Just because the legislature didn’t foresee this situation doesn’t mean the law doesn’t state that adoptions that take place in other states must be recognized in Florida. That is what the law says. The courts have to follow the law.
Roe vs Wade doesn’t apply here, nor do my personal feelings about lesbians. All that matters is what is written in the law.
You say we aren’t a nation of laws anymore, while stating that the courts should disregard the law regarding adoptions and make up their own. So I guess in your mind it is okay for the courts to disregard laws that you don’t like, but they should continue to uphold the laws you do. Either you don’t understand the concept of separation of powers, or you don’t believe in it. Either way you are wrong.
What is wrong is to allow a lesbian access to a young girl against the mother’s wishes.
The SPIRIT of the law was not meant to allow future sexual abuse.
If the circumstances of a particular situation are disregarded, then justice does not exist, and that justice is blind.
And Roe does apply here, as in finding laws that DON’T exist in the Constitution, then making THAT a law. If the High Court can’t follow the LAW, then there isn’t any law.
The law is politicized. I suppose you found that letting a woman starve to death, just a law, eh? What about Scooter Libby? Was that just? And Martin Armstrong? What law, where? The law has and is being twisted to use as a weapon against the average, Christian conservative. Making excuses and hiding behind “it’s the law” is just moral cowardliness.
Even Jesus was killed because of some LAW.
