Judge Overturns Death Sentence for Kentucky Honor Student's Murder

A western Kentucky man convicted of raping and murdering an honor student had his death sentence overturned by a federal judge who said Tuesday that justice demands a new hearing even though there's no doubt about the brutality of the crime.

U.S. District Judge Thomas B. Russell sent 34-year-old Robert Keith Woodall's case back to state court for re-sentencing. Russell found that the state judge improperly instructed the jury before sentencing and denied Woodall a chance to object to a black juror being dismissed.

"The crimes Woodall admitted to committing are revolting and despicable," Russell wrote in a 92-page ruling. "There is also no question that the victim and her family deserve justice. However, ours is a system of law that is concerned with justice for both the victim and the accused."

Woodall in 1998 pleaded guilty to killing 16-year-old Sarah Hansen after abducting her from a convenience store in Greenville in western Kentucky. A jury sentenced him to death for the murder plea and life in prison for kidnapping and rape.

Hansen, a member of the National Honor Society, vanished on Jan. 25, 1997, after going to the store to rent a movie with plans to return home and watch it with her boyfriend. About two hours later, police began searching for Hansen before finding the minivan she was driving at Luzerne Lake, about a mile and a half from the store.

Officers followed a 500-foot long blood trail from the van to the lake, where they found Hansen's unclothed body floating and her throat slashed. DNA, fingerprints and footprints led to Woodall. His case was later moved to Caldwell County because of pretrial publicity.

That’s why I always say we have a legal system not a justice system. Eventually, there’s going to be a point when the People get fed up and administering their own justice.

Ummm.... once convicted, he is no longer "the accused". The trial was fair. The sentencing simply was based upon the nature of the crime.

Note to judge: Please reveal your connection to this case - financial or personal?

I would like to say I think you are right about people getting fed up with this legal parsing. Unfortunately, I think the ‘Cowards’ Holder referred to in his pathetic speech was the unwillingness of the large majority of our fellow citizens to actually take the risks or make the effort to take action.

I am even more convinced about this the more I see everyone tacitly accepting the outrages of Bailouts, massive frauds and essentially corrupt governance. They may grumble but most will not act.

Most of those coming out of law schools now days are so far liberal that they believe all that post modernist garbage that is taught in liberal arts departments. I came across a new term, the other day, structural oppression or, as it is currently called, structural violence.

This is pretty simple, the structure is the cultural structure of the white capitalist, including government. The oppression or violence is any thing that denies a group of people the happiness that they desire. So, the white man through slavery, and prejudice, denied blacks, we know that. But they have extrapolated this to mean denied them a nice home, or good schools, and even through our culture of militarism, and judicial system, we have caused mental strain that causes people to commit crimes and also causes mental illness.

The last chapter of one book that I was looking at, had the title: Conclusion- Can we imagine an ordinary person as an earthly god?

And this structural stuff. Couldn’t be said that the current governments leftist structure will cause violence? Oppression? I would think it could and does include the far left it self. How do they avoid that? In the book, that is. Understanding the enemy.

Structural Oppression

I was posting on the board of the local newspaper and there was this letter to the editor about the white structual violence and the culture of militarism. I knew immediately that it was garbage of victimization that is taught in ethnic studies course, and decided to look it up. Sure enough. You won't even believe all the garbage that comes up on Google on the subject.

The second part of your question, about whether the current government could be considered to be cultural oppressors. No.

One of the local leftists asked me that same question on another thread, where I was saying that the local and state government is waging a war against the rural dwellers. The answer was no, that would be reverse structural oppression, because the rural property owners represent the traditional culture that the elitist governing cabal is attacking. It is our way of life that they hate, and want to turn upside down.

I knew some of this from reading about liberation theology and post modernist thought, but this goes beyond any of that. They have created their own jargon to describe this ideology. I don’t even know what else to describe it, but ideology.

This is an a long article, not a book. I was able to scan most of it when I clicked on the html choice. This is from a law school. So, I was right when I connected the legal system and restorative justice to this structural oppression garbage.

Here is an exerpt:

In light of my critique, macro structuralism and macro individual agency
and practices share common functions. Each major set reveals the degree
to which white structural oppression works against ordinary people. Race
Crits appear to use these themes to unearth invisible, deeply encrusted
forms of structural injustice.

These hidden forms permit whites to
control ordinary people and men to dominate women.
By deconstructing elite white narratives, Race Crits must believe that a

From my quick look at your link, this reminds me of the basic assumption that liberals base their misleading conclusions from. They have assumed that it is institutions that form and work in society that makes for this worlds woes, not the individual. It is these institutions that make for human evil. From there they can go their merry way, destroying “institutions” to “cure” the ills of the world. They truly believe that mankind is innocent, apart from evil/wrong institutions. Their rejection of God, and the resulting consequences of their actions will kill this country.

It is weird that they then conclude that individuals can be god, though. It is they who have appointed themselves that position over the rest of us.
