'Twittered' eligibility case lawyer faces threat of sanctions

Team defending Obama, Biden warns of 'costs, expenses, fees'

A Washington, D.C., law firm defending President Obama in a lawsuit challenging his eligibility to be president that earlier was tossed by a district judge because the issue already had been "twittered" now is threatening sanctions against opposing counsel if he doesn't withdraw his appeal of that decision.

The warning from Robert F. Bauer of the Washington firm Perkins Cole was delivered via letter to the plaintiff's attorney, John D. Hemenway. It is not the first such warning issued. Lawyers trying to kill a similar California lawsuit filed on behalf of Ambassador Alan Keyes also said they would seek sanctions against the plaintiff's attorneys in that case unless they left the issue of the president's eligibility alone.

The warning from Bauer noted that the firm represented Obama and Vice President Joe Biden in the case brought on behalf of Gregory S. Hollister, a retired military officer who is subject to being recalled to duty and, therefore, would need to know the legitimacy of any order coming from Obama.

"For the reasons stated in Judge Robertson's ruling, the suit is frivolous and should not be pursued," the letter warned. "Should you decline to withdraw this frivolous appeal, please be informed that we intend to pursue sanctions, including costs, expenses and attorneys' fees, pursuant to Federal Rule of Appellate Procedure 38 and D.C. Circuit Rule 38."

Hemenway. But Robertson quickly backed away when Hemenway noted the judge had cited hearsay in his ruling. Hemenway argued that if he was going to be penalized, he was eligible to a discovery hearing in which he could see documentation of what the judge cited as fact.

No one has mentioned that in bringing sanctions against the accusers, they have made themselves vulnerable.

The accused are entitled, by law, to seek/subpoena discovery of all relevant information in their defense.

I hope God had a hand in this judge’s decision, even if the judge had no idea.

All that is hidden will be brought to light,
and God works all things for the good of those who love Him.

Luke 8:17 For all that is secret will eventually be brought into the open, and everything that is concealed will be brought to light and made known to all.

Romans 8:28 And we know that God causes everything to work together for the good of those who love God and are called according to his purpose for them.

An article from 2008: Robert F. Bauer of the Perkins & Cole law firm, has written U.S. Attorney General Michael Mukasey, seeking to shut down the reported FBI investigation of ACORN and others. Instead, Bauer says, there should be a probe of those who have voiced concerns of voter registration fraud, claiming it's an intimidation effort designed to suppress voter turnout.

I know what you mean. Can’t say the doom thing has lifted but I am convinced that the jackal in chief is not going to last 4 years. I think April 15 will be a good day. Even I a total hermit is going to a Tea Party.

“A President who REFUSES to show he is even eligible to sit on the seat he RULES from is threatening anyone who dares to challenge him?”

A small correction, if you will.

A President who REFUSES to show he is even eligible to sit on the seat he SERVES THE PEOPLE from (or should be)is threatening anyone who dares to challenge him?

I’m sure you didn’t mean it this way:

But the idea that ‘we the people’ are here to serve at the leisure of our government officials — rather than the other way around — needs to be put to rest.

In a way your wording is correct — our servants HAVE become our rulers.

Somehow this trend has to be reversed.

The RULES was emphasized sarcastically because that is how Rahm Emmanuel put it.

I am ruled by nothing or no one but my conscience and my God.

“He also asserted that if he was penalized he would have the right to a discovery hearing to see documentation of the judge’s statements – ***not supported by any evidence introduced into the case*** – that Obama was properly ‘vetted.’” (emphases mine)

I like this... a lot!

I would think that the ‘evidence’ would tend to show that Mr. Obama was NOT ‘properly’ vetted for the reason that so many of Obama’s vital records have been locked up, ‘sealed’ or otherwise hidden from public scrutiny.

So a reasonable person would ask:

How could an interested public have been in a position to ‘properly’ vet Mr. Obama — under the aforementioned circumstances?

The defendants decry legitimate concerns posted on the internet as rumor, innuendo and ‘smears’ but want to use unsubstantiated internet hearsay — originating from such sources as factCheck, twitter, etc. — to support their case!

Thus we seek to discover(uncover)the original ‘hard copies’ of Obama’s vital documents!

I am a professional hermit myself. I live 15 miles from a town of any size. I would rather look at cows and trees than people and buildings. My wife is half hermit due to her being a one time city girl.

I’m a hermit by birth and habit, better half has become a hermit after marrying me.

It can take me a couple of weeks get motivated to drive the 4 miles to the nearby tiny hamlet.

I was born in 1962 and the America of today is like living in a foreign country. The talking heads like to compare whats going on here as a transition to a form of European socialism. I spent considerable time in Europe in my younger days and what is going on here has got nothing to do with a transition to European socialism.

How do you characterize the change you see, though?

I am a voracious reader of both fiction and non fiction books so the easiest way for me to describe where I think our country is headed is to use books I have read. I know George Orwell’s 1984 is being talked about a good deal lately(with good reason)but the comparison always felt like it was missing something. The other day I was looking for something to read and there on the shelf was the missing piece to the puzzle in the form of Ray Bradbury’s Fahrenheit 451. I thought these two dystopian novels when combined together completed the picture but there was something that was still missing. Your question got me thinking on the subject and I finally realized what was missing. I know there has been considerable talk of the Neo Marxist ideology/philosophy of Obama and some of his supporters and followers. This strain of Neo Marism is mostly based on the philosophy of the Frankfurt school. It is largely responsible for the craziness of the 60’s. So the answer to your question is as follows. Imagine if an adherent of the Frankfurt School philosophy decided to write a book describing how they would like the world to be. This book would be an amalgamation of the dystopian idea’s contained in Orwell’s 1984 and Bradbury’s Fahrenheit 451 constructed through the philosophical bias of a Neo Marxist. That is as close as I can come to describing how I feel about where the changes that are occuring in our country may be leading us.
