Illegal immigrant charged with child rape had been released a year earlier after assault arrest

A year before Prince William County police say he raped an 8-year-old girl, court documents show an illegal immigrant from Honduras was released by Montgomery County police after being arrested for second-degree assault.

Marcos Banegas has been on the run since Feb. 16 when Prince William County police charged him with forcible sodomy and aggravated sexual battery of a Woodbridge girl.

But before moving to Prince William where police say he cut hair at a local salon, the 26-year-old was arrested by Montgomery County police. Banegas was accused of “violently” grabbing a stroller, causing the child inside to be shaken, police said in court documents. The incident allegedly occurred while Banegas was arguing with the child’s mother near the intersection of Muddy Branch Road and West Diamond Avenue in Gaithersburg.

The charges were later dropped, and Banegas was released. Had his name been sent to federal immigration authorities, as it was in Prince William County, Banegas would have been detained for deportation hearings.

Earlier this year, Montgomery County Executive Ike Leggett altered the county’s long-standing policy of not sending the names of those arrested to Immigration and Customs Enforcement. Pushed by a series of high-profile killings allegedly committed by illegal immigrants, Leggett said in February the county would now send to ICE the names of people accused of violent offenses.

Leggett said the county would rely on the state’s legal list of violent offenses. But second-degree assault is not included on that list, and Banegas’ name would not have been turned over to ICE under the new policy, Leggett’s spokesman Patrick Lacefield said.

“People need to be held responsible for the crimes they commit,” Lacefield said. “Reporting every single crime would be putting county police in the position of enforcing federal immigration policy,” he added, calling on the federal government to reform immigration laws.

Jon Feere, a policy analyst at the Center for Immigration Studies, said Banegas’ release “is a perfect example” of local governments failing to enforce immigration law.

“Legal residents are going to have their lives threatened by people who are in the country illegally if those people aren’t deported after having committed even the most minor of offenses,” Feere said. “Montgomery County and Maryland as a whole are slowly realizing sanctuary policies are bad policies.”

Personally, I would label it, “Vote for X, they advocate for murders, rapists, child abusers, robbers, and other crooks who target your family.”

Whatever, but it wont raise any eyebrows and will get lost in the crowd.

You can thank just about all of the Democrat politicians and bureaucrats. These people are slowly destroying our country. I see it every day.

There may be some truth in your consideration of Holder there. I mean the part where his loyalties are rather scattered. I’m not privy enough with his youth to know, but you’re spot on when it comes to Obama, no doubt about it.

I wrote this the other day. It touches on the ignorance vs planned activity too. It also touches on him being somewhat of a puppet. If this guy was that smart, he wouldn’t need the teleprompter. He’d be doing this from his own soul.

Politicians and the MSM have created an environment where almost everything government says about illegal immigrants is not true and the policies are a total failure. I see it every day. It is part of the overall policy by the government elites to destroy our great country.

That’s possible. The thing I see happening if you call him a rapist though, is that folks will simply dismiss you as a kook. They won’t understand your thought process, and will just dismiss you. They might either way though. Take care.

While I agree with that, there are only a very few Republicans who aren’t in the same boat. I’ve tried to take the most vocal to task, but you’re right. It’s a massive problem.

Tancredo, Buchanan, Gilcrist, Simcox... who else is there?

Last year’s bill was shot down because John McCain refused to push his own bill when it was clear it was either the bill or the Presidency, and he made his choice.

This year, you’ll be amazed at the Republicans voting for amnesty. Oh excuse me, that word has been stricken form the Republican dictionary.

I’m not trying to be argumentative here, so take my comments for what they are. They reflect my observations. You don’t have to agree.

The Republicans, God love ‘em, don’t seem to have a clue when it comes to border issues. They believe that businesses need the labor. They believe that these are poor people just trying to improve their family’s future. They believe that those who speak out against illegal immigration are ultimately racists.

They do not understand fully the monetary impact on hospitals, schools, local communities, regions, states, and the nation as a whole.

