Palin attorney warns media over 'defamatory' charges

As Gov. Sarah Palin blasted the media Saturday in a tough Facebook post, her attorney delivered a strong warning to news outlets that they should not report any stories that allege the Alaska governor is leaving office because she is under any kind of federal investigation.

CNN has not reported these allegations were in any way connected to the governor's decision to leave office early.

"To the extent several websites, most notably liberal Alaska blogger Shannyn Moore, are now claiming as 'fact' that Governor Palin resigned because she is 'under federal investigation' for embezzlement or other criminal wrongdoing, we will be exploring legal options this week to address such defamation," said lawyer Thomas Van Flein in a letter (pdf) sent to reporters Saturday.

"This is to provide notice to Ms. Moore, and those who re-publish the defamation… that the Palins will not allow them to propagate defamatory material without answering to this in a court of law."

The MSM must keep in mind that Palin has the First Amendment Right to say that she will file suite against any media outlet that reports rumors regarding the governor.

You must have “actual malice” to win, if you are a “public figure” -— meaning if you are a celebrity or public official of any type.

“Actual Malice” must mean that you knew it was false before you said it or printed it.

I suggest that Shannyn familiarize herself with the legal concept of 'discovery' very soon.

The Palins will strip her life open like an over ripe banana and expose where her finances are coming from. I'm guessing the name "Soros" is somewhere to be found.

And we all know how lawyers love deep pockets.

This is a half truth intended to make Palin look like an authoritarian, anti-1st Amendment censorship queen. They can print all they want about the dimwad Moore's allegations. What they can't do is plunge feet first into the malice party, representing this garbage as truth without any substantiation beyond Moore's sayso.

They filed all these BS ethics complaints against Sarah Palin. Filing an ethics complaint is super easy in Alaska

Palin has spent 4600,000 on legal bills and owes money on them

Best case scenario--they were waiting for a Palin-basher to cross a clear line into action for slander and libel. Even for a public figure, this appears to satisfy the definition.

We could probably do some investigation of this Moore person right here on FR.

Found it interesting about Spenard’s in Alaska. When I lived there in the 80s, Spenard’s was it if you wanted construction materials. Hadn’t heard the name in a long while.

CNN pretty quick in defending themselves. MSNBC should be the ones worried after Shuster invited Shannyn Moore who is spreading the rumor and trying to imply it's true.

ANCHORAGE, Alaska — Alaska Gov. Sarah Palin says her political enemies are abusing state law with a flurry of frivolous ethics complaints against her, putting her more than $500,000 in legal debt.

Those filing the grievances _ there have been at least 18 cases so far _ say it's their legal right to hold the Republican governor accountable for what they see as abuses of power.

The truth is probably somewhere in between.

"Are Alaskans outraged, or at least tired of this yet _ another frivolous ethics charge by a political blogger?" Palin asked in one statement.

Most of the complaints have been filed since last August, when GOP presidential candidate John McCain picked Palin as his running mate. And most have been denied.

Palin's office has called the multiple dismissals "mounting evidence that accusations of wrongdoing by the governor lack merit and have been politically or personally motivated."

Even some of Palin's critics question the validity of some of the complaints, and her supporters have waged a weeklong Webathon to raise money for a legal defense fund set up for the governor, ringing up more than $109,000 by day seven, Sunday.

That letter appears to be authentic, and I sure hope it is. If so, good for you Sarah and Todd and your attorneys. It’s past high time that the liars and haters and their henchmen in the media are held responsible for their calumny.

I take particular satisfaction in the naming of specific organizations such as MSNBC and the rest.

On Friday July 3rd, I received an email that indicated there may be an indictment looming against Sarah Palin. Although I didn’t post the information here, I did post it as an update to an essay published elsewhere.

I believed it at the time, and am not yet totally sure the information as erroneous. That update may have been the first of a cascading set of events that Shannyn is now taking the heat for, totally without justification. If the heat should go on anyone for this, I suppose it should be me.

But I didn’t post it as “fact,” but that I had received the information as part of an email. And in the article to which it was an appended update, it fit into the context of trying to speculate on the ramifications of very quickly breaking news that made little or no sense. It still makes little or no sense.

