Note bene this issue has nothing whatsoever to do with gay "rights."

This is the right way. It is the same as if the mother was living with a man who did not father the child. There are no rights being trampled here, in fact, they're protecting the child's rights to a biological mother and father.
Now, if the "partner" wants to adopt the child and the mother agrees, then we have something interesting - what is in the best interest of the child? that's how it should be decided.
