Judge Sonia Sotomayor once described herself as a "product of affirmative action" while speaking on a Practising Law Institute panel. Judge Sotomayor aid that SAT and other aptitude tests have "cultural biases" built in.

Aren’t we all comforted to know that our country is run by a bunch of products of affirmative action? I wonder what would have happened if affirmative action were in place at the Springfield Armory in 1940, or at NASA in 1960?

Well, no. But there are real and measurable differences in relation to reading comprehension.

If the reading comprehension part of a test uses stories about things or places the reader has never, or rarely, encountered it measurably affects the reader's comprehension.

Of course, the race-baiters take it way too far, but there is a real issue in there.

I had no idea so I did some research...

In Asian culture eighty-eight (88) symbolizes fortune and good luck since the word 8 sounds similar to the word Fā (发, which implies 发财, or wealth, in Mandarin). The number 8 is considered to be the luckiest number of all in Chinese culture and prices in Chinese supermarkets can often be found containing many 8's (see numbers in Chinese culture). The Chinese government has even been auctioning auto license plates containing many 8s for tens of thousands of dollars. The 2008 Beijing Olympics opened on 8/8/08 at 8 p.m.

The only really culturally biased question I remember from any of my standardized tests (1410 on SAT) was having to know what a “Regatta” was.

Well actually I didn't HAVE to know, but it was in the question and I assume it would have thrown off anybody who was unfamiliar with the word.

For those of you in Rio Linda; a Regatta is a boat race, usually Crew, which is kind of an upper crust preppy sport.

Reading “the Mismeasure of Man” by Gould also showed the cultural bias of many “IQ” tests given to Immigrants (many of whom could not speak English, didn't know what a tennis court was, or that steepled buildings in the USA were usually Christian churches).

Things are not quite so blatant these days; and I reject the premise that these tests are significantly culturally biased - unless your culture doesn't speak English, read books, take tests, etc; in which case the person probably wouldn't do too well in an “academic culture” such as a university anyway (which is what the test is designed to do).

I understand what you’re saying but isn’t that the whole point of linguistic education? To expand one’s ability to comprehend what one one reading in that given language? I have rarely tilted at windmills yet I tested very well on comprehension of Don Quixote in it’s original language.

Also, black and Hispanic math scores are proportionally just as low compared to white. That’s not ethnic bias.

Of course there is a real issue there. The problem is the remedy.

Nothing can substitute for individual initiative and commitment.

Name any countries in the entire world, other than the US and perhaps Canada, which lowers its standards to allow for "cultural differences..."

After all, the incompetent will victimize other cultural clones, or have to practice in the culture which "bewilders" him or her. Neither attractive options.

Agreed.

But the comprehension difficulties are not racially, but culturally and linguistically rooted.

For example, though you and I both read and speak english, I could write prose about narrow subjects or use more region-specific terms and affect your comprehension, even if only a little. It would at least slow down your reading, as you worked to recall or understand the terms.

Take this simple sentence as an example: "Richard's PC was nearly useless at the moment since the modem wouldn't connect."

Present that sentence to an intelligent, literate Amish teenager and see if his comprehension isn't affected.

Again, I'm only pointing out that there is a small kernel of truth to the issue. I don't agree at all with the degree or manner of the race-baiters' treatment of it.

I grew up in a foreign country, in a town so small and "primitive" that there were zero motor vehicles in town, and the local airline used Ford trimotors ---- in 1947.

After moving to the US, by Jr high school I not only knew what a regatta is, but also polo, caviar, sitting room.

We're dealing with the hyphenated-American disease here...

Oddly, I'm of Mennonite decent, named Richard and an IT professional. ;-) But if I was teaching IT classes again and some Amish kid took my class and couldn't answer that question he wouldn't deserve to pass. That's the point of my class.

Ms. Sotomayor didn't hit the books hard enough and probably wasn't read to as a kid.

I am sure that there is a greater % of East Coast prep school preppies that know what a Regatta is than those raised in small town America.

But as I said, it is the ONLY “culturally biased” question that I remember. And even that was a stretch as one didn’t actually need to know what it was to get the correct answer; although I assume that seeing an unfamiliar word might well have thrown some off their game.

So to be clear; I reject the premise that these tests are culturally biased to any significant degree.

In fact for years now a question will be thrown out if it showed any discrepancy in who got it correct vs who got it wrong (race, socioeconomic status, etc).

Affirmative action beneficiaries don't have a very good track record of success. Remember the famous Bakke case? Bakke was a white guy denied admission to the UC Davis Med School in favor of a black man named Patrick Chavis.

Ever wonder what became of Patrick Chavis, one of the first poster children for affirmative action?

From National Review:

....the Medical Board of California suspended his medical license, partly on account of Chavis's "inability to perform some of the most basic duties required of a physician." Chavis was found to have been guilty of gross negligence and incompetence in three cases; the judge overseeing his case ruled that letting Chavis "continue in the practice of organized medicine will endanger the public health, safety and welfare."
