The Supreme Court ruled moments ago that Chrysler cannot yet sell most of its assets to Fiat, a move that has been opposed by three Indiana state pension and construction funds.
The ruling grants a stay in the sale as the court gathers more data and schedules a hearing on the matter.
It temporarily blocks the way for Chrysler to complete its merger with the Italian automaker and begin its new, post-bankruptcy life.
The U.S. favors the Chrysler-Fiat merger and wants to remove the Indiana road block.
"I'm delighted it appears we will be getting our day in court," Indiana state treasurer Richard Mourdock said in an interview on CNBC.
Here's the text of the statement from Associate Justice Ruth Bader Ginsburg:
"UPON CONSIDERATION of the application of counsel for the applicants, and the responses filed thereto, IT IS ORDERED that the orders of the Bankruptcy Court for the Southern District of New York, case No. 09-50002, dated May 31 and June 1, 2009, are stayed pending further order of the undersigned or of the Court."

about time some sanity.
Glad to hear that they aren’t letting Obambi screw the secured creditors and rewrite contract law.
How dare the Supreme Court stand in the way of der Presidente.
Why do these stories all say the "U.S" favors this instead of "the Obama administration"?
When even Ginsberg questions something from obambi, you know they tried something really fishy!
The Kenyan’s administration IS the US government, for now.
The arrest and jailing of the Supreme Court will soon be on the administrations agenda.
One doesn’t mess with the 1’s socialization plans.
Note the Washington Post viewpoint: “The U.S. favors the Chrysler-Fiat merger and wants to remove the Indiana road block.” Can you imagine the Washington Post referring to a stance by the Bush admin as something the “U.S. favors”!?
Wouldn’t a more appropriate headline be:
U.S. Supreme Court slows the Obama administration attempt to run roughshod over U.S. corporate law.
Whoohoo! I kept wondering how the Obamites planned to keep this out of the Supreme Court since it overturns 200 years of contract law.
If they REALLY want to block "el jeffe 0bama" they should make him produce valid documentation that he is a "natural born" citizen.
So what does 0 do when/if the scotus dashes his plans? Ignore them or challenge them?
Isn’t that just like the Supreme Court - delaying things by following the LAW!
So it was Ruthie who stood in the way of Hussein’s illegal power grab? Will wonders never cease! When did she begin paying attention to the law?
Solicitor General telling the USSC that it did not have jurisdiction wasn’t such a smart move.
I recommend we flood Justice Ginsburg’s email inbox with Thank Yous....
[So what does 0 do when/if the scotus dashes his plans? Ignore them or challenge them?]
In normal times, the SC would slam dunk this like a nerf ball through a kiddie hoop, right now I’m not so sure. But if they do modify the Chrysler ruling Obama will be forced to repond ugly. That is, he will have to demonize the conservatives on the court. How far this will fly, given how egregious this as been in favor of the UAW, is anyone’s guess.
Thanks for the reply! Interesting times ahead.
If O pisses them off they may grant standing to one of the many BC law suits and he’ll have to produce, step down or go to jail. Seems they have a big stick hidden under their robes. Let’s see O call em.
Yep.
