1. In 2001, Kevin Allen Ake was living at a YMCA in Illinois, apparently "so that he could assist an elderly member of his church who lived there." Several months after moving in, he was evicted, in his view because of his "efforts to begin a bible study program at the YMCA." As a result, he left a bunch of messages on the voice-mail of the YMCA's executive director, who was a lesbian; he denies that the messages contained explicit threats, but says he "basically shared what the Bible talked about was -- with that kind of unnatural lifestyle -- about lesbians and homosexuality."

Ake was then prosecuted and convicted for telephone harassment, which covers telephone calls made "with intent to abuse, threaten or harass." Two newspaper accounts reported that he was found guilty of leaving threatening messages, but nothing in the Illinois indictment, or in the Pennsylvania opinions that I read, makes it clear -- it seems possible that the finding was simply that he made the calls with the intent to "abuse ... or harass" rather than with the intent to threaten. In any case, though, telephone harassment, even harassment that isn't expressly threatening, is a crime; the laws banning it are generally seen as constitutionally permissible speech restrictions (with some exceptions); and the story here is in any event not about that conviction, which may well have been perfectly sound.

2. Now generally speaking, telephone harassment is a misdemeanor. But Ake was apparently motivated at least in part by the executive director's homosexuality, which made it a felony hate crime. Ake was thus convicted of a felony, and sentenced to 14 days' in prison, with credit for time served before trial, plus 2½ years' probation, 200 hours of community service, and a $2000 fine.

This is the first that I heard about this case. Here we have a perfect example of the danger of "hate crime" laws. The filthy leftists have basically silenced this man because of his faith, and were trying to deny him the right to practice his trade. The PA Commonwealth Court reversed the latter, but it was a 2-1 decision.

Folks, this is Stalin/Hitler stuff here. All that talk about respecting the First Amendment is just that, talk. These sodomites want to silence anyone that disapproves of their deviant lifestyle.

This is proof.

We went through this when we opposed a gay family video. They called us all kinds of names...scare tactics is what it was. This is typical Marxist “divide and conquer”.

As I have said before, any crime is a hate crime and what they are doing with this is silencing free speech. Pure and simple...they make it sound as though you are hateful, but in reality it’s just your opinion.

PC is based on Marxist principles...don’t ever give into it!

The Young Men's Christian Association (”YMCA” or “the Y”) has grown to become a worldwide movement of more than 45 million members from 124 national federations affiliated through the World Alliance of YMCAs.

Founded on June 6, 1844 in London, England, by George Williams within eleven years it has become an international movement. The original intention of the organization was to put Christian principles into practice. Young men who came to London for work were often living in squalid and unsafe conditions, and the YMCA was dedicated to replacing their life on the streets with prayer and Bible study. The YMCA idea, which began among evangelicals, was unusual because it crossed the rigid lines that separated all the different churches and social classes in England in those days. This openness was a trait that would lead eventually to including in YMCAs all men, women and children, regardless of race, religion or nationality. Also, its target of meeting social need in the community was dear from the start. Now the YMCA uses a holistic approach to individual and social development encompassing spiritual, intellectual and physical methods. This approach is symbolized by the inverse red triangle used by YMCAs around the world representing the YMCA mission of building a healthy spirit, mind, and body.
