Appeals Court: Marine can't sue Murtha

WASHINGTON – A federal appeals court has ruled that a Marine cannot sue Pennsylvania Rep. John Murtha for defamation.

Staff Sgt. Frank Wuterich of Meriden, Conn., claimed Murtha damaged his reputation by saying he and his comrades killed women and children "in cold blood" in Haditha, Iraq, in November 2005.

Murtha argued he has immunity from the lawsuit because he was acting in his official role as a lawmaker...

Hmmm...I thought that that immunity was only for statements made on the floor of the House, and not outside the building to reporters.

Then if he was acting in his official capacity to defame the soldier he can be censored and removed from the House of Representatives. The Republicans should demand his ouster and let the Democrats spend the next six months defending his despicable actions.

Quite true. Conservatives really have no representation right now, I can’t think of a single U.S. Congressman that I trust. So therefore, we have to act on our own, collectively. And aggressively.

All they have to do is pay off the court clerk who assigns the cases to judges. The court clerk probably assigned that judge because the judge was sympathetic to Murtha.

Yet another case of overt judicial misconduct in the service of a political agenda. Or did Murtha just give them money? This SOB was NOT acting as a legislator when he slandered our Marines. He was bloviating on TV, in an agit-prop campaign designed to give aid and comfort to America’s enemies. The judges’ position means that Members of Congress are mini-Sun Kings , above the laws that bound the rest of us. What bastards these people are!

The corrupt court system - just another one of the boxes of liberty closed up by the left.

However, I agree with this one. A congressman should be able to say whatever he wants on the floor without having civil or criminal penalties.

His constituents need to take care of the problem and vote him out. If they don’t, they should be the subject of national ridicule.

This amounts to a blanket exemption for lawmakers. I believe the standard used to be that only statements made “from the well of the House” were exempt. Why shouldn’t the courts return to that definition & let a trial court sort out the rest?

Murtha may be immune from prosecution but he is still a fat fart, a weasel, and a crook. He will burn in hell for all of eternity unless Al Gore succeeds in shutting down the fires of hell to stop cosmic warming, in which case Murtha will get off with an eternity of worms crawling in and out of his orifices.

My wife is from Carroltown, in the heart of Murtha’s district. At church I was looking at the people. They are decent, hard-working folks.

I can’t understand why they support Murtha.

I can only conclude that they just aren’t aware of what a scum he is. Sure the local media doesn’t inform them.

Many are Catholic. They still believe in the mantra: The Democrats are for the poor people, the Republicans are for the rich people.

But, to be sure, many of them believe that Murtha brings home the bacon for the district.

It’s very perplexing.

I pray all the time to St. Joseph, the patron saint of Justice...

As long as one lawmaker does not operate counter to a cadre of stronger lawmakers, he can do as he pleases. Murtha has even admitted that he is corrupt. But since he’s protected by the Princess of Darkness he’s untouchable.
