So wrote former sailor Steven Nary from his cell in Avenal State Prison in the middle-of-nowhere, California. Nary, now 32, had just endured a 3 ½ hour parole hearing, his first after more than thirteen years of incarceration.
Despite a near perfect prison record, a long standing conversion to Catholicism, an excellent psychiatric report, almost enough college credits to graduate, numerous letters of support, several job and living offersincluding one from my wife and meand the imperative of Californias empty coffers, Narys bid for parole was rejected out of hand.
As the heartbroken Nary learned, he will not be eligible for another hearing for five more years.
On the same day Nary was undergoing his ordeal, the Leather Pride Contingent was celebrating Gay Pride Week in San Francisco with its second annual Dirty Jock Strap Sale.
Ten years ago, Nary had been tried for second-degree murder in San Francisco in the very same week that Russell Henderson, one of Matthew Shepards killers, was being tried in Laramie, Wyoming.
The timing of the hearing might have been coincidental, same for the trial, but it is unlikely that they both were. Nary had killed a gay man, and San Franciscos political class is always eager to unruffle gay feathers.

First time I have heard this story. Yes, a grave miscarriage of justice. He never should have been jailed at all. But in a sick state like California, with a governor who panders to the left, I don’t know what chance he has of a pardon—which he certainly deserves.
Yes, Nary probably killed the guy, but he was probably given the “date rape drug” and does not remember much about it all.
There is absolutely NO doubt that the politicians and the legal system in California have violated the law, at worst, and acted with extreme cowardice, at best, in this case.

Apologies, I found the link to the full story and read further. It does seem like a clear case of self-defense, based on the web site’s explanation. If this is true, a clear miscarriage of justice, and I hope Schwarzenegger looks into it soon.
First of all, the man Nary probably killed was a sexual predator, who apparently made a practice of date-raping young men, many of whom were not even gay, themselves.
Next, the State of California and the local authorities violated several of Nary’s rights, when they went aboard a U.S. Navy ship, without permission, to arrest Nary.
Also, it is clear that authorities have interfered in Nary’s legal defense, and with his mail, to and from various people, as Nary tried to get help from politicians and the legal authorities.
The case is a travesty.
The queer slipped him a date rape drug and tried to rape him. It was self defense, and few guys I know would NOT kill such an assailant if the opportunity arose.
I don't know what kind of lawyer he had- there should have been at least a change of venue to somewhere where normal people could be found to serve as jurors. In SF, telling the truth, that he was disgusted by the queer's attempt on him, doomed him from the get-go. Made him one of those mean ol' intolerant people...
Matthew Shepard was not killed because of his sexual preferences. The belief that he was killed because of homosexuality is a fabrication.

If Nary was black, he’d be out.
