Obama sends labor another bouquet (Obama Exe)
Boston.com ^ | Feburary 6, 2009 | Executive Order.......

Posted on 02/06/2009 3:13:38 PM PST by yoe

In his latest labor-friendly move, President Obama signed an executive order this afternoon encouraging the use of union workers for big federal construction projects.

The order instructs federal agencies to have construction contractors make agreements that require contractors to negotiate with unions, recognize union wages and benefits, and follow collective bargaining agreements.

Obama's order restores a Clinton administration rule that was rescinded by President George W. Bush, the Associated Press reports.

In response, Stephen Sandherr, chief executive officer of the Associated General Contractors of America, issued a statement:

"Today's executive order has the unfortunate potential to limit contractors' ability to compete for projects at a time when the government is reporting that over one million construction workers have lost their jobs. Given that federal agencies have no demonstrated expertise in writing contracts that cover contractors and their employees, we strongly encourage officials to exercise the discretion this order provides and avoid government-mandated labor agreements," he said.

The full text of the order is below:

EXECUTIVE ORDER - - - - - - - USE OF PROJECT LABOR AGREEMENTS FOR FEDERAL CONSTRUCTION PROJECTS By the authority vested in me as President by the Constitution and the laws of the United States of America, including the Federal Property and Administrative Services Act, 40 U.S.C. 101 et seq., and in order to promote the efficient administration and completion of Federal construction projects, it is hereby ordered that:

Project Labor Agreement: If you hire union workers, union workers won’t commit acts of vandalism, sabotage and assault which would slow down the progress of the job.

BIG government labor will destroy business in this country. Everything is going to go out of the country. I am waiting for the assault on WalMart to unionize it. That will be their first huge attack when the unionizing of all comes around.

This will make all federal projects cost more as all contractors must use “prevailing wages” (ie union wages) for workers.

No longer can a non-union company have an advantage over a unionized company when bidding on a federal project.

What then, is the force or effect of the Davis-Bacon Act?

So, non-union labor is not really labor. I see. They don't deserve the work as much as union labor.

Now we can have Big Digs all over the country. Add in the cost overruns, and a $Trillion looks like chicken feed.

Federal projects (and most public projects of any kind - state, city, county etc.) already require that prevailing wages be paid - that is the primary point of the Davis Bacon Act - and hence leads to my question...

What is the force of such a law when the President can sign an xord that says they have to use Union Labor anyway, even if the non-union contractor pays DB Wages?

I urge ALL to frequently check the “Presidential Actions” section of the now totally pukey monsterHouse website. Explore around the site for more coming misery and radical decisions that will be couched in spin and ooze in the pressers.

http://www.whitehouse.gov/briefing_room/PresidentialActions/

Anyone who was so vengeful, BDS-consumed, petty, selfish or stupid as to sit out or vote 3rd party in this election should be tarring, feathering, cursing, mutilating and punishing themselves for the next 8 years.

Anyone who fantasized that 0 wouldn’t be that different from Pres. Bush needs to be institutionalized and permanently removed from sane society.

Obama's payback to unions because they got him elected. Some of Obama's favorites are socialist backed unions. This is just one more control measure for Obama's marxist ideology. You must control them and take freedom and choice away.

From here on in, Obama gives and he will control with that giving. You want it, play by his rules. Hitler would be proud.

Forgive my multiple posts on this page, but I can't sit still.

From the xord:
Construction employers typically do not have a permanent workforce, which makes it difficult for them to predict labor costs when bidding on contracts and to ensure a steady supply of labor on contracts being performed.
False.

Challenges also arise due to the fact that construction projects typically involve multiple employers at a single location.
Misleading - while there may be multiple employers there should be a single GC responsible for the contract and therefore for all of their sub-contractors. Additionally, there should be a CM from the agency overseeing the project.

And the crux of the matter is identified in Section 3(c):
contain guarantees against strikes, lockouts, and similar job disruptions;
The Unions have spoken - within 6 months large scale projects will be rolling across the country - the Democrat in the WH got word that his work projects were going to come to a grinding halt unless he guaranteed organized labor, wich spent MILLIONS on his election, their 'fair' share.

.

If I were a millionaire (which I clearly am not) I would file suit today in federal claiming a conflict of interest - asking as relief either recension of this order or that he be required to return all of the contributions made by or bundled through labor organizations.

I am waiting for the assault on WalMart to unionize it.

Going on right now in Lodi CA. Have been trying to get approval for building a SuperCenter for over 5 years. The concerned citizens group (Union front) keep finding environmental reasons not to build it, even though it is right across from the old style one. Nothing but Union stuff. The other supermarkets are so worried that they will go out of business. I do not love shopping at Walmart, but I believe that they have a right to exist. If you can't compete with them, then figure out what you are doing wrong. Don't blame Walmart for your failures.

It's not about wages. It's about who can and cannot bid on Federally funded construction projects. No open shops will be allowed to bid. Only union shops will be allowed to bid. It reduces competition and provides an unfair advantage to union shops in those states that have Right-to-Work laws.

This is very big. It will give the unions a spring board to freeze out open shops in Right-to-Work states where the unions have all but withered away due to their non-competitive practices. With the trillion dollar federal spending package on it's way, this will ensure that only union shops get the "stimulus" and all open shops get nothing.

One reason is to force small family businesses out of the workforce.

The prevailing wage law is bad enough, it's cost us a lot of wasted money.

Most government jobs of course have a lot of graft and payoff in them, so honest struggling small business are out of the loop.

This is another form of intimidation. The Dem's way of saying only those who play nice with unions will receive contracts and only those under the thumb of the unions will participate in the 2-4 million jobs offered by the stimulus (pork)package.

I would not be so bad if the Democrats would just come out and say we are Socialist and proud. But instead they do this back room crap. At some point there is going to be hell to pay for this kind of distasteful executive orders.

One thing the Pelosi and her kind in the government should keep in mind is the following:

“Texas is a free and independent State ... All political power is inherent in the people ... they have at all times the inalienable right to alter their government in such manner as they might think proper.”

I actually think he should be arrested on the grounds he is an enemy of the state

think about it surely he was groomed for years to get in on the inside to ruin us. Ayers knew his violence was never going to win.
Karl Marx said that they could never take over by force and that they have to get people into positions of power and influence, i.e. teachers, professors judges, elected officials etc.
He has the USS Cole mastermind
his first media address is to the muslims
he shuts down Gitmo and orders be nice to terrorists and being them here
He mentions his muslim roots for the first time to muslims
homo’s open in the military(saul alinsky tactics)
the list is endless in his first few days

to me he and his voters are the enemy who do not care for this great country.
If this bill passes this will ensure that we are screwed financially for at least a generation

I am not a Walmart fan either. Their supercenters have virtually shut down all grocery stores around our area. There are 3 SC’s within a 15 mile area and there are only about four or five other grocery stores in the entire area that are surviving. Mostly in the outer areas, not anywhere near the SC’s. They come in and under cut of course all the grocery prices and they go out of business. Then Walmart starts raising prices. Back during the high gas prices they jumped up their prices to match the increased gas prices. Now that gas has dropped, OF COURSE, Wallyworld HAS NOT dropped the grocery prices back. They kept them where they were when they raised them. So, any excuse to raise, no reason to bring them back down. Really pisses me off. We basically have not other choice but too get groceries at Wallyworld.

They have tried to unionize Wal Mart before.

First thing they did to get their foot in the doors was to unionize their butchers in the meat departments. It looked like it was gonna happen until Wal Mart simply decided to shut down the meat departments.

Nice slap in the face for the union thugs.