They do not comprehend the crime problem. They don’t understand the law enforcement issues, people running across state lines to commit crimes in other jurisdictions. They don’t understand how gangs have been made worse, incorporated if you will, and spread into almost every community in the nation. This is in effect, and underground army, with different factions wielding power. That’s what Somalia is all about.

Then you have the problem with illegals voting. These people are being nationalized on a priority basis, and they are voting too.

The Republicans are either exceptionally blind and or stupid, or they have bought into the leftist’s arguments lock stock and barrel.

I think it’s a combination of the two. It’s okay if you don’t agree. I just wish people could see what is taking place in our nation, and confront it today.

Yes. I didn’t know what I was going to find when I searched for his mug shot, but I figured that whoever he was, he deserved to have his picture put up as kind of “wanted” poster.

Does 0bama have any slave blood? NO!

Where does Holder get off lecturing us about racism when he is only here due to his Barbados parents immigrating here? He has a right to lecture white people who have ancestors who fought in the Civil War? Or WW1 or WW2?

0bomo has even less right to bring up racism seeing that his Kenyan daddy donated sperm then took off. Wasn't even an immigrant. America was just a place where he studied for a few years

I was addressing the idea of him not being loyal to the United States based on his youth. We both understand how Obama spent major time during his youth in Asia, in Madrasas. I didn’t think Holder had spent time outside the U.S. That’s an important distinction, because it exposes kids to an anti-US vision, that may severely negatively impact their long-term vision of the United States. Of course you can get that in the U.S. today too, just by attending our public schools.

As for Holder or Obama criticizing our nation regarding the issues you mentioned, we’re sixty to one hundred years beyond those practices. So I don’t think anyone has the right to keep ragging on the U.S. over it. Should we study it? Sure. Should we continue to berate the nation as a whole over it? No.

I hate to say this, but racism is not on the decline in the United States. It is on the rise. Far from us being a color-blind society, color is the main thing minorities think of today. And today, we have something like 35% of our populace, given license, in fact championed to think of whites as racists. Hey, it’s okay to cast the whole White race as racists. Never mind the fact that anyone with that attitude, is a racist.

So when people raise the issue of racism today from a minority position, I just shake my head. I don’t care what color you are. And if you’re a minority, don’t come to me talking about racism. It’s a pathetic loser of an issue to raise these days.

I live in Mo Co (Montgomery Conty) ...

Its true - if you are stopped for say, a traffic ticket and the cops suspect you might be illegal, they cannot check your status ... only for “violent crimes” ...

But, it is NOT just that ...

Even if you are convicted for a violent crime, you may “earn” a “sentence modification” from the judge who sentenced you - if you are a “good boy” in prison ... and then you can get out early (like 4 years out of a 20 year sentence).

That is what happened in two instances in Mo Co recently and the perps went on to kill two innocent people - including a high school honors student ...

The people who drink the kool aid (DEMS) in Mo Co THEN wonder how this can happen ...

Sounds like a good opportunity for Prince William County to issue a warrant for the arrest of Montgomery County Executive Ike Leggett (Monkey county is in MD, and PW is in VA).

Art definitely crossed the line when he sent his criminal buddy to Virginia to hurt that little girl.

How about before they commit even the most minor offense? How about rounding them all up just for being here illegally? How about closing the border?

Here in Republican-land, our hospital was closed due to bankruptcy brought on by illegals. You want stupid, just check out your state legislature in session on their live cam web sites. It will make you sick watching the incompetency.

I know lots of great people who are recent immigrants to the US. They are honest, hard working and family oriented. The problem is that the politicians and bureaucrats have created a situation where recent immigrants are being encouraged to disobey and disrespect our laws and criminals are allowed to commit crime after crime with no consequence. I agree with everything you said about some Republicans and their being blind to the real problems and stupid about their implications. The problem is that the Democrats are actively pushing for special “rights” for illegal immigrants and allowing them to vote and actively forbidding their being arrested when they commit crimes.
The Democrats and the MSM are now publicly targeting a sheriff in Arizona because he actually enforced the law and arrested illegal aliens.

The illegal aliens who shot the teenagers in Newark were from Maryland and they had been arrested several times and released. This is only happening because the Democrat politicians are aggressively pushing it behind the scenes.
