Report: Fired Inspector General Sues Obama to Get Job Back

The government watchdog President Obama fired last month for allegedly being "confused" and "disoriented" filed a lawsuit Friday to reclaim his job, the Washington Times reported.

Gerald Walpin, who was the inspector general for the Corporation for National and Community Service until President Obama removed him, argues in the lawsuit that the firing was politically motivated and broke a 2008 law governing how watchdogs can be dismissed, the newspaper said.

I do know that the firing generated quite a bit of interest over at the FBI, and they have opened an investigation into all of Walpin’s claims. Ironic that this had only been a civil matter, but now has progressed into a criminal investigation.

I don't know this blog,
but after looking around,
this seem to sum it:

Short version: Walpin was investigating Obama crony’s involvement in an AmeriCorps-related scandal involving misappropriation of funding. Case was settled, to the mild detriment of crony*. Walpin disagreed with settlement. Complaint made against him. So far, this is all he-said, he-said.

Then the White House tried to force out Walpin; Walpin, well aware of his rights, made them go through the process. At this point, Senator Charles Grassley - Republican - stepped in, as IG issues are one of his interests. Grassley would also like to know if the First Lady’s office is involved in this somehow, given that her CoS is going over to run the Corporation for National and Community Service, who Walpin was also responsible for oversight over. Meanwhile, Senator Claire McCaskill - Democrat - has also stepped in, as she too is usually associated with IG protection. That makes this officially a matter of bipartisan concern, which means that the White House of course is doing everything it can to address said concerns seriously.

I’m kidding, of course. No, what the White House is actually doing, of course, is trying to imply that Walpin’s senile:

WASHINGTON — Responding to criticism from a Senate Democratic ally, President Obama explained why he fired the Inspector General of the AmeriCorps without the 30-day notification required by law, calling Gerald Walpin so “confused” and “disoriented” that there was reason to question “his capacity to serve.”

As Ed Morrissey noted, believing that this was the White House’s primary motive requires that you believe that the administration’s instinctive, immediate reaction to seeing an employee come down with a debilitating disease is to fire them. Yes. That is precisely the thing that one does when one wishes to maintain a reputation for empathy and tolerance. I can’t say that I have as much difficulty as Michelle Malkin reconciling the allegation of Walpin’s mental diminished capacity with his public appearances (see the video above), mostly because neither I nor Ms. Malkin can take it at all seriously…

Good! A bit more from Washington Times, Fired inspector general files lawsuit

.........."He also said in its haste to dump him, the administration never interviewed him or any of his staff - an omission Mr. Walpin said in his lawsuit violates a 2008 law meant to protect government watchdogs.

The law requires that Congress be notified 30 days before an inspector general is dismissed, and Mr. Walpin contends that the administration has yet to meet the requirements for who should be notified and what reasons must be given.".....................

............."Though it's not part of the suit, Mr. Walpin's lawyers said in their legal brief that the case "raises serious questions of age discrimination" because of the accusations that Mr. Walpin, who is in his late 70s, seemed unable to function. ".................

I hope he claims TOTUS does not have the authority to have him fired based upon Obama not being eligible to hold the office. Produce the long form birth certificate!

I haven’t seen the complaint, but I hope he’s suing Obama personally for acting outside his official capacity. In other words, Obama didn’t have the authority to fire him in the manner in which he was fired, and Obama would have to hire a private law firm to defend himself...and would have to pay any settlement out of his own pocket.

He ought to file an action under the Americans with Disabilities act, too.

Was any attempt at a 'reasonable accomodation' made?

If not, it's off to Federal Court.

Once again, it's the coverup, stupid. Obama could have done it the right way and although, Walpin might not have liked it, he would have little recourse.

But in their haste to fire him, the skirted the laws - laws that Obama was even involved in writing and to justify that mistake, they impugned his character by claiming he was incoherent and incompetent. Up to that point, maybe he would have gone away, but as a proud man, he is determined to get his reputation back.

Wonder who the Obama version of Craig Livingstone will be.

He didn’t do anything wrong that I can tell. Glen Beck gave him some kind of pre-hospitalization mental test which of course he aced. Totally political, to protect the One and his wife’s buddies.
