administration than will law-abiding conservatives.

I am not advocating riots. I am saying that riots are inevitable. The are inevitable and they will not be started by conservatives. Look at what is happening in Europe. The riots will be started by dissatisfied entitlement recipients.

However, as Rahm Emanuel is so fond of saying, every crises is an opportunity which should not be ignored. We need to be better prepared to cash in on the riots than Obama and his disciples.

SPRINGFIELD — Illinois gun owners could fall prey to a state bureaucracy that fails to process firearm owner’s identification cards promptly.

The state’s tardiness leaves some otherwise law-abiding firearm owners vulnerable to criminal charges because FOID cards often expire while the state police are still processing renewals.

Criminal charges can be filed against any resident who possesses a gun but does not have a valid FOID card.

The Illinois State Police agency is required by law to process FOID applications within 30 days. But the process is taking up to 60 business days, according to agency spokesman Lt. Scott Compton.

“Gun owners can’t go shooting, can’t go hunting, can’t buy ammo, and can’t legally own a gun. They’re caught in a problem with the state police not complying with their own law,” said Richard Pearson of Chatsworth, executive director of the Illinois State Rifle Association.

Compton attributed the delay to a deluge of 280,000 applications last year, well above the 225,000 the state averages and the most since 1968. More than 88,500 came in the last three months alone. One day in December 2008 saw about 2,400 applications, more than double the state’s average for that date.

Though an additional three staff members have been assigned to handle applications, they haven’t completed training, Compton said.

Just what is causing the sudden influx of FOID applications is an open question. Some gun shop owners contend after the November 2008 election of President Barack Obama, more people sought to buy guns because they feared future restrictions on firearm sales.

Under certain scenarios an otherwise law-abiding gun owner without a valid FOID card could be charged with a felony punishable by up to three years in prison, said Todd Vandermyde, a Springfield lobbyist for the National Rifle Association.

Even people who keep guns locked away in their homes while they await their FOID renewal are in technical violation and can be charged with a misdemeanor.

This leaves some to question the state’s gun-purchasing policies.

Roger Skartveit, owner of Bazooka’s Gun Shop in Ottawa, favors moving to a system similar to Arizona’s, where driver’s licenses are used as identification for gun buyers.

“If you have any reason you couldn’t purchase it, it goes on your record. So when they swipe your card, you either get an approval or a denial immediately,” Skartveit said.

This “instant-check” system takes about 30 minutes, he said.

In addition to the record number of card applicants in 2008, this time of the year is particularly busy for FOID applicants, said Tim McGrath, owner of Guns and Gadgets in Peotone.

“In September and October, guys get ready to get in the field to go hunting. Then they see their card is going to expire, and have to get it taken care of before it does,” McGrath said.

Vandermyde said he believes the delays are due to the state’s fiscal woes.

“There’s no money out there to process these cards. It is like everything else in state government, the governor has screwed things up,” he said.

Pearson said he isn’t sure if delays by the state police were intentional, but said he wouldn’t be surprised if that was the case.

“If the state doesn’t agree with your right, they simply close off the faucet. We’ve seen this in other cases. You can’t get motorcycle licenses because they don’t offer the courses. You can’t hunt because they don’t offer hunter’s safety courses,” he said.

McGrath said gun owners shouldn’t be penalized because the state can’t adhere to its own law — but owners need to take a measure of responsibility, too.

“If you’re responsible enough to own a firearm, you’re responsible enough to get the application,” McGrath said. “You make sure not to wait until the day you’re going hunting.”
