Obama’s first judicial nominee blocked Indiana abortion (consent) law

Washington D.C., Mar 27, 2009 / 04:04 am (CNA).- President Barack Obama’s first judicial nominee’s record includes judicial decisions which obstructed the enforcement of Indiana’s informed consent law requiring women to be told the risks of abortion.

President Obama on March 17 nominated Judge David Hamilton to the Seventh Circuit Court of Appeal. He is presently U.S. District Chief Judge for the Southern District of Indiana.

Over his seven years as a district judge, Judge Hamilton ruled against the Indiana informed consent law which required abortionists to inform women about the risks of abortion. The Indiana law was identical to a Pennsylvania statute upheld by the Supreme Court.

Judge Hamilton claimed the law imposed an “undue burden” on a woman’s ability to obtain an abortion.

The Seventh Circuit Court of Appeal reversed Judge Hamilton’s decision on appeal, and strongly criticized his decision as an “abuse of discretion.”

Critics have also reported that in 2005 Judge Hamilton ordered the Speaker of the Indiana House to stop the delivery of “sectarian prayers” at the opening of the legislation. The judge ordered that the prayers “should refrain from using Christ’s name or title.”

Concerned Women for America (CWA) President Wendy Wright, who was critical of the nomination, remarked that even the “liberal” American Bar Association had rated Judge Hamilton as “not qualified” for his post.

“Hamilton's decisions reveal a deep disrespect for the Constitution and overinflated view of his own opinion. Senators would be derelict in their duties if they vote to promote him to do further damage to religious freedom and justice,” she argued.

Mario Diaz, Esq., CWA's Policy Director for Legal Issues, charged that Judge Hamilton’s record showed a “dangerous understanding” of the role of a judge and of original intent when enacting the First Amendment.

“Few things could violate Judge Hamilton's supposed 'separation of church and state' more than the state (i.e. Judge Hamilton) telling people they cannot pray in the name of Jesus. It seems Judge Hamilton would use the law as a tool to steer the country in the direction he believes it should go. That is not the role of a judge,” said Diaz.

The Obamanation is proceeding as expected for the kind of Marxist activist he is.

Obama is revealing himself to be far further to the left than anyone could possibly have expected.

I have personally called the Archbishops Office in Baltimore and confirmed that O’Brien has sent a letter to Notre Dame condemning the invitation of Obama. It has not been made public. Please call your local Bishop and ask if they will also be sending a letter.

The facts of this appointment are easy to state: the president has selected as his first judicial appointment an ideologue who was been reprimanded for abuse of discretion by the Seventh Circuit Court of Appeals. The American Bar Association has rated Judge Hamilton to be "not qualified," a negative rating almost never resorted to by the American Bar Association especially with reference to a Liberal appointee.

Hamilton' s reported decisions betray a hostility to the exercise of the Christian religion and an unsettling fastidiousness to preserve abortion rights.

It is clear that the President of the United States, in making his first judicial appointment, has chosen ideology over all other considerations. Anyone familiar with Obama's history of zealously protecting abortion glaringly illuminated by an incomprehensible failure to protect babies who miraculously survived botched abortions, should not be surprised that this has occurred.

If any reader is unsettled in mind whether Barak Obama is an earnest but misguided liberal as opposed to a committed radical Marxist, this appointment should prove highly probative for the second choice. At the very least it demonstrates that to understand Obama you need not worry about whether he is a narcissist, you need only study his ideology. Culminating in this appointment, Obama has done nothing, repeat nothing, repugnant to what his biography tells us about the man: he is a Manchurian Marxist.

This appointment I take to be a confirmation of the judgment which many of us made prior to the election. It is disquieting because it raises questions about whether facts on the ground will deter Obama from fulfilling his ideological destiny. In other words, are we to live out Obama's own version of Mein Kampf? Will he persist until Gotterdammerung?

An acolyte of the Saul Alinsky method would be expected to conform his actions to fit the circumstances: when possible, attack when necessary, withdraw. So far Obama has shown not the slightest disposition to withdraw anywhere but, thanks to a complaisant media, he has not yet faced any pushback strong enough to qualify as a test.

Until Obama surprises, I see no reason to depart from the judgment that the man is determined to dismantle the America we had hoped to pass on to our children. If I am wrong, some unexpected event will demonstrate the real character of Barak Obama and relieve me of my anxieties.

Meanwhile, the drama now turns toward the United States Senate and the Republican rump who will choose either virtue or politics as usual. I have no doubt that Lindsey Graham will soon make the choice plain.

Does anyone believe Lindsey Graham will choose pushback?

And this is what Obama is going to do. Fill the courts with abortion-friendly judges and other extreme liberal jurists, and he has the votes to appoint anyone he wants.
