Why? The courts have ruled voting is unConstitutional. :D

If it’s overturned, we can be sure Schwarzenegger will have our Attorney General appeal the ruling to the SCOTUS.

We may not like it. I won’t. What would you and I say if an initiative passed that forbid Californians to own any guns? We would want the Ninth Circuit Court to rule against that.

The initiative process is a Democratic process. It’s not the process of a Republic.

There are times when it works out and times when it doesn’t.

The voters got it right. I wouldn’t be surprised to see the Ninth overturn it on a civil rights basis.

Even with 7 of 9 justices on the Supreme Court appointed by Republicans, I’m not sure they wouldn’t strike down the initiative too.

I’d like to hear a good argument that would reassure me that they wouldn’t.

I’d be surprised if the court overrules the voters on this. Precedent is that they have allowed changes of this magnitude to the constitution by amendment before.

That said - if they do overturn, I don’t think there is anything that could be done. Even if the AG wanted to an appeal to the SC wouldn’t be an option as this is a state constitution issue.

Voters don’t exist I guess.

Someone just posted what this will do to language re: husband/wife; Forget natural law, history and what happened to other civilizations that went this route.

Lord have mercy on those who don’t study history... and don’t see the eugenics, social engineering and population control that comes with it.

When your masters, the oligarch, deem you so insignificant that they must slap you down because of your insolence to their ways.

They find a "technicality" to rule it on. What do you think they have been desperately looking for since the challenges hit them?

I think you need to come up with an example that is closer to the case at hand. I have a hard time conceiving of a hypothetical state proposition that bluntly denies the second amendment of the U.S. Constitution even getting on a ballot much less having the Ninth Circuit hearing arguments about it.