Despite the fact that she specifically refers twice to the report as a “rumor,” Van Flein says she portrayed the story as fact. The only fact is that there are rumors. I know because I’ve been hearing them since last October. They even have a name - “Housegate.” If you Google “Palin Housegate,” you get 8,600 references, beginning back with an article that appeared in the Village Voice. Googling “Palin sports complex scandal” gets you 230,000. How many mentions are required to constitute a rumor? It’s probably less than 230,000. I’m not exactly sure how the legal dynamic duo of Palin-Van Flein is planning to un-rumorize almost a quarter of a million online references to a rumor that started 8 months ago, but it will be interesting to watch.

I watched Shannyn’s piece on MSNBC...both she and David Schuster were VERY CAREFUL to say that what she was discussing were rumors circulating in Alaska for weeks. Up here, you can’t ignore rumors. (You know, like the rumors circulating for weeks about Bristol’s pregnancy...those sure turned out to be false, didn’t they?)

Regarding the speculation (something we are doing a good bit of on this blog as well), Palin CANNOT expect to leave the State of Alaska...hell, the entire country...hanging and not expect rampant rumors to persist. Then again, she’s Sarah Palin...I guess she expects to have EVERYTHING the way that SHE wants it!

Combinations with the word "scandal" must necessarily appear fewer times.

When you make a search for a given expression you have to bracket it with quotes or you will get the total word count for all the words in the expression.

We were sitting in our seats at the pharmacist's waiting for our name to come up so we could get some pills when this woman started shrieking and cursing ~ just going crazy.

She'd just seen Sarah Palin appear on the TV that'd been provided for people waiting.

I asked her what was wrong and all she could do was to keep screeching "she's a cockroach, she's a cockroach".

I wrote it off as delerium tremens ~ a problem frequently found in Democrat terminal alcoholics.

It’s not necessarily winning or losing any defamation lawsuits that is the essential goal here, although there are a great number of irresponsible people who richly deserve to be legally kicked in the teeth.

It’s the “discovery” process. It will be enlightening to see how many cockroaches scurry away from the light if the scurrilous attacks against the Palins continue and the Palins bring suits against the attackers.

With respect to the rumor-mill that was desperately trying to churn out the extortion lies, I carefully watched twitter to see who said what, then doubled back doing some research of my own trying to locate the origins of the stories.

Then I conducted a WHOIS search on a powerful tool I use which found the main websites linked together to one main site are all inter-related... and a lawyer/former lobbyist is the Registered Admin for the site. She is extremely highly connected - to a powerful lobbying legal firm - and the who's who throughout Washington, New York, Chicago and beyond. I checked into her facebook connections AND her trail of contacts/connections through the mapping tools at muckety. It blew me away.

I nexted checked into the Technical Admin. No surprise to find that he is an SEO Streaming Email teckie geek - a real master, knows his stuff extremely well. What did surprise me is his ownership in a solar company specializing in solar power.

Many of the sites connected thru that one website you will recognize. They've been mentioned in comments here (plus there are more).

Some of the names connected to their web through the lobby legal firm will blow your mind. It will shock you how high the connection goes... and how deep.

I've not mentioned names here because I don't know who to trust with this information. It's out there, if someone has the patience to dig deep and far enough.

This is more than a machine -- it is a monster of massive proportions. My hope is that Sarah will succeed in bringing it down.


There is no doubt that the smear campaign is well funded and orchestrated. The important question is how high does it go and if public money is being used. Finally, someone is calling the shots to synchronize occupation media, leftist blogs, political operatives and corrupt judges.

I think one of the things we can do to help is link back all of our findings to the Conservatives4Palin website. This is where her lawyer has decided to make the public legal announcements of intent. Anything of “value” and not “noise” will help in here legal work as well as discovery process.

You are totally right; reporters & pundits really don't get this, and I hate it whenever I read a line like the one in the article. Reporting the number of search results for a phrase really provides no metric of anything and it's ridiculous when you hear someone using numbers like these to try and prove any kind of point.
